How to Stop a Garnishment in Washington State

To stop a garnishment in Washington State, file a claim of exemption with the court that issued the writ, and do it fast: you generally have 28 days from the date printed on the writ. That filing forces the court to decide which of your wages or bank funds are legally protected, and Washington’s exemption limits are more generous than the federal floor for most consumer debts. If a claim of exemption won’t fully solve the problem, you can negotiate a payment arrangement directly with the creditor, or file for bankruptcy to trigger a federal automatic stay that halts collection immediately.

File a Claim of Exemption

The writ of garnishment served on your employer or bank should arrive with a claim of exemption form attached. That form is how you tell the court that some or all of the money being held is protected by law. You must identify the specific exemption you’re claiming and back it up with documentation.1Washington State Legislature. RCW 6.27.160 Claiming Exemptions – Form – Hearing – Attorneys Fees – Costs – Release of Funds or Property

Gather pay stubs showing current earnings, bank statements showing where deposits came from, and any award letters for benefits like Social Security or VA payments. If you’re arguing hardship, write out a monthly expense breakdown: rent or mortgage, utilities, food, medical costs, transportation. Specific, documented numbers hold up better if the creditor pushes back.

Deliver copies to three places:

  • File the original with the clerk of the court that issued the writ, by first-class mail or in person.
  • Mail a copy to the creditor or their attorney at the address printed on the writ.
  • Keep a copy for yourself for any hearing.

Your bank or employer (the garnishee) is already holding the funds under the writ. Your claim goes to the court and the creditor, not back to the garnishee.2Washington State Legislature. Revised Code of Washington Chapter 6.27 – Garnishment

Meet the Filing Deadlines

Timing is unforgiving. If the writ reaches you within seven days of the date printed on it, you have 28 days from that printed date to file your claim. If it reaches you more than seven days after the writ date, you have 21 days from the date you were actually served.1Washington State Legislature. RCW 6.27.160 Claiming Exemptions – Form – Hearing – Attorneys Fees – Costs – Release of Funds or Property Miss the window and the garnishee can release your held funds to the creditor; you lose the chance to assert exemptions on that writ.

A Washington wage garnishment works as a continuing lien. It attaches to your nonexempt earnings until the judgment is collected, or until the employer’s payroll period ending on or before 60 days after the writ’s effective date expires, whichever comes first.3Washington State Legislature. RCW 6.27.350 Continuing Lien on Earnings – When Lien Terminates The creditor can then serve a fresh writ. So if you miss a deadline on one writ, filing on the next one still protects future paychecks.

What Happens After You File

The creditor has seven days to object. If they do, they must mail you a written declaration explaining why and schedule a court hearing within 14 days of receiving your claim.1Washington State Legislature. RCW 6.27.160 Claiming Exemptions – Form – Hearing – Attorneys Fees – Costs – Release of Funds or Property No timely objection, and the exemption stands; the held funds should be released to you.

At the hearing, you carry the burden of proof. Bring pay stubs, benefit letters, bank statements highlighting direct deposits, and your expense breakdown. The judge decides which funds are protected and orders them released.

One warning: if the court finds either side acted in bad faith (a frivolous claim or a baseless objection), it can award attorney’s fees and costs to the winning party. Don’t claim exemptions for money that clearly isn’t exempt, but don’t be rattled by an objection either. Many creditors object as a matter of course.

How Much of Your Paycheck Is Already Protected

Before deciding what to claim, know what Washington already shields. The limits depend on the type of debt, and the state is more protective than the federal baseline for most consumer categories. “Disposable earnings” means your gross pay minus legally required deductions like taxes and Social Security, not take-home after voluntary items like 401(k) contributions.

General Debts

For a general judgment (a personal loan or medical debt reduced to judgment, for example), the exempt amount each week is the greater of 35 times the federal minimum wage ($7.25, which comes to $253.75 per week) or 75% of your disposable earnings. The creditor can take whichever is less: 25% of disposable earnings, or the amount above $253.75.4Washington State Legislature. RCW 6.27.150 Exemption of Earnings – Amount Earn $253.75 or less per week in disposable income on a general debt, and nothing can be taken.

Consumer Debt

Credit card balances, auto loans, and other debts incurred for personal or household purposes get stronger protection. Washington ties the floor to the state minimum wage. For 2026, that’s $17.13 per hour,5Washington State Department of Labor and Industries. Minimum Wage making the weekly floor 35 × $17.13 = $599.55. At least 80% of your disposable earnings are exempt, so a creditor can take no more than 20%.4Washington State Legislature. RCW 6.27.150 Exemption of Earnings – Amount Under roughly $600 per week in disposable income, a consumer debt garnishment takes nothing. Look carefully at the writ to see which category applies.

