How to Win Your Colorado Unemployment Appeal Hearing

To win a Colorado unemployment appeal, you have to do four things well: file within 20 calendar days of the mailing date on your denial, figure out the exact legal reason you were denied and who carries the burden of proof on that reason, gather documents and witnesses that speak directly to that reason, and keep filing your weekly certifications the entire time your appeal is pending.1Department of Labor & Employment. Appeal Rights The hearing is by phone, usually about an hour, and preparation decides it. Claimants lose winnable cases by telling a general story about their employment instead of attacking the specific ground for denial, or by missing a procedural step that dismisses the appeal before the merits are ever heard.

File Within 20 Calendar Days

The clock runs from the date the determination was mailed, printed on the letter itself, not the date you opened it. If day 20 lands on a weekend or legal holiday, you get the next business day.1Department of Labor & Employment. Appeal Rights

The fastest route is MyUI+. Sign in, go to “View and Maintain Account Information,” open “Issues and Determinations,” click the Issue Identification Number, and select “File Appeal.” The form asks for your reason for disagreeing, contact information, and whether you need an interpreter or have a representative.2Department of Labor & Employment. Steps to File an Appeal Online You can also fax to 303-318-9014 or mail to the Unemployment Appeals Section, PO Box 8988, Denver, CO 80201-8988, including both sides of the determination notice. At this stage you only need a detailed written reason you disagree; evidence comes later.1Department of Labor & Employment. Appeal Rights

A late appeal can still be filed, but you’ll have to testify under oath at the hearing about why it was late, and if the hearing officer finds no good cause, the appeal is dismissed and the original denial stands. Past 180 days late, no hearing is scheduled at all.3Department of Labor & Employment. Appeals FAQs

Attack the Specific Reason for the Denial

This is where appeals are won. Read the determination and identify the exact legal ground: misconduct connected with work, voluntary quit without good cause, or something else. Whichever it is, that ground tells you what the hearing officer has to decide and who has to prove what.

If You Were Fired for Misconduct

The employer carries the initial burden. They have to show you violated a reasonable, known workplace rule through deliberate action or repeated carelessness. Your job is to weaken that showing. Was the rule ever communicated to you in writing? Was it enforced consistently, or did the employer overlook the same behavior in other employees? Was this a single mistake or a genuine pattern? Written warnings, performance reviews, the employee handbook, and internal emails all become relevant here.

Colorado separates ordinary misconduct from gross misconduct. Gross misconduct carries a 26-week disqualification and covers conduct showing extreme disregard for the employer’s interests, such as workplace violence or threats against coworkers or supervisors.4Justia Law. Colorado Revised Statutes Title 8 Section 8-73-108 – Benefit Awards If the employer can’t meet its burden on the actual ground charged, you should get a full award.

If You Quit

The burden is on you, and it’s a real one. Colorado recognizes specific qualifying reasons for a voluntary quit, including unsafe working conditions, a substantial detrimental change to your job duties or pay, harassment, and medical necessity supported by a doctor’s recommendation.4Justia Law. Colorado Revised Statutes Title 8 Section 8-73-108 – Benefit Awards General dissatisfaction won’t qualify.

The hearing officer will also want to know whether you tried to fix the problem first. Did you report it to HR or your supervisor in writing? Did you ask for a transfer, a schedule change, a leave of absence, or lighter duties? Claimants who can show they exhausted reasonable alternatives before resigning are in much stronger position than those who simply left.

Gather Evidence That Speaks to That Reason

Scattershot evidence weakens your case. Pick documents that go directly to the denial ground.

  • For misconduct denials: the employee handbook, any written warnings you did or did not receive, performance reviews, emails between you and supervisors, and anything showing the employer tolerated similar conduct from others.
  • For voluntary quit denials: emails or written complaints documenting the problem you reported, a doctor’s note if health was the reason, your employment contract showing changes in duties or pay, photos of unsafe conditions, and correspondence showing you asked for accommodations before resigning.
  • Witnesses: a coworker who saw what actually happened can testify by phone. Firsthand accounts carry weight.

