How to Respond to an AC Suit on Account in Missouri

If you’ve been served with an AC suit on account in Missouri, the single most important thing you can do is appear in court on the return date printed on your summons. An associate circuit suit on account is a debt collection lawsuit, usually over a credit card, medical bill, or merchant account, filed in the division of circuit court that handles civil claims of $25,000 or less.1Missouri Revisor of Statutes. Missouri Code 517.011 – Applicability of Chapter Miss that date and the judge can enter a default judgment against you for the full amount demanded. Show up with your defenses in writing and you force the plaintiff to actually prove the debt.

Find Your Return Date First

Associate circuit cases don’t work like standard civil lawsuits. You don’t get thirty days to mail in a written answer. The summons you were handed lists a specific date and time when you must appear in person, and that is your deadline. If you miss it after being properly served, the judge can enter a default judgment for the amount the plaintiff requested.2Missouri Revisor of Statutes. Missouri Code 517.131 – Default Judgment, When Entered

Confirm the date and the courtroom. Put it on your calendar. If you cannot physically attend, call the clerk’s office before the date to ask about appearing by counsel or requesting a continuance. Doing nothing is how most defendants lose these cases, and it is almost always preventable.

Check How You Were Served

Missouri law requires that the summons and petition be delivered by a sheriff, deputy sheriff, or court-appointed special process server.3Missouri Revisor of Statutes. Missouri Code 506.140 – Who Shall Serve Process A plaintiff cannot simply mail the papers or hand them to you themselves. The server must file written proof of service with the court documenting when, where, and how you were served.4Missouri Revisor of Statutes. Missouri Code 506.180 – Proof of Service

If you were never properly served, the court lacks personal jurisdiction over you and cannot enter a valid judgment. That is a defense you need to raise promptly, because showing up and arguing the merits can waive it.

Know What the Plaintiff Must Prove

A suit on account is not a single-contract breach claim. It’s a theory that a running account existed between you and the plaintiff, and that a balance went unpaid. Missouri appellate courts require the plaintiff to prove four elements, and failure on any one of them should sink the claim:

  • You requested the goods or services, by signed agreement, verbal request, or conduct like swiping a card.
  • The plaintiff actually delivered the goods, performed the services, or extended the credit.
  • The charges were reasonable, either agreed to in advance or reflecting fair market value.
  • Payment was demanded and not made.

A plaintiff who arrives with only a final balance and no transaction-by-transaction breakdown has a much harder time carrying this burden. Missouri court rules require that when a petition is based on an account, the plaintiff attach a statement of account or itemized breakdown of the charges. If the petition you received doesn’t include that, you can challenge its sufficiency.

Defenses to Put in Your Written Answer

Every affirmative defense needs to be raised in writing. Skip one and you may lose the right to assert it later. The defenses that come up most often in a suit on account:

  • Statute of limitations. Missouri gives creditors five years to sue on a contract-based claim, including a suit on account. The clock generally runs from the date of the last payment or the last charge, depending on circumstances. If the five-year window closed before the lawsuit was filed, raise it in your answer. The court will not check for you, but once you assert it, a time-barred case should be dismissed.5Missouri Revisor of Statutes. Missouri Revised Statutes 516.120 – What Actions Within Five Years
  • Payment. If you already paid the balance or part of it, bring proof. Bank statements, canceled checks, receipts.
  • Accord and satisfaction. If you offered a partial payment as full settlement and the creditor accepted it, the debt may already be resolved. This comes up often with medical bills that were negotiated down.
  • Failure of consideration. If goods were defective, services were never completed, or what you received didn’t match what was promised, the plaintiff has not held up their end.
  • Wrong defendant. Debt buyers sometimes sue the wrong person because of incomplete records. If the account isn’t yours, challenge standing and identity early.
  • Improper service. Covered above. If service was defective, raise it before engaging the merits.
  • Unauthorized interest or fees. Interest and attorney fees are only recoverable if the original agreement authorized them or a statute permits them. A petition demanding fees the contract never allowed should be challenged.

Check Whether the Case Was Filed in the Right County

Missouri law lets a plaintiff file a non-tort claim like a suit on account in the county where you live, or in the county where the plaintiff resides if you can be found there.6Missouri Revisor of Statutes. Missouri Code 508.010 – Venue for Nontort and Tort Suits

When a third-party debt collector files the suit rather than the original creditor, federal law adds a tighter restriction. The Fair Debt Collection Practices Act requires a debt collector to sue in the judicial district where you signed the original contract or where you live when the lawsuit begins.7Office of the Law Revision Counsel. 15 USC 1692i – Legal Actions by Debt Collectors A collector who drags you into a distant county violates federal law and opens itself to a counterclaim.

