An Idaho driver’s license suspension can come from the Idaho Transportation Department (ITD) or from a court, and getting back on the road means fixing whatever caused it, paying a reinstatement fee that ranges from $25 to $285 depending on the offense, and in many cases filing SR-22 insurance or installing an ignition interlock device. The fastest way to find out your current status is ITD’s free Check Driver Status tool, which returns an answer in seconds once you enter your name, date of birth, and either your license number or Social Security number.1Idaho Transportation Department. Check Driver Status
If the tool shows you as suspended and you aren’t sure why, request a copy of your driving record from any DMV office. It lists every violation, point assessment, and suspension action on file. Keep your mailing address current with ITD too, because suspension notices go to whatever address is on record, and a missed notice doesn’t delay the suspension.
Why Idaho Suspends a Driver’s License
Suspensions come from several different triggers, and the reinstatement path depends on which one applies to you.
Too Many Points
Idaho assigns points for moving violations, and the suspension tiers stack:
- 12 or more points in 12 months: 30-day suspension
- 18 or more points in 24 months: 90-day suspension
- 24 or more points in 36 months: six-month suspension
The windows overlap, so a cluster of tickets in a short period can push a driver into a longer bracket faster than expected.2Idaho Transportation Department. IDAPA 39.02.71 – Rules Governing Drivers License Violation Point System
Unpaid Traffic Fines
When a court enters judgment on an unpaid traffic infraction and the driver ignores it, the court notifies ITD. The license is then suspended for 90 days or until the penalty is paid, whichever comes first. ITD will not issue a restricted permit during this suspension, so paying is the only way out.3Idaho State Legislature. Idaho Code 49-1505 – Suspension of Drivers License and Privileges for Failure to Pay Underlying Traffic Infraction Penalty – Appeal
Lapsed Insurance
Idaho requires liability insurance on every registered vehicle. If ITD discovers a lapse, both your license and your registration can be suspended. You’ll need new coverage before reinstatement, and in some cases an SR-22 certificate as well. The same category covers failure to satisfy a civil judgment from an accident.
DUI
A DUI triggers two separate suspensions that run alongside each other.
The first is an administrative license suspension (ALS) imposed by ITD. If you fail a breath or blood test at 0.08 BAC or higher, ITD suspends your license for 90 days starting 30 days after your arrest. The first 30 days are absolute (no driving at all), after which you can apply to ITD for restricted privileges for the remaining 60 days.4Idaho Transportation Department. Driver Records and Suspensions
The second is the court-ordered suspension that follows a conviction. For a standard first DUI with BAC under 0.20, the court must impose 90 to 180 days of suspension, the first 30 absolute, after which the judge may grant a restricted permit. Other first-offense penalties include up to six months in jail, fines up to $1,000, and a mandatory alcohol evaluation with treatment if recommended.
A second DUI within ten years brings a mandatory one-year suspension with no restricted driving allowed, 10 days to one year in jail (first 48 hours served consecutively), and fines up to $2,000. After the suspension ends, you can only drive a vehicle with an ignition interlock device.4Idaho Transportation Department. Driver Records and Suspensions
Refusing a BAC Test
Refusing is treated more harshly than failing. Under Idaho’s implied consent law, a first refusal brings an absolute one-year suspension with no restricted privileges. A second refusal within ten years doubles the suspension to two years. You also face a $250 civil penalty and a mandatory ignition interlock for one year after the suspension ends.5Idaho State Legislature. Idaho Code 18-8002 – Tests of Driver for Alcohol Concentration, Presence of Drugs or Other Intoxicating Substances
Medical or Vision Concerns
ITD can suspend a license when a medical condition or vision impairment affects safe driving. Idaho law treats visual acuity of 20/70 or worse in both eyes, even with corrective lenses, as grounds for suspension. Officers, physicians, and courts can all report drivers they believe are medically unfit. Reinstatement requires documentation from your doctor showing you meet the minimum standards.
Child Support Noncompliance
Idaho suspends licenses for falling behind on court-ordered child support. The Idaho Department of Health and Welfare handles enforcement and sends a notice before the suspension takes effect. You have 21 calendar days from receiving that notice to request a hearing.
Driving While Suspended
Getting caught driving on a suspended or revoked license is a criminal offense in Idaho, and penalties climb with each conviction:
- First offense (misdemeanor): 2 days to 6 months in jail, fine up to $1,000, suspension extended by 180 days
- Second offense: 20 days to 1 year in jail, fine up to $1,000, suspension extended by one year
- Third or subsequent offense: 30 days to 1 year in jail, fine up to $3,000, suspension extended by two years
The extension stacks onto whatever suspension you were already serving.6Idaho State Legislature. Idaho Code 18-8001 – Driving Without Privileges
One exception: if your license was suspended solely for something like unpaid child support or failure to attend school, driving without privileges is a $150 infraction instead of a misdemeanor.6Idaho State Legislature. Idaho Code 18-8001 – Driving Without Privileges
How to Reinstate Your License
Reinstatement follows the same pattern across suspension types: fix the underlying problem, pay the right reinstatement fee, and submit any additional documents ITD requires. The fees and insurance requirements are where readers trip up.
