Illinois Amazon Tax: Buyer Rates, Use Tax, and Seller Filing

If you shop on Amazon and your order ships to an Illinois address, expect to see Illinois sales tax on the receipt. Amazon collects and remits the state’s 6.25 percent Retailers’ Occupation Tax plus any local add-ons, which push the combined rate as high as 10.25 percent in Chicago.1Tax Foundation. What You Pay as a Buyer

Illinois uses destination-based sourcing on remote sales, meaning the tax rate is set by where the package is delivered, not where the seller or warehouse sits.3Illinois Department of Revenue. Two Amazon orders with identical carts can carry different tax totals if they ship to different Illinois zip codes.

Physical Goods

Almost anything you can hold — electronics, clothing, furniture, kitchen items, toys — is taxable at the full combined rate. This is the default for Amazon purchases and covers the great majority of what shoppers order.

Digital Purchases

Illinois splits digital products by delivery method. Software you download onto your device is treated as tangible personal property and taxed. Cloud-based software you use remotely without downloading, and streaming content that never lives on your device, generally falls outside the Retailers’ Occupation Tax. So a downloaded video game is taxed; a streaming-only subscription may not be.

Shipping Charges

p>Shipping is part of the taxable base when the charge isn’t separately listed on your invoice, or when it is listed separately but the seller offers no alternative pickup option.5Illinois Department of Revenue. Reduced Rates and Groceries

Prescription and nonprescription medicines, medical appliances, insulin, and diabetic supplies are taxed at 1 percent rather than the standard 6.25 percent state rate.6Legal Information Institute. Illinois Administrative Code 86-140.126 – Taxation of Food, Drugs and Medical Appliances

Groceries changed on January 1, 2026. Illinois eliminated its 1 percent state tax on qualifying food for off-premises consumption. Alcohol, soft drinks, candy, cannabis-infused products, and prepared food don’t qualify. And if your municipality or county imposes its own grocery tax, that local rate still applies.7Illinois Department of Revenue. When Amazon Doesn’t Collect: Use Tax

Amazon and most large online retailers now collect Illinois tax, but not every online purchase does. Smaller sellers below the state’s collection threshold don’t have to charge Illinois tax. When you receive an online order with no tax on the receipt, Illinois still expects you to pay the same amount directly as consumer use tax.

The rate matches the sales tax: 6.25 percent for general merchandise, 1 percent for qualifying food, drugs, and medical appliances.4Illinois Department of Revenue. Use Tax Rates How you report depends on the annual total:

  • $600 or less for the year: report on your IL-1040 income tax return, or file Form ST-44 by April 15.

Most consumers with occasional untaxed purchases fall under the $600 line and settle it on the annual return. The obligation is widely ignored in practice but remains enforceable, and the state can assess penalties on unreported purchases found during an audit.

What You Owe as a Seller on Amazon

If you sell through Amazon’s marketplace and Amazon processes the buyer’s payment, Amazon is the party legally responsible for collecting and remitting Illinois tax on those orders. Illinois prohibits the Department of Revenue from collecting the same tax from both the marketplace facilitator and the marketplace seller on a single transaction.2Illinois General Assembly. The threshold that pulls a remote retailer into Illinois collection is set by 35 ILCS 120/2. For sales on or after January 1, 2026, the sole test is $100,000 or more in cumulative gross receipts from sales of tangible personal property to Illinois purchasers during a rolling 12-month lookback period. FY 2026-12, Destination-Based Retailers’ Occupation Tax Changes Amazon, as the marketplace facilitator, meets that threshold on its own volume and collects on every Illinois sale that runs through its checkout, regardless of any single third-party seller’s size.

The distinction matters if you sell on more than one channel. Amazon covers tax on marketplace orders. Sales through your own independent website are a separate bucket. If those direct sales alone hit $100,000 in gross receipts to Illinois buyers during the lookback period, you have your own Illinois registration and filing obligation for that channel.

Registering and Filing on Your Own Channels

Remote sellers who cross the $100,000 line on direct sales register through the MyTax Illinois online portal. During registration you link the appropriate tax types to your account and begin collecting Retailers’ Occupation Tax on Illinois orders.

Inventory bought for resale can be documented as tax-exempt using Form CRT-61, the Certificate of Resale, so you’re not paying tax to your supplier on goods you’ll later collect tax on at the point of sale.11Illinois Department of Revenue. Certificate of Resale

Filing frequency depends on your total liability. Higher-volume sellers generally file monthly, while smaller sellers may qualify for quarterly or annual schedules based on prior-year collection history. All filings go through MyTax Illinois.

Penalties for Getting It Wrong

Illinois uses a tiered late-payment penalty under the Uniform Penalty and Interest Act. For returns due on or after January 1, 2024:12Illinois General Assembly. 35 ILCS 735 – Uniform Penalty and Interest Act

  • Paid within 30 days of the due date: 2 percent of the unpaid amount.
  • Paid after 30 days but before an audit begins: 10 percent.
  • Paid after the Department opens an audit or investigation: 20 percent, reduced to 15 percent if the full balance is paid within 30 days of the Department’s audit findings.

Interest accrues on top of the penalty. The move from 2 percent to 20 percent is steep enough that self-correcting a missed filing before the state notices costs a fraction of waiting for an audit letter.
