To stop unemployment benefits in New York, simply stop filing your weekly certification. There’s no form to submit and no phone call to make. Once a full week passes without a certification, the Department of Labor marks your file inactive on its own. The one wrinkle: if you worked part-time during your last week on the claim, you may want to file one final certification first to collect a partial payment for that week.
Do You Need to File One Last Certification?
It depends on your final week.
If you started full-time work right away and didn’t have any unemployed days to claim, you’re done. Skip the next certification and the claim goes dormant.
If you worked part-time during that last week, file one more certification before you stop. You may qualify for a partial payment if you worked 30 hours or fewer and earned less than $869 in gross pay (before taxes) for the week.1Department of Labor. Partial Unemployment Eligibility The $869 figure is New York’s current maximum weekly benefit rate, and it also serves as the earnings ceiling for partial eligibility.2Department of Labor. What is the Maximum Benefit Rate? Earn more than that in any week, regardless of hours worked, and you get nothing for that week.
One timing rule to know: you cannot certify for a given week more than one week late. Let the window slip, and the partial payment is gone for good.3Department of Labor. After You’ve Filed For Unemployment Frequently Asked Questions
What to Have Ready for the Final Certification
Three pieces of information:
- Total hours worked during the week.
- Gross earnings for the week — pay before taxes or deductions, not take-home.
- Confirmation that you have returned to work.
If you haven’t been paid yet, estimate gross earnings by multiplying your hourly rate by the hours worked. Gross pay also includes tips, bonuses, commissions, and the value of meals or lodging provided by the employer.3Department of Labor. How Much You’ll Receive for a Partial Week
New York uses an hours-based schedule rather than reducing benefits by calendar days worked:1Department of Labor. Partial Unemployment Eligibility
- 0–10 hours: full weekly benefit rate, no reduction
- 11–16 hours: 75% of your weekly benefit rate
- 17–21 hours: 50% of your weekly benefit rate
- 22–30 hours: 25% of your weekly benefit rate
- 31 or more hours: no benefits for that week
When counting, round up to the nearest whole hour and cap each day at 10 hours.4NYS Department of Labor. What Happens to Your Claim After You Stop
A full week without a certification triggers a break in your claim, and the Department of Labor marks your file inactive. The claim isn’t deleted. It stays in the system for the rest of your benefit year, which runs 52 weeks from the date you originally filed.1Department of Labor. Partial Unemployment Eligibility Any unused balance stays with that dormant file until the year expires.
The difference between inactive and closed matters. An inactive claim can be reopened. An expired one requires a brand-new application.
If the New Job Doesn’t Work Out
Lose your new job before your original benefit year ends and you don’t file a new claim. You reopen the existing one. Log into your NY.gov account and find the “Reopen Claim” option on the unemployment services page. The system asks about the gap: employer name and address, dates worked, gross wages, and reason the job ended. Have separation paperwork handy if you have any.
Reopening typically takes 5 to 10 business days. Once it’s approved, start certifying immediately — don’t wait for a determination letter in the mail. Your original weekly benefit amount generally stays the same because you’re reopening, not starting over.
If your benefit year has already expired by the time you need benefits again, you’ll have to file a completely new claim, and you’ll need enough wages in the new base period to qualify.
Why You Can’t Just Keep Certifying “To Be Safe”
Continuing to certify after you’ve returned to work, or underreporting hours and earnings, is treated as an overpayment and potentially as fraud. The penalties under New York Labor Law are serious.8New York State Senate. New York Labor Law LAB 594 – Reduction and Recovery of Benefits and Penalties for Wilful False Statement
- Full repayment of every dollar received because of the false statement.
- A civil penalty equal to 15% of the overpaid amount, or $100, whichever is greater.
- Loss of future benefits for up to 20 weeks following discovery of the offense.
- The forfeiture penalty can carry across benefit years and remains enforceable for two years from the date of the final determination.
These stack on top of any criminal charges the state or federal government may pursue. The federal Treasury Offset Program also lets the government seize your federal tax refund to recover overpayments. If you’re genuinely unsure whether your final week qualifies for a partial payment, file an honest certification. The worst outcome is a $0 week.
What Arrives at Tax Time
Unemployment benefits count as taxable income on your federal return. In January following any year you received benefits, the Department of Labor mails a 1099-G showing total benefits paid and federal tax withheld. The same form is available in mid-January through your account at labor.ny.gov.9Department of Labor. 1099-G Tax Form

Form 1099-G Certain Government Payments If you collected benefits in two different calendar years, you’ll get a separate 1099-G for each. Report Box 1 as income and claim Box 4 as tax already paid. If you never opted into withholding, set money aside for the bill. A surprise balance due at filing time catches a lot of people off guard.
