Winning a 388 petition in a California dependency case comes down to two things done well: proving your circumstances have genuinely changed since the last order, and proving the change you are asking for is in the child’s best interest. Under Welfare and Institutions Code § 388, a parent, guardian, relative, or other interested party can ask the juvenile court to change, modify, or set aside a prior order.1California Legislative Information. California Code Welfare and Institutions Code 388 Most petitions never reach a hearing because they fail a paper screening. If yours is going to succeed, it has to be built from the first page to clear that screening and then hold up under live testimony.
What a granted petition can deliver is substantial: return of the child, a shift from monitored to unmonitored visitation, reinstated reunification services, termination of the court’s jurisdiction, or in rare cases reinstatement of parental rights years after termination if the child was never adopted.2DCFS Policy Institute. WIC 388 Petitions: Response Reports The size of what you can win is also why the court scrutinizes the petition before granting a hearing.
Clear the Prima Facie Screening
Before any evidentiary hearing is set, a judge reads your petition and decides whether the facts you allege, taken as true, could support the ruling you want. If they could not, the court denies the petition on paper.3Judicial Branch of California. California Rules of Court 5.570 – Request to Change Court Order This is where most 388s die.
The difference between a petition that survives and one that does not is specificity. “I am working on getting sober” is aspirational and gets denied. “I completed a six-month residential treatment program on [date], have tested negative twelve consecutive times at [facility], and have maintained stable housing at [address] since [date]” states facts a judge can test. Dates, program names, test results, addresses, duration, and documentation turn allegations into a prima facie case. If the petition clears screening, the court must hold the hearing within 30 calendar days of filing, though it may first hold an interim hearing on whether a full evidentiary hearing is warranted.3Judicial Branch of California. Show Circumstances Are Changed, Not Changing
No distinction sinks more 388 petitions. Courts separate “changed” circumstances (the transformation is complete and demonstrated over time) from “changing” circumstances (you are headed in the right direction but have not arrived). A judge who sees only progress in motion will usually deny the petition, especially when the petitioner failed to maintain that progress during the months or years of reunification services the court already provided.
The common losing fact pattern: a parent files just before a hearing to terminate parental rights, offering two months of clean tests. A judge typically reads that as changing. The winning version looks very different: a completed treatment program, a year or more of sustained sobriety, steady employment, and a stable home. The practical takeaway is to resist the urge to file early. A premature petition denied on changing-versus-changed grounds is worse than waiting another few months and filing with an airtight record. If you have been in services for two years and your evidence covers two months, the math on the page will defeat you before the agency even responds.
Build the Best Interest Case
Even with strong evidence of change, the court will not grant the petition unless the modification promotes the child’s best interest. California appellate courts have identified three factors from In re Kimberly F. that drive this analysis:4Justia. In re Kimberly F. (1997)
- The seriousness of the original problem and the reason it persisted. Chronic substance abuse or domestic violence draws heavier scrutiny than temporary housing instability.
- The strength of the child’s bond with the current caretaker compared to the bond with the parent. A deep attachment to a foster family that has provided years of stability weighs against disruption.
- The degree to which the original problem has actually been resolved, and how easily it can be removed. Sustained resolution over a meaningful period beats recent enrollment in a program.
These factors interact. The more serious the original problem, the stronger the evidence of change needs to be, and the more compelling the reason for disrupting the child’s current placement must be. Argue each factor directly in the petition and at the hearing rather than hoping the judge will connect the dots from your evidence to the child’s interest.
Match the Evidence to the Right Burden
You may have read that 388 petitions require clear and convincing evidence across the board. That is not accurate. The standard depends on what you are asking for:3Judicial Branch of California. California Rules of Court 5.570 – Request to Change Court Order
- Most modification requests use the preponderance of the evidence standard. The evidence must tip the scales in your favor, more likely than not, that the child’s welfare requires the change.
- Removal of a child from the home requires clear and convincing evidence that grounds for removal exist under WIC § 361(c).
- Termination of reunification services requires clear and convincing evidence that a qualifying condition exists, plus a preponderance of the evidence that reasonable services were offered or provided.
- Custody or visitation changes in cases where reunification services were bypassed require clear and convincing evidence that the proposed change is in the child’s best interest.
A parent asking for return of the child or reinstatement of services usually faces the preponderance standard. That is lower than clear and convincing, but it still demands documented, credible evidence. Verbal promises and self-reported improvement do not satisfy preponderance any more than they satisfy clear and convincing.
Fill Out JV-180 Like It Is Your Opening Brief
The petition is filed on form JV-180, a mandatory Judicial Council form, in the same court that issued the original order.5Judicial Council of California. JV-180 – Request to Change Court Order The form identifies the order you want changed, the new circumstances or evidence, and how the modification benefits the child.
Treat the written narrative as the single most important thing you will do in the case, because the judge screens the petition on exactly those words. “Things are better now” fails. Specific facts with corresponding exhibits survive. Attach everything that corroborates your claims: completion certificates, lab-verified drug test results, letters from therapists and counselors who have actually worked with you, pay stubs or an employer letter, a signed lease, utility bills, and visitation logs. The quality of your attachments usually decides whether a hearing is set.
Prepare for the Agency’s Position
The county child welfare agency is almost always a party, and when a 388 is filed the court typically requests an updated report from the agency on your compliance with case plan requirements, participation in services, and current situation.2DCFS Policy Institute. WIC 388 Petitions: Response Reports If the agency supports the petition, your path is much easier. If it opposes, the opposition will be documented: missed visits, positive tests, housing concerns.
Judges give the agency’s recommendation substantial weight but are not bound by it. The strategy that works is to treat the agency’s expected report as the opposition brief and prepare specific counter-evidence for each concern you can anticipate. If housing stability will be questioned, bring the lease, utility bills in your name, and a landlord letter. If sobriety will be questioned, bring lab-verified results from an independent testing facility rather than self-reports. A court-appointed special advocate may also weigh in, and a CASA whose recommendation diverges from the agency’s, based on sustained involvement with the child, can prompt the judge to look harder at your evidence.
If every party agrees to the modification, the court can grant it without a hearing. Otherwise the hearing proceeds within the 30-day window.3Judicial Branch of California. California Rules of Court 5.570 – Request to Change Court Order
Perform at the Hearing
You present live testimony and documents to the judge. No jury. The petitioner goes first, lays out the evidence of changed circumstances, and explains how the modification serves the child’s interest. The agency and other opposing parties then respond through cross-examination and their own evidence.
Credibility decides close cases. Judges watch for consistency between your testimony and the documentary record. If the petition claims twelve months of sobriety but the agency’s file shows a positive test six months ago that you did not disclose, every other claim becomes suspect. Honest acknowledgment of past failures paired with concrete evidence of sustained change reads as credible. Overstatement does not. Expert testimony and reports from therapists, substance abuse counselors, and other professionals who have worked with you over time carry more weight than a certificate of completion. A counselor who can describe a year of your engagement in treatment is more persuasive than any single document.
If Your Petition Is Denied
A denied 388 is reviewed on appeal under the abuse of discretion standard. The appellate court will overturn only if the trial judge acted unreasonably on the record in front of them, and most appeals fail because the trial record was thin, not because the appellate court disagreed with how evidence was weighed. The practical answer to a denial is usually to refile rather than to appeal, but a new petition based on the same facts the court already rejected will not win. You need genuinely new evidence or further changed circumstances that developed after the last denial.
Each denied petition also costs you some credibility with the judge who reads the next one. Before refiling, address every specific weakness the court identified, wait until your circumstances are truly changed rather than changing, and build the kind of record that would have won the first petition if you had waited to file it.