If you’re relying on a medical reason, a generic “stress” note isn’t enough. The doctor should specifically tie your condition to the work, recommend that you leave, and address whether modified duties or a leave of absence would have solved the problem.

Submit Exhibits Before the Hearing and Serve the Other Side

Wait for your Notice of Hearing before submitting anything. It contains the hearing date and instructions. The online documentation form linked from the CDLE appeals page is the easiest route, though fax and mail are available.3Department of Labor & Employment. Appeals FAQs

After sending documents to the hearing officer, you also have to send copies to every other party listed on the Notice of Hearing, usually your former employer. Electronic delivery, mail, or hand delivery all work, but the other side must receive everything before the hearing.5Department of Labor & Employment. The Hearing During the hearing, ask the hearing officer to enter your documents as exhibits on the record. Skip that step and the evidence may not be considered in the decision.

Subpoenas for Unwilling Witnesses or Documents

If a witness won’t come voluntarily or the employer won’t release documents you need, request a subpoena from the Division. File the Request for Subpoena form at least two weeks before the hearing and show good cause: the subpoena must produce relevant, non-repetitive evidence you can’t get any other way.6Colorado Department of Labor and Employment. Subpoena Request Instructions

If granted, you’re responsible for having the subpoena personally served on the witness or document holder at least three business days before the hearing, providing a copy to the other party, and filing proof of service with the Division before the hearing starts. Miss any of those steps and the hearing officer can exclude what the subpoena was meant to produce.6Colorado Department of Labor and Employment. Subpoena Request Instructions

Keep Filing Your Weekly Certifications

Do not stop. This is the single most common self-inflicted loss during an appeal. You have to keep requesting payment every week and meeting every eligibility requirement while the appeal is pending, including the work search and reporting any earnings.1Department of Labor & Employment. Appeal Rights

If you win, you only get back pay for the weeks you actually certified and stayed eligible.1Department of Labor & Employment. Appeal Rights Claimants who assume the denial means they can’t collect will win the hearing and then find out they’ve forfeited weeks of benefits that can’t be recovered.

The Telephone Hearing

Check In the Day Before

You must check in by 2:00 p.m. Mountain Time on the calendar day before your hearing, including weekends. You’ll need the Docket ID number from the upper-right corner of your hearing notice. If you filed the appeal and you fail to check in by this deadline, your appeal is dismissed.5Department of Labor & Employment. The Hearing Set a reminder.

The Call Itself

Hearings run by phone and usually take about an hour. The hearing officer will call you at the number you gave during check-in. If nothing has come through within 10 minutes of the scheduled time, call 303-318-9299. If you’re the appealing party and you don’t answer, the appeal is dismissed.8Department of Labor & Employment. The Hearing
The hearing officer runs the proceeding, states the issues, and questions both parties and any witnesses. You’ll get to make your case and question the other side’s witnesses; they get to question you.

How to Actually Handle It

Stay on the specific denial reason. The hearing officer doesn’t need your full employment history; they need to decide whether the employer proved misconduct, or whether you proved good cause for quitting. When a document supports a point, name it and refer to it as an entered exhibit. On cross-examination, ask narrow factual questions designed to expose gaps rather than arguing. If you don’t know an answer, say so. Credibility is part of the officer’s evaluation, and getting caught exaggerating hurts you more than admitting uncertainty.

If the Decision Goes Against You

The written decision appears in your MyUI+ account and is mailed to all parties, with findings of fact, legal reasoning under the Colorado Employment Security Act, and a conclusion.1Department of Labor & Employment. Appeal Rights You can appeal a hearing officer’s decision to the Industrial Claim Appeals Office within 20 calendar days of the mailing date, with the same weekend-and-holiday extension.9Department of Labor & Employment. Appeal a Hearing Officer’s Decision The ICAO reviews the record for legal or factual errors; it does not hold a new hearing or accept new evidence. What you did at the phone hearing is what it reviews, which is another reason to treat the phone hearing as your one real shot.

If the employer wins, you may have to repay benefits already paid. The Division can offset future payments or pursue direct repayment.3Department of Labor & Employment.