Reinstatement Fees by Offense
- $25: excessive points, medical suspensions, failure to maintain SR-22, unsatisfied judgments, child support, failure to attend school, and alcohol-age violations
- $85: no insurance, leaving the scene of an accident, eluding a peace officer, reckless driving, and miscellaneous court-ordered suspensions
- $245: out-of-state DUI conviction, test refusal, and administrative license suspension (ALS)
- $285: Idaho DUI conviction
If your suspension period has ended but ITD still shows you as suspended, it’s almost always because the reinstatement fee hasn’t been paid or ITD doesn’t have your SR-22 on file. Both have to be in place before your record updates.7Idaho Transportation Department. SR-22 and Reinstatement Information
SR-22 Insurance
An SR-22 isn’t a separate kind of insurance. It’s a certificate your auto insurer files with ITD confirming you carry at least Idaho’s minimum liability coverage. If your policy lapses, the insurer notifies ITD and your license gets suspended again.
You’ll need an SR-22 after any of these offenses: DUI, reckless driving, eluding police, leaving the scene of an accident involving injury or death, vehicular manslaughter, using a vehicle to commit a felony, or driving as an uninsured motorist.7Idaho Transportation Department. SR-22 and Reinstatement Information
For a DUI conviction, SR-22 coverage must be kept in place for three years starting at the end of your suspension period, not from the date of arrest or conviction. The clock only begins when you’re actually eligible to drive again.4Idaho Transportation Department. Driver Records and Suspensions
Ignition Interlock Devices
For a DUI conviction where any part of the sentence or fine is suspended (which covers most first offenses), Idaho law requires the court to order an ignition interlock device on every vehicle you operate. The device prevents the car from starting if it detects alcohol on your breath.8Idaho State Legislature. Idaho Code 18-8008 – Ignition Interlock Devices
Refusing a BAC test also triggers the interlock requirement, with the device staying installed for one year after the suspension period ends.5Idaho State Legislature. Idaho Code 18-8002 – Tests of Driver for Alcohol Concentration, Presence of Drugs or Other Intoxicating Substances
Installation and monthly monitoring are your expense. Costs vary by provider, but expect an installation fee plus a recurring monthly lease and calibration charge.
Restricted Permits for Work and Medical Needs
Idaho offers restricted driving permits in some situations, and the channel for applying depends on why your license was suspended.
For an administrative license suspension after a failed BAC test, you apply directly to ITD once you’ve served the first 30 days of absolute suspension. The restricted permit limits driving to and from work, for work purposes (including job hunting), for schooling, and for medical needs, and only between 8:00 a.m. and 5:00 p.m., Monday through Friday.9Idaho Transportation Department. Restricted Driving Permit
For a court-ordered DUI suspension, the court itself grants a restricted permit. You petition the judge, and the court decides whether to allow limited driving during the suspension period, never during the first 30 absolute days.4Idaho Transportation Department. Driver Records and Suspensions
For other suspension types such as points, insurance lapses, and miscellaneous court suspensions, ITD runs its own application process. The eligibility rules are strict: you must be an Idaho resident, at least 17 years old, not currently suspended in another state, and not have been issued a restricted permit for a similar offense within the past two years. Three or more suspensions or revocations in the past three years disqualifies you automatically.9Idaho Transportation Department. Restricted Driving Permit
Not every suspension qualifies. A suspension for failure to pay a traffic infraction specifically bars ITD from issuing a restricted permit, and a BAC test refusal carries an absolute suspension for the full one or two years with no restricted driving at all.3Idaho State Legislature. Idaho Code 49-1505 – Suspension of Drivers License and Privileges for Failure to Pay Underlying Traffic Infraction Penalty – Appeal
Violating the terms of a restricted permit (driving outside approved hours, for unapproved purposes, or while intoxicated) will result in immediate revocation and additional criminal penalties.
Appealing a Suspension
You can challenge a suspension when you believe it was issued in error. The process and deadline depend on the type.
For an administrative license suspension after a DUI arrest, you must request a hearing promptly. The hearing focuses on narrow questions: whether the officer had reasonable cause for the stop, whether you were properly informed of the test consequences, and whether the test results are valid. The written request to the court includes your name, license number, and a daytime phone number.
For a suspension based on failure to pay a traffic fine, the original court proceeding is your opportunity to contest. By the time ITD processes the suspension, the court has already certified you had notice and a chance to respond, and ITD doesn’t hold a separate hearing.3Idaho State Legislature. Idaho Code 49-1505 – Suspension of Drivers License and Privileges for Failure to Pay Underlying Traffic Infraction Penalty – Appeal
For child-support-related suspensions, you have 21 calendar days from receiving the notice to request a hearing through the Idaho Department of Health and Welfare.
At any hearing you can present evidence, bring witnesses, and challenge the state’s case. If you lose, you can petition for judicial review in district court, though that process is longer and more procedurally strict.
Extra Consequences for CDL Holders
Commercial drivers face federal rules on top of the state suspension framework. Serious traffic violations, including speeding 15 mph or more over the limit, reckless driving, improper lane changes, following too closely, and texting while driving a commercial vehicle, carry mandatory disqualification periods: a second serious violation within three years brings 60 days, and a third or subsequent brings 120 days, each stacking on top of any state suspension.10eCFR. 49 CFR Part 383 Subpart D – Driver Disqualifications and Penalties
A DUI conviction in any vehicle, commercial or personal, triggers a one-year CDL disqualification for a first offense and a lifetime disqualification for a second. Letting your federal medical examiner’s certificate lapse will also cause ITD to downgrade your CDL until you update it.11Federal Motor Carrier Safety Administration. Medical
