There is no single hotline or state agency that investigates most complaints against a Florida homeowners’ association, and that surprises people who assume HOAs are regulated the way condominiums are. To report HOA abuse in Florida, you have to match the type of abuse to the right channel: a written records request and formal demand for internal disputes, presuit mediation before any lawsuit, binding arbitration through the Department of Business and Professional Regulation for election and recall fights only, a HUD complaint for housing discrimination, local law enforcement for financial crimes, and circuit court as the last resort.
Why No State Agency Investigates Most HOA Complaints
Florida homeowners regularly call the state expecting an investigator. It does not work that way. The Division of Florida Condominiums, Timeshares, and Mobile Homes at DBPR investigates condominium complaints under Chapter 718. Homeowners’ associations sit under Chapter 720, which gives the division no comparable authority. If you find a state complaint form online, check what it covers before you file. The DBPR forms are for condominiums, cooperatives, and mobile home parks. Submitting one about your HOA produces a jurisdiction letter, not an investigation. The single exception is election and recall arbitration, covered below.
That gap in state enforcement is why the burden falls on you. The reporting paths that follow are the ones Florida law actually gives homeowners.
Start With a Records Request and a Written Demand
Before anything else, get the paperwork. Your right to inspect the association’s official records is the strongest lever you have, and it is the one boards most often try to block. Florida law requires the association to make records available within 10 business days of a written request, kept within 45 miles of the community or within the same county.2Florida Senate. What you can inspect is broad: meeting minutes, financial and accounting records, insurance policies, contracts, bids, the membership roster, and all governing documents and amendments.2Florida Senate. If you suspect selective enforcement, meeting minutes may show how the board treated other violations.
Send the request by certified mail with return receipt. That detail matters. If the association fails to produce records within 10 business days of a certified-mail request, Florida law presumes the failure was willful. You can recover actual damages or a minimum of $50 per calendar day starting on the 11th business day.2Florida Senate. Florida Statute Chapter 720 Section 303 Repeated knowing violations by a director or manager are a second-degree misdemeanor, and deliberately withholding records to conceal a crime is a third-degree felony.
Once you have the documents, put your complaint in writing to the board. Certified mail again, receipt kept. Identify the specific act, cite the section of the governing documents or statute being violated, and propose a concrete resolution. A letter naming Section 4.3 of the Declaration and attaching dated photographs lands differently than a general complaint about unfairness.
Build an evidence file while this plays out. Photograph everything with dates. Save every email and letter. Attend board meetings, where you have the right to speak on any agenda item, and log what happens.3The Florida Legislature. Demand Presuit Mediation Before Filing Suit
For most HOA disputes in Florida, you cannot walk into court. The law requires you to demand presuit mediation first. That covers property use, common-area changes, covenant enforcement, amendments to governing documents, board and committee meetings, membership meetings other than elections, and access to official records.4Florida Senate. To start, serve a written demand for mediation on the association. Both sides then agree on a certified mediator and split the cost. Take the process seriously even if you doubt it will settle anything. If you skip mediation or refuse to fully participate, you forfeit the right to recover attorney fees even if you later win in court.5The Florida Legislature. Report Election and Recall Disputes to DBPR
Elections and recalls are the one category where a state agency actually gets involved. The Division of Florida Condominiums, Timeshares, and Mobile Homes handles binding arbitration for these disputes.6Cornell Law School. If you believe the board seated an ineligible member or ran an election that violated the governing documents, you have 60 days from the announcement of results to challenge it.7The Florida Legislature. Florida Statute Section 720.306 – Statutes and Constitution: View Statutes: Online Sunshine
Recalls run in the other direction. When homeowners collect enough support to recall directors, the board must either certify the recall or file a recall arbitration petition with the division. If the board does neither, the homeowners driving the recall can file the arbitration petition themselves.6Cornell Law School. File a Fair Housing Complaint With HUD
If the abuse involves discrimination based on race, color, religion, sex, national origin, familial status, or disability, a different set of protections applies. The federal Fair Housing Act prohibits housing discrimination by any entity, including HOAs.8U.S. Department of Justice, Civil Rights Division. You have one year from the last discriminatory act to file a complaint with the U.S. Department of Housing and Urban Development. HUD investigates, attempts conciliation, and issues a determination of whether reasonable cause exists to believe discrimination occurred. Report Criminal Conduct to Law Enforcement
Some HOA abuse is not a civil dispute at all. Florida law requires that a director or officer charged with theft or embezzlement of association funds be removed from office immediately. Any officer, director, or manager who solicits or accepts a kickback from a vendor doing business with the association commits a third-degree felony.10The Florida Legislature. Report suspected embezzlement, kickbacks, or other financial crimes to your local law enforcement agency or the state attorney’s office in your county. These are criminal matters and do not require mediation first. Use your records-inspection rights to gather documentation before you make the report. Bank statements, vendor contracts, and meeting minutes give investigators something concrete to work with.
Filing a Lawsuit in Circuit Court
When mediation fails and no other channel resolves the dispute, a suit in circuit court is what remains. HOA litigation combines contract law, real property law, and Chapter 720, so a Florida attorney with HOA experience is effectively required.
Understand the financial exposure before you file. Florida’s dispute resolution statute lets the prevailing party recover attorney fees and costs from the losing party.5The Florida Legislature. The mediation requirement feeds directly into this risk. A court can deny you attorney fees even after a win on the merits if you refused to participate in mediation.5The Florida Legislature.
