To revoke a power of attorney in New York, sign and date a written revocation and deliver it to your agent. Under General Obligations Law 5-1511, that delivery — in person, by mail, courier, fax, or electronic transmission — is enough to end the agent’s authority, and the agent must honor it even if they believe you lack capacity, unless a court has already appointed a guardian over your affairs.1New York State Senate. New York General Obligations Law 5-1511 – Termination or Revocation of Power of Attorney; Notice The document itself is the easy part. What takes work is making sure everyone who relied on the old POA — your agent, your banks, the county clerk, the IRS — actually knows it is gone.
Drafting the Revocation
New York does not require a specific form. Your revocation should identify the original power of attorney by its signing date, name the agent whose authority you are ending in full, and state clearly that you are revoking all authority you previously granted. If you only want to pull back some powers and leave others in place, spell out exactly which ones.
Sign and date it. The statute does not require notarization or witnesses, even though the original POA needed both under GOL 5-1501B.2New York State Senate. New York General Obligations Law 5-1501B – Creation of a Valid Power of Attorney Notarizing anyway is still the right call. Banks and title companies accept a notarized revocation with less friction, and you will need notarization if the document has to be recorded with a county clerk. New York caps notary fees at $2 per signature, so this is not a cost decision.3NY Department of State. Notary Public – Frequently Asked Questions
Make several copies. You will need them for your agent, every financial institution the agent dealt with, potentially the county clerk, and your own file.
Delivering the Revocation to Your Agent
A signed revocation sitting on your kitchen table does nothing. Your agent has to receive it before the revocation binds them, and until they know, any good-faith action they take under the old POA can still bind you.1New York State Senate. New York General Obligations Law 5-1511 – Termination or Revocation of Power of Attorney; Notice
Send it by certified mail with return receipt requested. The signed green card is your proof of delivery with a date. If you expect the agent to stonewall or claim they never got it, an attorney can hand-deliver the revocation and collect a signed acknowledgment. Either way, keep the receipts.
Notifying Banks and Other Third Parties
The same good-faith rule protects banks, brokerages, title companies, and anyone else who previously acted on the POA. A financial institution has “actual notice” of a revocation once it has had a reasonable opportunity to act on a written revocation delivered to the branch or office where your account is held.1New York State Senate. New York General Obligations Law 5-1511 – Termination or Revocation of Power of Attorney; Notice
Make a list of every institution where your agent transacted on your behalf. Deliver a copy of the revocation to each one, ask them to update their records, and get written confirmation back. Most banks have an internal process for flagging the account. If you skip this step, an old agent could keep writing checks or moving money for a window that closes only when the bank finally gets notice.
Recording With the County Clerk
If your original power of attorney was recorded in a county clerk’s office — which is standard when the agent has authority over real property — the revocation must be recorded in the same office. Real Property Law 326 says a recorded power of attorney is not considered revoked by anything you do unless the revocation is recorded there too.4New York State Senate. New York Real Property Law 326 – Revocation to Be Recorded A buyer, lender, or title company searching the public record will otherwise still see a live POA.
Fees vary by county. New York City’s Department of Finance charges a base fee of $32 plus $5 per page with a required cover page, putting a one-page revocation at about $42. Counties outside the city generally charge less. Call ahead to confirm the fee and any formatting rules on margins or font size.
Government Agencies Need Separate Notice
Internal Revenue Service
If you filed IRS Form 2848 giving your agent authority over federal tax matters, revoke it directly with the IRS. Write “REVOKE” across the top of the first page of your copy of the form, sign and date under the annotation, and mail or fax it to the address in the Where To File chart in the form instructions. If you no longer have the form, send a signed statement that identifies the tax matters and years covered and names each representative whose authority you are ending.5Internal Revenue Service. State tax authority runs on its own track. The Department of Taxation and Finance maintains separate authorization records and has its own POA forms and revocation process; use it if the original POA covered state tax matters.6Department of Taxation and Finance. Social Security Administration
The SSA does not recognize standard powers of attorney at all. If someone acts as your representative payee, that appointment sits inside SSA’s own system, and ending it requires SSA’s process, which includes reassessing whether you can manage benefits yourself and possibly naming a replacement payee.7Social Security Administration. Healthcare Proxies Are a Different Document
Revoking your financial POA does not touch your healthcare proxy. Public Health Law 2985 gives you broader options: you can revoke a healthcare proxy by telling your agent or any healthcare provider, orally or in writing, or by any act showing intent to revoke, and signing a new proxy automatically supersedes the old one. One built-in rule to know: if your spouse is your healthcare agent and you divorce or legally separate, that appointment is revoked automatically unless the proxy says otherwise.8New York State Senate. New York Public Health Law 2985 – Revocation The financial POA statute has no matching automatic trigger for divorce, so revoke a former spouse’s financial authority in writing.1New York State Senate. When the Agent Refuses to Step Down
Most revocations end here. Problems start when an agent keeps acting anyway, or when the agent claims the principal no longer has capacity to revoke.
Read GOL 5-1511 carefully on that second point. The agent must comply with a revocation even if they believe you lack capacity. The one exception is a court that has already placed you under guardianship in an Article 81 proceeding.1New York State Senate. New York General Obligations Law 5-1511 – Termination or Revocation of Power of Attorney; Notice An agent who ignores a valid revocation on the theory that “Mom doesn’t know what she’s doing” is violating the statute.
If the agent will not stand down, you or a family member can petition New York Supreme Court to formally terminate the authority. Where the agent has misused funds, the court can order a full accounting, compel return of misappropriated money, and refer the matter for criminal prosecution. In elder abuse or financial exploitation cases, courts can issue emergency orders freezing assets. Where a principal genuinely cannot manage their own affairs and no valid durable POA remains, a family member or other interested party can petition for guardianship under Article 81 of the Mental Hygiene Law.9New York State Unified Court System. What It Costs
Handled on your own, the revocation is cheap. Notary fees are capped at $2 per signature.3NY Department of State. Notary Public – Frequently Asked Questions Certified mail with return receipt runs under $10. County clerk recording, if it applies, generally lands between $30 and $55, with New York City starting at about $42 for a one-page filing.
Costs jump when the revocation is contested. An attorney drafting and delivering a straightforward revocation might charge a few hundred dollars. A contested proceeding or an Article 81 guardianship petition costs significantly more. If exploitation is part of the picture and money is tight, Adult Protective Services may be able to help at no cost.
