To stop child support payments in Indiana, you file a Verified Petition to Terminate Child Support with the court that issued the original order, wait for the judge to enter a termination order, and keep paying until the Indiana Child Support Bureau and your employer confirm that income withholding has stopped. Support does not end on its own in most cases, and skipping payments before you have that confirmation creates arrears that Indiana can collect aggressively.
When the Support Obligation Actually Ends
Indiana treats a child as emancipated at age 19, and the noncustodial parent’s duty to pay current support ends at that point.1Indiana General Assembly. Indiana Code 31-16-6-6 – Termination of Child Support Obligation; Exceptions The Department of Child Services calls this emancipation “by operation of law,” so no separate finding of independence is required once the child hits that age.2Indiana Department of Child Services. Child Support Orders
“By operation of law” is not the same as “handled for you.” If your support comes out of your paycheck, someone still has to tell your employer to stop the deduction. The issuing agency sends a termination notice on the Income Withholding Order form, and your employer processes a final payment. That paperwork can lag the birthday by weeks.
Indiana law also recognizes earlier emancipation in specific situations:1Indiana General Assembly. Indiana Code 31-16-6-6 – Termination of Child Support Obligation; Exceptions
- The child legally marries, at any age.
- The child joins a branch of the United States armed forces.
- The child is no longer under the care or control of either parent or a court-approved guardian.
- The child is at least 18, has not attended school for the last four months, is not currently enrolled, and is either self-supporting or capable of supporting themselves through employment.
The last category catches people out. Turning 18 alone does not end support. The child must also be out of school and either financially independent or employable. Assume nothing and stop paying, and you owe every missed installment.
Two Exceptions That Extend Support Past 19
A court can order support for postsecondary education costs, including tuition, room and board, and books, that continue past age 19 under Indiana Code 31-16-6-2.3Indiana General Assembly. Indiana Code 31-16-6-2 – Expenses for Child’s Education and Special Medical, Hospital, or Dental Expenses Educational support is not automatic; it has to appear in a specific order or in the original decree. If your decree includes college-expense language, expect to keep paying, and file a petition to modify if you believe the order is no longer appropriate.
Support for a child whose disability prevents self-sufficiency can also continue indefinitely, but only through a separate court order extending it.2Indiana Department of Child Services. Child Support Orders If circumstances later change and the adult child gains the ability to support themselves, you can petition to terminate or reduce the order with supporting medical, employment, or independent-living evidence.
Filing the Petition to Terminate
The process starts with a Verified Petition to Terminate Child Support filed in the court that issued the original order. Several Indiana counties publish standard forms. The petition names the child, identifies the existing support order, and states the legal basis for termination: age, marriage, military service, adoption, custody change, or another qualifying event.
Gather documentation before you file. For age-based termination, a birth certificate is enough. For earlier emancipation, bring the marriage certificate, enlistment papers, or proof of the child’s employment and independent living. Filing fees vary by county, and fee waivers are available for parents who cannot afford them.
Once you file, the court schedules a hearing and the other parent gets notice and a chance to respond. Uncontested petitions usually move quickly. If the other parent argues the child still depends on support, both sides present evidence and the judge decides.
When termination is granted, the court directs the Indiana Child Support Bureau and your employer to stop income withholding. The agency issues a termination notice on the Income Withholding Order form, your employer processes a final deduction, and the deductions stop. Wait for that confirmation before you change anything on your end.
Other Routes to Ending Support
Adoption
When another parent adopts your child, your legal relationship to the child ends, and so does the support obligation going forward. Indiana Code 31-19-15-1 relieves biological parents of all legal duties to the child once an adoption is finalized.4Indiana General Assembly. Indiana Code 31-19-15-1 – Effect Upon Duties, Obligations, and Rights of Biological Parents; Parent-Child Relationship Terminated Stepparent adoptions are the most common version. The biological parent either consents or has parental rights terminated by the court, which Indiana allows without consent in defined situations, including abandonment for at least six months before the petition is filed or failure to communicate with or financially support the child for at least one year.5Indiana General Assembly. Indiana Code 31-19-9-8 – Consent to Adoption Not Required; Written Denial of Paternity Precludes Challenge to Adoption Any arrears that accumulated before the adoption remain collectible.
Change in Custody or Guardianship
If the child comes to live primarily with you, or moves in with a grandparent or other third-party guardian, the existing support order may no longer make sense. File a petition to modify or terminate support under Indiana Code 31-16-8-1, which requires showing that circumstances have changed so substantially and continuously that the current order is unreasonable.6Indiana General Assembly. Indiana Code 31-16-8-1 – Modification or Revocation of Child Support Order or Maintenance Order A formal custody order or documentation of an extended change in the child’s residence usually satisfies that standard.
Voluntary Agreement Between Parents
Both parents can agree to end support, but a private agreement between the two of you carries no legal weight. Indiana treats child support as a right belonging to the child, so any agreement has to go to the court for approval. You prepare a written stipulation explaining why termination is appropriate and showing that the child’s needs are being met, and the judge reviews it before entering an order.6Indiana General Assembly. Indiana Code 31-16-8-1 – Modification or Revocation of Child Support Order or Maintenance Order An informal promise from the custodial parent that you can stop paying does not protect you; arrears keep building until a court order says otherwise.
Unpaid Arrears Do Not Go Away
Ending the current support obligation does not erase back payments. Indiana law is explicit that the duty to pay arrears survives the end of the duty to pay current support.7Justia Law. Indiana Code Title 31 Article 16 Chapter 12 – Enforcement of Child Support Orders If you owed $5,000 the day your child turned 19, you still owe $5,000 after the order terminates.
The federal Bradley Amendment reinforces this. No state can retroactively reduce or forgive support arrears that accrued before a modification petition was filed.8Office of the Law Revision Counsel. 42 USC 666 – Requirement of Statutorily Prescribed Procedures to Improve Effectiveness of Child Support Enforcement Modification is only possible for the period during which a petition was pending, and only from the date the other parent received notice.9eCFR. 45 CFR 303.106 – Procedures to Prohibit Retroactive Modification of Child Support Arrearages Every day you wait to file is another day of arrears no court can undo later.
Do Not Stop Paying Without a Court Order
Even after a qualifying event like a 19th birthday, marriage, or the child moving out, keep paying until you have a court order or written confirmation from the Child Support Bureau that the obligation has ended. Indiana enforces support debt aggressively, and the consequences escalate fast.
The state can intercept your federal and state tax refunds. The federal offset applies once you owe as little as $500 in non-TANF arrears. Indiana can put liens on your real and personal property, and the county sheriff can seize and sell that property to satisfy the debt.10Indiana Department of Child Services. Chapter 12 Section 5.4 – Real and Personal Property Liens Banks participate in quarterly data matches that identify accounts belonging to parents behind on support, and those accounts can be frozen or levied.11Office of Child Support Enforcement. Child Support Handbook Chapter 5 – Collecting Support
A court can suspend your driver’s license until you set up a payment plan. The federal government will deny or revoke your passport once you owe $2,500 or more.12Administration for Children and Families. Passport Denial Program 101 Willful nonpayment can lead to contempt of court, which carries fines and possible jail time. None of these steps require the other parent to lift a finger; the state agency pursues enforcement on its own. Keep paying, file your petition as soon as you qualify, and let the paper trail do the work of ending the obligation.
