HSC 11370.4: California Drug Weight Enhancements Explained

California Health and Safety Code 11370.4 adds between 3 and 25 years of state prison on top of the base sentence for certain drug sales and transportation convictions once the weight of the substance crosses a statutory threshold. The enhancement applies only to specific offenses involving specific drugs, and the thresholds are dramatically lower for fentanyl than for anything else on the list.1California Legislative Information. Which Offenses and Drugs Trigger the Enhancement

Weight enhancements do not attach to every drug charge. Simple possession for personal use is outside the statute, and so is any drug not on the covered list, no matter the quantity. What the statute covers is sales, transportation, and possession for sale of three groups of substances.

For heroin, cocaine, and cocaine base, the qualifying offenses are possession for sale under HSC 11351, possession of cocaine base for sale under HSC 11351.5, and transportation or sale under HSC 11352.1California Legislative Information. California Health and Safety Code 11370.4

For methamphetamine, amphetamine, PCP, and PCP analogs, the qualifying offenses are possession for sale under HSC 11378 or 11378.5 and transportation or sale under HSC 11379 or 11379.5.1California Legislative Information. California Health and Safety Code 11370.4

Fentanyl is its own category. The qualifying offenses are possession for sale under HSC 11351 and transportation or sale under HSC 11352.2California Legislative Information. California Health and Safety Code 11370.4

Weight Tiers for Heroin, Cocaine, and Cocaine Base

Subdivision (a) sets six tiers of added prison time for heroin, cocaine, and cocaine base:1California Legislative Information. California Health and Safety Code 11370.4

  • Over 1 kilogram: 3 additional years
  • Over 4 kilograms: 5 additional years
  • Over 10 kilograms: 10 additional years
  • Over 20 kilograms: 15 additional years
  • Over 40 kilograms: 20 additional years
  • Over 80 kilograms: 25 additional years

These stack on top of the base term. The base sentence for possession for sale of cocaine base under HSC 11351.5 is two, three, or four years.3California Legislative Information. California Health and Safety Code 11351.5 A defendant convicted of that offense with 10 kilograms of cocaine base could face four years plus a 10-year enhancement before any other sentencing factor enters the calculation.

Weight Tiers for Methamphetamine, Amphetamine, and PCP

Subdivision (b) covers methamphetamine, amphetamine, PCP, and PCP analogs in four tiers, capped at 15 years:1California Legislative Information. California Health and Safety Code 11370.4

  • Over 1 kilogram, or 30 liters liquid: 3 additional years
  • Over 4 kilograms, or 100 liters liquid: 5 additional years
  • Over 10 kilograms, or 200 liters liquid: 10 additional years
  • Over 20 kilograms, or 400 liters liquid: 15 additional years

Liquid volumes matter because PCP and methamphetamine are sometimes moved in liquid form. Someone stopped with 35 liters of liquid PCP crosses the first threshold even if the total weighs under a kilogram.

Weight Tiers for Fentanyl

Subdivision (c) uses much lower thresholds, starting at roughly one ounce:2California Legislative Information. California Health and Safety Code 11370.4

  • Over 28.35 grams (one ounce): 3 additional years
  • Over 100 grams: 5 additional years
  • Over 500 grams: 7 additional years
  • Over 1 kilogram: 10 additional years
  • Over 4 kilograms: 13 additional years

The statute continues with higher tiers beyond 10 kilograms. The gap between fentanyl and everything else in the statute is the reason so many trafficking cases carry enhancements now. A cocaine operation needs to move more than a kilogram to reach the first tier. A fentanyl operation reaches it at about 28 grams.

How the Weight Is Calculated

California uses gross weight. The measurement is the entire mixture or substance containing the controlled drug, not the weight of the pure chemical inside it. The California Supreme Court confirmed this reading in People v. Pieters, holding that the statute unambiguously refers to the weight of the controlled mixture.4Justia. Practically: five kilograms of powder that is mostly cutting agent but contains a detectable amount of cocaine counts as five kilograms for enhancement purposes. Prosecutors do not have to prove purity. That closes off any argument that a diluted product should draw a lighter sentence because the “real” drug weight is small.

