Idaho Gambling Age: What You Can Play at 18 and Penalties

The legal gambling age in Idaho is 18 for every form of gambling the state allows. That single threshold applies to lottery tickets, pari-mutuel horse race wagering, charitable bingo with meaningful prizes, and gaming at tribal facilities, though individual tribes can set a higher minimum under their own ordinances.1Idaho Lottery. General FAQs2Idaho State Legislature. Idaho Code Section 67-7707 – Bingo by Charitable or Nonprofit Organizations Turning 18 in Idaho does not open the door to a casino floor the way it might in a neighboring state. Idaho’s constitution bans most forms of gambling outright, so the list of things you can legally do at 18 is genuinely short.

Where the 18 Minimum Applies

Idaho sets 18 as the floor for each legal gambling category, and each category has its own rules layered on top of the age requirement.

You must be 18 to buy an Idaho Lottery ticket, whether it’s a scratch-off or a draw game like Powerball or Mega Millions.1Idaho Lottery. General FAQs Retailers are required to verify age, and lottery prizes cannot be claimed by anyone under 18.

Pari-mutuel wagering on horse races also carries an 18-year-old minimum. Idaho allows live and simulcast horse race betting at licensed facilities. A licensee running a race meet can operate pari-mutuel windows on its own races and, with Racing Commission approval, on simulcast races from other tracks.3Idaho State Legislature. Idaho Code Section 54-2512 – Pari-Mutuel Betting, Other Betting Illegal

Charitable bingo is a little more nuanced. Idaho requires players to be at least 18 for any bingo game that awards cash prizes or prizes worth more than $25.2Idaho State Legislature. Idaho Code Section 67-7707 – Bingo by Charitable or Nonprofit Organizations Low-stakes church-hall or school bingo where the prizes are small novelty items sits outside that age gate. The same 18-year-old rule covers raffles run by qualifying nonprofits.

Tribal gaming facilities in Idaho generally set 18 as their minimum, but this is the one place where the number can shift. Each tribe operates under its own gaming ordinance and can adopt stricter age policies than the state baseline. If you’re planning a trip to a specific tribal casino, check that facility’s posted age requirement before you go.

What an 18-Year-Old Can Legally Play

Idaho’s constitution permits three categories of gambling, and tribal gaming operates as a fourth category under federal law and state-tribal compacts.4Justia Law. Idaho Constitution Article III, Section 20 – Gambling Prohibited That’s the full menu.

The State Lottery

The Idaho Lottery offers scratch-off tickets and participates in multi-state draw games, with revenue directed to public schools and the permanent building fund.

Pari-Mutuel Horse Racing

Live and simulcast horse race wagering is available at licensed tracks and simulcast facilities. Simulcast-only sites are limited to the same county as a live race track and require Racing Commission approval.3Idaho State Legislature. Idaho Code Section 54-2512 – Pari-Mutuel Betting, Other Betting Illegal Live dog racing and dog race training are separate matters, prosecuted as felonies under Idaho law.5Idaho State Legislature. Idaho Code Section 54-2514A – Dog Racing Illegal

Charitable Bingo and Raffles

Nonprofits can run bingo and raffles for charitable purposes if they qualify. A group must be tax-exempt under one of several IRS categories, including 501(c)(3) and 501(c)(4), and must have operated in its county for at least one year. Electronic card-minding and auto-daubing devices are banned for bingo.6Idaho State Legislature. Idaho Code Section 67-7702 – Definitions

Tribal Video Gaming

Several Idaho tribes operate gaming facilities under compacts with the state. Because the state constitution bans slot machines and casino gambling by name, the compacts created a separate legal category called tribal video gaming machines. These accept currency, display results on a video screen, and rely on a computer-based random number generator.7Idaho Secretary of State. Tribal Gaming You won’t find blackjack, craps, or roulette at Idaho tribal casinos. The floors are built around video terminals rather than traditional table games.

What Being 18 Does Not Unlock

This is where visitors and new residents most often get the law wrong. Being 18, or any age, does not make the following legal in Idaho.

Sports betting. No form is allowed—retail, mobile, or online. Idaho’s gambling statute explicitly reaches wagering on “the happening or outcome of an event, including a sporting event.”8Idaho State Legislature. Idaho Code Section 18-3801 – Gambling Defined Idaho has actively defended its ban, including pushing back against federal regulators over sports-related events contracts.9Idaho Attorney General. Labrador Letter – Defending Idaho’s Right to Regulate Gambling

Online gambling. No online poker, no virtual casino, no state-licensed internet wagering of any kind. Federal law separately prohibits financial institutions from processing transactions tied to illegal online gambling.10Office of the Law Revision Counsel. 31 US Code Subchapter IV – Prohibition on Funding of Unlawful Internet Gambling

Daily fantasy sports. DraftKings, FanDuel, and similar platforms don’t operate in Idaho. The state’s broad gambling definition and constitutional ban leave no clear legal path for DFS contests.

Casino games and home poker. The constitution names blackjack, craps, roulette, poker, baccarat, keno, and slot machines as prohibited.4Justia Law. Idaho Constitution Article III, Section 20 – Gambling Prohibited Idaho has no social gambling exception. A home poker game for real money technically violates the law even among adult friends. Enforcement against casual home games is rare, but the exposure exists.

Penalties for Underage or Illegal Gambling

Participating in illegal gambling in Idaho is a misdemeanor, as is knowingly allowing gambling on property you own or control.11Idaho State Legislature. Idaho Code Section 18-3802 – Gambling Prohibited Idaho misdemeanors can carry jail time and fines depending on the circumstances and the court’s discretion.

For an underage player, the more immediate consequence is usually forfeiture of winnings and refusal of payout. Lottery prizes will not be paid to anyone under 18, and tribal facilities and pari-mutuel windows are required to verify age before accepting bets or paying out.

Nonprofits that run bingo or raffles outside the rules face civil penalties of up to $10,000 per violation, and knowing violations can be charged as criminal gambling.2Idaho State Legislature. Idaho Code Section 67-7707 – Bingo by Charitable or Nonprofit Organizations Dog racing offenses sit in a separate, more serious tier as felonies.5Idaho State Legislature. Idaho Code Section 54-2514A – Dog Racing Illegal

Taxes on Your Winnings

If you win, the IRS wants to know. All gambling winnings count as taxable federal income, whether you hit a lottery number, cash a pari-mutuel ticket, or leave a tribal casino ahead.

Starting January 1, 2026, gaming operators must issue IRS Form W-2G for slot-style machines, bingo, and keno winnings of $2,000 or more. That threshold rose from $1,200, with future adjustments tied to inflation.12Internal Revenue Service. Instructions for Forms W-2G and 5754 (Rev. January 2026) For horse race payouts, the W-2G trigger is generally $600 in winnings when the payout is at least 300 times the wager. When any single win hits $5,000 or more, the operator withholds 24% for federal income tax before paying you.

Winnings below those thresholds are still taxable; the IRS simply doesn’t receive an automatic report. You can deduct gambling losses only up to the amount of your winnings, and only if you itemize. Keep records of wins and losses if you play with any regularity.