Private Student Loans

Private student loans (not federal) carry the most protective limit: the greater of 50 times the highest applicable state minimum wage ($17.13, so $856.50 per week) or 85% of disposable earnings.4Washington State Legislature. RCW 6.27.150 Exemption of Earnings – Amount Under about $857 per week in disposable income, you’re fully shielded.

Spousal Maintenance

Court-ordered spousal support gets the least protection: only 50% of disposable earnings are exempt, so up to half the paycheck can be taken.4Washington State Legislature. RCW 6.27.150 Exemption of Earnings – Amount There is no minimum-wage floor in this category.

Protections on Bank Accounts

Bank account garnishments carry a different automatic shield. For consumer debt, Washington requires the bank to protect $2,000 across all your accounts at that institution without any filing from you. If your total balance is at or below $2,000, the bank must release everything. For married couples or registered domestic partners whose accounts hold community property, that threshold is doubled. Different amounts apply for general judgments and private student loan debt. The $2,000 figure receives its first inflation adjustment on July 1, 2027.6Washington State Legislature. RCW 6.15.010 Exempt Property

If more of your account funds are exempt than the automatic protection covers (for example, because the money came from Social Security), that’s where the claim of exemption comes in. File it with bank statements proving the source of the deposits.

Federal Benefits Deposited Directly

A separate Treasury rule requires banks that receive a garnishment order to run an automatic two-month lookback on your account. If Social Security, SSI, VA benefits, or other covered federal payments were deposited during that window, the bank must protect up to two months’ worth of those deposits automatically.7eCFR. 31 CFR Part 212 – Garnishment of Accounts Containing Federal Benefit Payments SSI payments are protected even against government debts and support obligations. If your bank fails to apply the lookback, raise it in your claim of exemption and at the hearing.

Negotiate With the Creditor

Legal filings aren’t the only route. Garnishment is expensive for creditors too (court fees, employer processing, slow incremental payments), so many will accept a voluntary payment plan and release the writ in exchange. Call the creditor or their attorney and propose a monthly figure you can actually pay.

Get the agreement in writing before you send money. The terms should spell out that the creditor will dismiss or suspend the writ, what you’ll pay and when, and what happens if a payment is late. Without that, nothing stops the creditor from pocketing voluntary payments and continuing to garnish. Once the underlying judgment is vacated, modified, or satisfied, or the writ is dismissed, the continuing lien on your earnings terminates.3Washington State Legislature. RCW 6.27.350 Continuing Lien on Earnings – When Lien Terminates

Bankruptcy and the Automatic Stay

When exemptions and negotiation aren’t enough, filing a bankruptcy petition triggers an automatic stay the moment the case is filed. The stay operates as a federal court order forcing all creditors to stop collection immediately, including wage garnishment and bank account freezes.8Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay

To make it effective quickly, notify the Washington state court clerk handling the garnishment and the creditor’s attorney of your bankruptcy case number. Funds seized after the filing date generally must be returned. The stay stays in effect until the case closes or a creditor successfully petitions the bankruptcy court to lift it.

Bankruptcy works best for credit card debt, medical bills, personal loans, and similar obligations that can be discharged. If the underlying debt survives discharge, the creditor can resume garnishment later.

Your Job Is Protected From a Single Garnishment

Federal law bars an employer from firing you because your wages are being garnished for any one debt, no matter how many garnishment orders are issued to collect on that same debt.9Office of the Law Revision Counsel. 15 USC 1674 – Restriction on Discharge From Employment by Reason of Garnishment An employer who violates this faces a fine of up to $1,000 and up to one year of imprisonment, and you may be entitled to reinstatement and back wages.10U.S. Department of Labor. Employment Law Guide – Wage Garnishment The gap: the protection only covers garnishment for a single debt. Two or more separate creditors garnishing you, and the federal shield no longer applies. Washington has no state-level expansion of this rule.

Garnishments That Are Harder to Stop

Some garnishments don’t respond to the tools above.

Child support and spousal support are largely immune. The bankruptcy automatic stay doesn’t stop support collection, and support survives discharge.11United States Courts. Discharge in Bankruptcy – Bankruptcy Basics If support is the issue, your path is a modification petition in family court based on changed circumstances.

Federal student loans can be garnished by the U.S. Department of Education at up to 15% of disposable income through an administrative process that doesn’t require a court judgment, with at least $217.50 per week left to you. The Department resumed garnishment for defaulted borrowers in January 2026. Rehabilitation, consolidation, or entering an income-driven repayment plan can stop this without bankruptcy.

Tax debts owed to the IRS or state tax agencies operate under their own garnishment powers outside the normal judgment-creditor process, and are nondischargeable in bankruptcy except in narrow circumstances.

When multiple garnishments arrive at once, Washington follows priority rules rather than first-come, first-served. Child support generally comes first, and if the amount already garnished for support exceeds the general wage protection limits, no additional garnishment for consumer debt can layer on top.12U.S. Department of Labor.