There is one carve-out. In methamphetamine, amphetamine, and PCP cases under subdivision (b), plant or vegetable material seized in connection with the drug is excluded from the weight calculation.1California Legislative Information. California Health and Safety Code 11370.4 Dried plant matter mixed with PCP will not push the total over a threshold the way other additives would.

Conspiracy Cases and the Substantial Involvement Requirement

The enhancement can attach to a conspiracy conviction, but the statute imposes a higher bar first. The jury or judge must specifically find that the defendant was substantially involved in planning, directing, carrying out, or financing the underlying offense.1California Legislative Information. California Health and Safety Code 11370.4 The requirement appears in both subdivision (a) and subdivision (b).

The point is to keep low-level participants from absorbing decades of enhancement time for an operation they barely touched. A driver who made a single delivery without knowing the overall scale would likely fall below the line. Someone who fronted purchase money, coordinated logistics across multiple locations, or recruited other participants would meet it.4Justia. It must be proven at trial or admitted in a plea; a prosecutor cannot simply allege it and see it applied at sentencing.

When a Judge Can Strike the Enhancement

Even when the facts support a weight enhancement, the court is not required to impose it. Penal Code 1385 authorizes a judge to dismiss or strike an enhancement in the furtherance of justice, and the reasons must be stated on the record.5California Legislative Information. SB 81, effective in 2022, expanded that discretion. If the defendant proves one of the listed mitigating circumstances applies, the court must give that showing great weight and lean toward dismissal, unless doing so would endanger public safety. The statute defines that phrase narrowly: there must be a likelihood of physical injury or other serious danger to others.5California Legislative Information. California Penal Code 1385

Two circumstances matter most in weight-enhancement cases:

  • When more than one enhancement is charged in a single case, all enhancements beyond the first should be dismissed.
  • When applying the enhancement would push the total sentence past 20 years, the enhancement should be dismissed.

Other listed circumstances include a connection between the offense and mental illness, prior victimization or childhood trauma, or juvenile status at the time of the offense.5California Legislative Information. California Penal Code 1385 The list is not exclusive, and judges keep the broader authority to strike an enhancement for any reason consistent with the furtherance of justice.

Other Consequences That Come With a Weight-Enhanced Conviction

Three collateral consequences tend to travel with these cases and can matter as much as the added years themselves.

State Prison Rather Than County Jail

Proposition 36, passed in November 2024, generally requires that sentences with weight-based enhancements for substances like fentanyl, heroin, cocaine, and methamphetamine be served in state prison rather than county jail.6Legislative Analyst’s Office. Proposition 36 Ballot Analysis Before Prop 36, some drug sale sentences could be served locally depending on criminal history.

Asset Forfeiture

Any case big enough for a weight enhancement is also big enough for asset forfeiture under HSC 11470. The state can seize cash, vehicles, boats, aircraft, and financial instruments connected to the operation, including money paid for controlled substances, proceeds traceable to a drug transaction, and funds used to facilitate offenses under HSC 11351, 11352, 11378, and 11379. Vehicles, boats, and aircraft face forfeiture when used to facilitate sale or possession for sale of threshold quantities: 14.25 grams for heroin, and 28.5 grams for cocaine, cocaine base, and methamphetamine.7California Legislative Information. California Health and Safety Code 11470 Any defendant facing an 11370.4 enhancement is already well past these forfeiture triggers.

Immigration Consequences

A conviction that carries a weight enhancement will almost certainly qualify as an aggravated felony for federal immigration purposes. Federal law classifies illicit trafficking in a controlled substance as an aggravated felony, and any state drug offense punishable as a felony under federal law meets the definition.8U.S. Citizenship and Immigration Services. Permanent Bars to Good Moral Character The California offenses that trigger 11370.4 all involve sale, transportation, or possession for sale, which line up with the federal trafficking definition.

An aggravated felony makes a non-citizen deportable and permanently bars them from establishing good moral character for naturalization if the conviction occurred on or after November 29, 1990.8U.S. Citizenship and Immigration Services. Permanent Bars to Good Moral Character It also eliminates eligibility for most forms of relief from removal, including asylum and cancellation of removal. For a non-citizen, the immigration outcome often outlasts the prison term.
