Illinois Chapter 7 Bankruptcy Laws: Exemptions, Process, and Discharge

Filing Chapter 7 bankruptcy in Illinois can eliminate most unsecured debts, including credit card balances and medical bills, through a federal court discharge, while state-specific exemptions determine which property you keep. The process runs on the federal Bankruptcy Code, but Illinois is an opt-out state, so you use the Illinois exemption list rather than the federal one. Illinois raised several of those exemption amounts effective January 1, 2026, which meaningfully expands what you can protect in your home and vehicle.

Who Qualifies

Not every Illinois resident can file Chapter 7. The gatekeeper is the means test, which Congress built into the Bankruptcy Code to push higher-income filers into Chapter 13 repayment plans instead of a full discharge.1Office of the Law Revision Counsel. 11 U.S. Code 707 – Dismissal of a Case or Conversion to a Case Under Chapter 11 or 13 The test averages your household income over the six months before filing and compares it to the median income for an Illinois household of the same size. Fall below the median and you pass.

For cases filed on or after April 1, 2026, the Illinois median income thresholds are:

  • One earner: $73,180
  • Household of two: $93,934
  • Household of three: $113,625
  • Household of four: $137,902
  • Each additional person: add $11,100

These figures update roughly every six months, so confirm the current numbers before you file.2United States Department of Justice. Median Family Income Table – On or After April 1, 2026

Coming in over the median doesn’t automatically disqualify you. A second calculation subtracts allowed monthly expenses for housing, transportation, healthcare, and other necessities. If the disposable income left over is low enough that the court won’t presume abuse, Chapter 7 is still on the table.3United States Department of Justice. Means Testing

The Two Required Courses

Before filing, you must complete a credit counseling briefing within the 180 days leading up to your petition. The provider has to be approved by the U.S. Trustee Program, and the certificate of completion goes in with your paperwork. Skip it and the court dismisses your case.4United States Department of Justice. Credit Counseling and Debtor Education Information

After filing, you take a second course, a financial management class, before the discharge is entered. Miss this one and the court closes your case without discharging your debts, which leaves you worse off than not filing at all.5Office of the Law Revision Counsel. 11 USC 727 – Discharge The provider must again be approved by the U.S. Trustee, and Official Form 23 serves as proof.

What You Keep: Illinois Exemptions

Because Illinois has opted out of the federal exemption scheme, state law controls what property you can shield. Several key amounts were raised effective January 1, 2026.

Home Equity

The homestead exemption protects equity in your primary residence. An individual can now shield up to $50,000 of equity in a home, condominium, or cooperative. Co-owners share a combined cap of $100,000, split proportionally by ownership share.6Illinois General Assembly. Illinois Code 735 ILCS 5/12-901 – Amount The prior limits were $15,000 and $30,000, so this is more than a threefold increase. It applies only to your actual dwelling, not investment properties or vacation homes.

Vehicles, Tools, and the Wildcard

The motor vehicle exemption protects up to $3,600 of equity in a single vehicle, up from $2,400. Professional books, tools, or equipment used in your trade are exempt up to $2,250, previously $1,500.7Illinois General Assembly. Illinois Code 735 ILCS 5/12-1001 – Personal Property Exempt

Illinois also offers a wildcard exemption of up to $4,000 in any personal property, with the first $1,000 automatically exempt. You can apply the wildcard to bank accounts, a tax refund, or equity in items that don’t fit under another exemption. How you use it often decides how much cash and property you walk out with.

Retirement Accounts

Illinois fully exempts retirement plan assets with no dollar cap. That covers 401(k) plans, IRAs, pensions, profit-sharing plans, government retirement plans, and any account intended in good faith to qualify as a retirement plan under the Internal Revenue Code or the Illinois Pension Code.8Illinois General Assembly. Illinois Code 735 ILCS 5/12-1006 – Retirement Plans For many filers, this is the single most valuable protection they have. A substantial 401(k) can sit untouched while credit card balances are wiped out.

Equity above these limits is non-exempt, and the trustee can sell non-exempt assets to pay creditors. In practice, most Illinois Chapter 7 cases are “no-asset” cases where everything fits within the exemptions and the trustee has nothing to liquidate.

What Chapter 7 Won’t Wipe Out

Chapter 7 discharges most unsecured debt, but Congress carved out categories that survive no matter what. This is where filers get blindsided, assuming bankruptcy eliminates everything and then learning their worst debt is the one that stays.

