Idaho Do Not Call List: Exemptions, Calling Hours, and Penalties

The Idaho Do Not Call list is not a separate state registry. Idaho’s Telephone Solicitation Act points residents to the free National Do Not Call Registry and gives the Attorney General power to pursue telemarketers who ignore it, with civil penalties climbing to $5,000 per call for repeat violators.1Idaho Office of Attorney General. Do Not Call Registry Registration takes about two minutes, costs nothing, and never expires.

How to Register Your Number

You have two ways to sign up. Register online at DoNotCall.gov, or call 1-888-382-1222 from the phone you want to protect.2Federal Trade Commission. National Do Not Call Registry FAQs Both landlines and cell phones qualify.

Online registration needs the ten-digit number and a working email address. The FTC sends a confirmation email with a link you must click within 72 hours. Each number generates its own confirmation, so if you’re adding more than one line, watch for each separate message.2Federal Trade Commission. National Do Not Call Registry FAQs

Calling 1-888-382-1222 is simpler but has one catch: you have to call from the actual number you’re registering. The system reads your caller ID and logs the request automatically, with no email step.

Your registration stays active indefinitely. The FTC removes a number only if the line is disconnected and reassigned, or if you ask to be removed.2Federal Trade Commission. National Do Not Call Registry FAQs You can check your status anytime at DoNotCall.gov/verify.

When Sales Calls Should Stop

Your number appears in the registry the next day, but telemarketers get up to 31 days to scrub their calling lists. During that window, legal sales calls can still come through. After day 31, any covered telemarketer calling your registered number is in violation of federal and Idaho law.3Federal Trade Commission. Who Can Still Call You Legally

Registration blocks most sales pitches, not every ring. Several categories of callers remain exempt.

Idaho Exemptions

Idaho Code Section 48-1003A carves out three groups. Calls to a business line are not covered. Companies you have an established business relationship with can still call you — meaning any company you purchased from or had a transaction with in the past 18 months, until you tell them to stop. Minors selling for a charitable purpose are also exempt.4Idaho State Legislature. Federal Exemptions

Because Idaho uses the federal registry, the federal Telemarketing Sales Rule exemptions also apply. Charities and nonprofits can still call for fundraising. Political campaigns can contact you about candidates or ballot measures. Survey and polling firms can call as long as they don’t try to sell anything during the conversation. Debt collectors can also call registered numbers, which surprises many people but is explicitly permitted.1Idaho Office of Attorney General. Do Not Call Registry

An exempt caller who turns deceptive or abusive still isn’t protected from Idaho’s broader consumer laws or, in the case of debt collectors, the federal Fair Debt Collection Practices Act.

Calling Hours

Even exempt and non-exempt telemarketers in Idaho are limited to calling between 8 a.m. and 9 p.m., any day of the week. A pitch at 7:45 a.m. or 9:15 p.m. is a violation regardless of your registry status.

What a Legitimate Telemarketer Must Tell You

Idaho requires every telephone solicitor to identify themselves at the start of a sales call: their name, the company they represent, and what they’re selling, before anything beyond a greeting. If a purchase is completed by phone, the solicitor must tell you about your right to cancel and provide their Attorney General registration number.6Idaho State Legislature. Idaho Code 48-1004 – Telephone Solicitor Duties

Robocalls carry their own disclosure rules. Any prerecorded sales message must state, at the start, who is responsible for the call, why they are calling, and how to reach them.7Idaho State Legislature. Idaho Code 48-1003C – Automatic Dialing-Announcing Device A recorded pitch that launches straight into selling without that identification is already illegal on its face. Missed disclosures and skipped identifications are the easiest violations to document for a complaint.

Penalties Telemarketers Face

Idaho’s penalty ladder climbs fast. A first violation of the no-call provisions carries a civil penalty of up to $500. A second violation jumps to $2,500. Third and later violations can reach $5,000 each.4Idaho State Legislature. Idaho Code 48-1003A – No Telephone Solicitation Contact List These are per-call figures, so a company dialing hundreds of registered numbers can face serious aggregate liability. The Attorney General brings these actions in district court.

Consumers also have a private right to sue. Under Idaho Code 48-1007, anyone who buys goods or services through a telephone solicitation and suffers damages can file their own lawsuit without waiting for state enforcement.8Idaho State Legislature. How to Report an Illegal Call

Once the 31-day grace period has passed, any illegal sales call is worth reporting. Using both state and federal channels increases the odds of enforcement.

File a state complaint with the Idaho Attorney General’s Consumer Protection Division using their online telephone solicitation complaint form.9Idaho Office of Attorney General. Consumer Complaints This route matters most when the caller is Idaho-based or when you want state penalties on the table.

File a federal complaint at DoNotCall.gov. If you actually lost money to a phone scam, report it separately at ReportFraud.ftc.gov so investigators can build a fraud case.2Federal Trade Commission. National Do Not Call Registry FAQs

Either report should include your phone number, the number shown on your caller ID (even if you suspect it was spoofed), the date and approximate time of the call, and any company name or callback number the caller gave you.2Federal Trade Commission. National Do Not Call Registry FAQs Log each call from a repeat caller separately. Those repeat violations are what push penalties into the $5,000-per-call range.