What Happens at the Return Date

If you appear and contest the debt, the case proceeds to a bench trial. There is no jury at the associate circuit level. The judge hears evidence, the plaintiff must prove each element of the claim, and you get to cross-examine witnesses, challenge documents, and present your own evidence. Judges in these courtrooms see hundreds of debt collection suits and notice when records have gaps.

Before any default judgment can be entered against a defendant who did not appear, the plaintiff must file an affidavit stating whether you are on active military duty. The Servicemembers Civil Relief Act protects service members who cannot defend themselves because of deployment.8Office of the Law Revision Counsel. 50 USC 3931 – Protection of Servicemembers Against Default Judgments

If You Lose: You Have Ten Days

Any party who disagrees with an associate circuit judgment has the right to a trial de novo, a brand-new trial before a circuit judge with fresh evidence.9Missouri Revisor of Statutes. Missouri Code 512.180 – Appeals From Cases Tried Before Associate Circuit Judge This is not a review of the first trial for errors. It is a do-over.

The deadline is strict: you must file the application for trial de novo with the clerk within ten days of the judgment being entered.10Missouri Revisor of Statutes. Missouri Code 512.190 – Perfecting Right of Trial De Novo, How Miss it by a day and the right is gone. A filing fee applies; ask the clerk for the current amount.

What a Judgment Actually Does to You

Ignoring a suit on account carries real consequences. A judgment is not just a piece of paper.

Missouri applies 9% annual interest to money judgments on contract claims. If the original agreement carried a higher rate, that higher rate applies instead.11Missouri Revisor of Statutes. Missouri Code 408.040 – Interest on Judgments and Orders On a $10,000 judgment, that’s $900 per year in interest alone.

Associate circuit judgments do not automatically become liens on your real estate. They only attach after the creditor files the judgment with the circuit court clerk.12Missouri Revisor of Statutes. Missouri Code 511.350 – Judgments and Decrees, Liens on Real Estate Once recorded, the lien sits on real property you own in that county, and you cannot sell or refinance without clearing it.

Wage garnishment is the most common enforcement tool. Federal law caps garnishment at 25% of disposable earnings, or the amount by which weekly pay exceeds 30 times the federal minimum wage, whichever is less.13Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Missouri goes further: if you are the head of a household and a Missouri resident, the cap drops to 10% of disposable earnings.14Missouri Revisor of Statutes. Missouri Code 525.030 – Maximum Part of Aggregate Earnings Subject to Garnishment Claim that protection if it applies to you.

If a Debt Collector Is Suing You

When the plaintiff is a debt buyer or collection agency rather than the original creditor, the FDCPA gives you additional leverage. Beyond the venue rule above, a collector cannot inflate the balance, misstate the legal status of the debt, threaten actions it cannot legally take, harass you with repeated calls, or tack on fees the original agreement never authorized.

Suing on a time-barred debt can itself be an FDCPA violation. If a collector violates the Act, you can sue within one year and recover actual damages, statutory damages up to $1,000, and attorney fees. Raising an FDCPA counterclaim in the same case is a legitimate strategy that sometimes motivates the collector to dismiss or settle.

One misconception worth clearing up: filing a lawsuit does not by itself trigger the FDCPA’s debt validation notice requirement. Federal regulations exclude formal court pleadings from the definition of an “initial communication” that starts the 30-day validation window.15Consumer Financial Protection Bureau. 12 CFR 1006.34 – Notice for Validation of Debts If the lawsuit is the first contact you’ve had, do not assume the collector was supposed to send a validation notice first.

Bankruptcy as a Last Resort

Filing bankruptcy triggers an automatic stay that immediately halts any pending suit on account. Creditors who keep pursuing the case after learning about the filing risk sanctions.16United States Courts. Discharge in Bankruptcy – Bankruptcy Basics Most debts behind a suit on account, including credit card balances, medical bills, and trade accounts, are dischargeable. Debts obtained through fraud can survive, but only if the creditor affirmatively asks the bankruptcy court to rule the debt non-dischargeable. A valid lien that existed before the filing, however, can survive and remain enforceable against the secured property.

Bankruptcy carries long-term credit consequences and is not a step to take lightly. But if a judgment is already compounding at 9% interest and garnishment is coming, it is worth understanding before the first paycheck disappears.