  • Child support and alimony. Never dischargeable.
  • Most recent income tax debts. Older tax debts may qualify for discharge only if narrow timing rules are met, and fraud or willful evasion makes the debt permanently non-dischargeable.
  • Government-backed and qualified private student loans, unless you can prove repayment would be an “undue hardship,” a standard courts interpret narrowly.
  • Debts obtained through fraud or false financial statements. This category also captures luxury purchases over $500 to a single creditor within 90 days of filing, and cash advances over $750 within 70 days of filing.
  • Any debt for death or personal injury caused by driving while intoxicated.
  • Criminal fines, restitution, and most government penalties.
  • Debts from willful and malicious injury to a person or property.
  • Debts you fail to list, unless the creditor knew about the case in time to file a claim.

The full list of exceptions is in the Bankruptcy Code.9Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge If most of what you owe falls into these categories, Chapter 7 may not be worth filing.

How the Case Moves

Filing means submitting a petition and supporting schedules to the U.S. Bankruptcy Court for the federal district where you live. Illinois has three: Northern, Central, and Southern. The filing fee is $338, payable at submission, with installment payments or a fee waiver available in limited circumstances.

You’ll need to hand over, among other things, pay stubs or other proof of income received within 60 days before filing and a copy of your most recent federal tax return or transcript. The tax return has to reach the trustee at least seven days before the meeting of creditors.10Office of the Law Revision Counsel. 11 USC 521 – Debtor’s Duties You’ll also list every creditor, every asset you own with an estimated value, and your household income and expenses. The main form is Official Form 101, the Voluntary Petition for Individuals Filing for Bankruptcy, backed by the 106-series schedules.11United States Courts. Voluntary Petition for Individuals Filing for Bankruptcy Everything is signed under penalty of perjury. Omitting an asset or understating income can cost you your discharge and, in serious cases, result in criminal charges.

The Automatic Stay

The moment your petition is filed, the automatic stay takes effect. It halts most collection activity against you, including lawsuits, wage garnishments, foreclosure proceedings, repossessions, and creditor phone calls.12Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Creditors who violate the stay can face sanctions. If you’re facing an imminent garnishment or drowning in collection calls, the stay alone can bring immediate relief.

The 341 Meeting

Shortly after filing, the U.S. Trustee schedules a meeting of creditors, called the 341 meeting. Creditors rarely appear in a routine consumer case. The trustee places you under oath, verifies your identity, and asks about your disclosures and any non-exempt property. Most meetings run about ten minutes.13United States Department of Justice. Section 341 Meeting of Creditors

Discharge

Assuming no one objects and you’ve finished the debtor education course, the discharge typically arrives 60 to 90 days after the 341 meeting. The order operates as a federal court injunction: creditors who try to collect a discharged debt are violating that injunction.14Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge

Secured Debts: Cars, Homes, and Financed Items

Discharge eliminates your personal liability, but it doesn’t strip a lender’s lien on collateral. If you owe money on a car or a financed appliance, the lender can still repossess it once the case ends unless you act. You have three options for secured personal property:

  • Surrender the property. You return it, and any remaining balance is discharged.
  • Reaffirm the debt. You sign a new agreement to keep paying under the original terms. The property stays yours, but so does the debt, and courts scrutinize these agreements because they partially undo the discharge.
  • Redeem the property. You pay the current fair market value in a single lump sum, and the rest of the loan is discharged. This applies only to tangible personal property used for personal or household purposes, not real estate.15Office of the Law Revision Counsel. 11 USC 722 – Redemption

Redemption shines when you’re deeply underwater. Owe $12,000 on a car worth $6,000, and paying $6,000 to keep it clears real money off your books. The obstacle is coming up with the cash. Some lenders offer redemption financing, but the rates run high.

Reaffirmation is voluntary. No creditor can force you into one, and you can rescind within 60 days after the agreement is filed or before your discharge, whichever is later. Mortgage debts are handled differently in practice: courts generally won’t act on reaffirmation agreements secured by a home, so most homeowners simply keep making payments without reaffirming.

After the Discharge

Credit Report

A Chapter 7 filing stays on your credit report for up to 10 years from the filing date.16Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports Individual accounts included in the bankruptcy typically drop off after seven years. The initial score hit is significant, but many filers see scores recover within one to two years as the delinquent balances disappear. What happens after that depends on how you handle new credit.

Taxes on Discharged Debt

Ordinarily, canceled debt counts as taxable income. Bankruptcy is the major exception. Debt discharged in a Title 11 case is excluded from gross income under federal tax law.17Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness If a creditor sends a 1099-C reporting canceled debt, you claim the exclusion on IRS Form 982.

Filing Again

You cannot receive another Chapter 7 discharge if your prior Chapter 7 was filed within eight years of the new petition.5Office of the Law Revision Counsel. 11 USC 727 – Discharge The clock runs from filing date to filing date. File inside that window and the court denies your discharge, leaving your finances exposed for nothing. If you need relief sooner, Chapter 13 may be available, with its own timing rules.
