I-66 HOV-2 or HOV-3 Requirements in Virginia

I-66 in Virginia requires HOV-3+ along the full corridor: at least three people in the vehicle (driver plus two passengers), plus an E-ZPass Flex switched to HOV mode, to ride the express lanes toll-free. The hours differ by segment. Inside the Beltway, the restriction applies only during weekday peak periods. Outside the Beltway, it runs 24 hours a day, seven days a week.1Virginia Department of Transportation. About

Inside the Beltway Rules

Between I-495 and Route 29 in Rosslyn, I-66 is an express corridor only during peak commuting hours. Eastbound, HOV-3+ runs 5:30 a.m. to 9:30 a.m. Westbound, it runs 3:00 p.m. to 7:00 p.m. Monday through Friday, excluding federal holidays.1Virginia Department of Transportation. About During those windows, three-person carpools ride free with an E-ZPass Flex in HOV mode. Solo drivers and two-person carpools pay a dynamic toll.2Virginia Department of Transportation. 66 Express Lanes

Outside those hours, the lanes are free and open to everyone regardless of occupancy. Weekends and federal holidays are unrestricted as well.

Outside the Beltway Rules

The 22.5-mile express stretch between Gainesville and I-495 is stricter. HOV-3+ enforcement and tolling run around the clock, every day, with no holiday exceptions.366 Express Outside the Beltway. HOV – Travel Free Three or more occupants with a properly set E-ZPass Flex ride free at any hour. Everyone else pays.

There is no off-peak window here. Drivers who don’t want to pay or carpool can use the general-purpose lanes that run alongside the express lanes on this segment.466 Express Outside the Beltway. Pricing and Toll Segments

You Need an E-ZPass Flex in HOV Mode

A standard E-ZPass will not register a carpool. To ride free as HOV-3+, you need an E-ZPass Flex transponder mounted on the windshield and switched to “HOV ON” before you enter the lanes.5Virginia Department of Transportation. 66 Express Lanes Inside the Beltway – Using the Lanes If the Flex is left in toll mode, the system charges the toll even with three people in the car. VDOT is direct on this point: switch it before you get on the express lanes, because nothing in the system automatically detects how many people are inside.6Virginia Department of Transportation. Who Counts, and Who’s Exempt

Every person in the vehicle counts, regardless of age. An infant in a car seat is a valid third occupant.7Virginia Department of Transportation. HOV Lanes Pets don’t count. Mannequins and stuffed passengers don’t count.

A limited set of vehicles can use the HOV lanes without three occupants:

  • Motorcycles ride free and don’t need an E-ZPass.5Virginia Department of Transportation. 66 Express Lanes Inside the Beltway – Using the Lanes
  • Firefighting vehicles and emergency medical services vehicles are exempt.
  • Law enforcement vehicles are exempt when in use for law enforcement.
  • Transit buses designed to carry 16 or more passengers, including the driver, ride free.7Virginia Department of Transportation. HOV Lanes
  • Public utility vehicles are exempt only when responding to an emergency call.
  • Taxicabs are exempt only when carrying two or more occupants including the driver.8Virginia Code Commission. Virginia Code 33.2-501 – Designation of HOV Lanes; Use of Such Lanes

Clean Fuel Plates Do Not Help on I-66

Virginia’s Clean Special Fuel license plates grant HOV exemptions on some corridors, but not on I-66. The DMV states plainly that Clean Special Fuel plates do not exempt a vehicle from the occupancy requirement on the 66 Express Lanes inside or outside the Beltway, regardless of when the plates were issued. Three occupants and an E-ZPass Flex in HOV mode are still required.9Virginia DMV. Clean Special Fuel Vehicles/Plates

Penalties for HOV Violations

I-66 sits inside Virginia’s Planning District 8, which carries higher HOV fines than most of the state. A first violation is a traffic infraction, and repeat offenses within a five-year window climb quickly:8Virginia Code Commission. Virginia Code 33.2-501 – Designation of HOV Lanes; Use of Such Lanes

  • First offense: $125 fine.
  • Second offense within five years: $250 fine, plus three demerit points.
  • Third offense within five years: $500 fine, plus three demerit points.
  • Fourth or subsequent offense within five years: $1,000 fine, plus three demerit points.

Two violations in the same month put the next one at the $250 tier. Enforcement on I-66 is handled by Virginia State Police, and the corridor uses automated occupancy detection alongside traditional patrols. Falsely claiming a carpool by running the Flex in HOV mode with too few people is what these fines are built to catch.
