Illinois Craft Grower License: Fees, Scoring, and Renewal

An Illinois craft grower license lets a business cultivate cannabis in up to 5,000 square feet of canopy space and sell wholesale to dispensaries, infusers, transporters, cultivation centers, and other craft growers. Applying costs a nonrefundable $5,000, and awardees pay a $40,000 license fee before the license is issued. The state caps craft grower licenses at 150 total, and as of the most recent state report, 87 have been issued, all to social equity applicants.1Illinois Department of Financial and Professional Regulation. 2025 Annual Cannabis Report

What the License Lets You Do

A craft grower can cultivate cannabis, process concentrates and infused products, and sell to cultivation centers, other craft growers, infusers, and dispensaries.2Justia Law. Illinois Code 410 ILCS 705 – Article 30 Craft Growers You cannot sell directly to consumers. Your revenue depends entirely on wholesale relationships with other licensees.

You also cannot deliver product yourself past short distances without hiring a licensed transporter. In Cook County, the self-delivery radius is 2,000 feet. In counties with 700,000 to 3 million residents, it is 2 miles. In smaller counties, it is 15 miles. Anything beyond that requires a transporter license.2Justia Law. Illinois Code 410 ILCS 705 – Article 30 Craft Growers

How Many Licenses Exist and Who Gets Them

The Cannabis Regulation and Tax Act directed the Department of Agriculture to issue up to 40 craft grower licenses by July 2020 and up to 60 more by December 2021. After January 2022, the Department can raise the number by rule, but the total is capped at 150.2Justia Law. Illinois Code 410 ILCS 705 – Article 30 Craft Growers

How many you can hold depends on when you were awarded. First-round licensees can hold one, second-round licensees can hold two, and those awarded after January 2022 can hold three. Every one of the 87 licenses issued so far has gone to a social equity applicant, which reflects how the scoring works in practice.1Illinois Department of Financial and Professional Regulation. 2025 Annual Cannabis Report

Fees and What Goes in the Application

Applications are filed electronically with the Department of Agriculture. The $5,000 application fee is nonrefundable and goes to the Cannabis Regulation Fund. If you win a license, you pay a prorated $40,000 license fee before it is issued.3Illinois General Assembly. Illinois Code 410 ILCS 705/30-10 – Application4Illinois General Assembly. Illinois Code 410 ILCS 705/30-15

The application itself is heavy. You will need:

  • Illinois State Police background checks on all principal officers, board members, and agents, each of whom must be at least 21.
  • A security plan approved by the Illinois State Police, including a plant monitoring system, recordkeeping procedures, and staffing plan.
  • A description and survey of the enclosed, locked facility where cannabis will be grown, harvested, and packaged.
  • Proof of local zoning compliance and distance requirements.
  • A plan for hiring and educating minorities, women, veterans, and persons with disabilities.
  • A commitment to resource-efficient lighting, HVAC, water application, and wastewater filtration.
  • A description of your cultivation and horticultural experience.
  • Cultivation, processing, inventory, and packaging plans, along with weekly physical inventory of all plants.

Every one of those pieces is scored, and weak documents in any category cost points that are hard to make up elsewhere.3Illinois General Assembly. Illinois Code 410 ILCS 705/30-10 – Application

How Applications Are Scored

Applications are scored on a 1,000-point scale with 2 bonus points available. The maximum points by category:

  • Social equity applicant status: 200
  • Security plan and recordkeeping: 145
  • Business plan and services: 110
  • Diversity plan: 100
  • Product safety and labeling: 95
  • Illinois residency (5+ years, 51%+ ownership): 90
  • Facility suitability: 75
  • Cultivation plan: 75
  • Employee training plan: 50
  • Environmental plan: 20
  • Labor and employment practices: 20
  • Veteran ownership (51%+): 20

Social equity status alone is worth more than security and recordkeeping combined. Illinois residency and veteran ownership add meaningful points on top. The scoring is why every license issued so far has gone to a social equity applicant: without that 200-point block, a competitive score is very hard to reach.5Illinois General Assembly. Facility, Security, and Inventory Rules

All cultivation must happen inside an enclosed, locked facility at the address on the license, with no more than 5,000 square feet of canopy for flowering plants.6Illinois Department of Agriculture. Adult Use Cannabis Business Establishment License Applications – Questions and Answers Access is restricted to registered agents, Department of Agriculture and Public Health inspectors, law enforcement and emergency responders, non-cannabis contractors, transporter agents, and approved incubator or mentoring participants. A craft grower sharing a building with an infuser or dispensary can share common areas like bathrooms, but no one works inside the cultivation space without being a registered craft grower agent.2Justia Law. Illinois Code 410 ILCS 705 – Article 30 Craft Growers

Resource-efficiency rules bite too. Lighting cannot exceed 36 watts per gross square foot of canopy, or every fixture must have a photosynthetic photon efficacy of at least 2.2 micromoles per joule and be listed by the DesignLights Consortium. Operations under 6,000 square feet of canopy need high-efficiency ductless split HVAC; larger ones need variable refrigerant flow systems. Watering must use automated systems like drip irrigation, and runoff must be measured and reported.3Illinois General Assembly. Illinois Code 410 ILCS 705/30-10 – Application

Security runs 24 hours a day, seven days a week. Closed-circuit cameras have to cover every entrance and exit, parking areas, adjacent alleys, and the entire interior wherever cannabis is produced, stored, shipped, or destroyed. Restrooms and executive offices are the only exceptions. Recordings must be time-stamped, exportable, and tamper-evident, and the system has to keep running through power outages.7Illinois General Assembly. Illinois Administrative Code 8-1300.385 – Security

Every plant is logged in a seed-to-sale tracking system, and physical inventory happens weekly. The Department of Agriculture’s Bureau of Cannabis Inspections runs pre-operational, routine, and investigative inspections covering plant and product management, security, inventory, packaging, transportation, and other operations, and inspectors can arrive at any time.8Illinois Department of Agriculture. Testing, Waste, and Taxes

Before any batch goes to a dispensary, an approved independent lab pulls a random sample and tests it for microbiological contaminants, mycotoxins, pesticide residues, residual solvents, and active ingredient content.10Illinois General Assembly. Illinois Code 410 ILCS 705/50-5 – Testing

Cannabis waste has to be rendered unusable before it leaves the facility. That means grinding it and mixing it with enough non-cannabis material to make the result at least 50% non-cannabis by volume. Compostable waste can be mixed with food or yard waste and sent to composting or anaerobic digestion; non-compostable waste is mixed with paper, cardboard, plastic, or soil and sent to a landfill or incinerator. Everything is weighed, recorded, and entered in the tracking system, a supervisor verifies the process, and the whole event happens on camera. You also give the Department of Agriculture and Illinois State Police at least seven days’ notice through the tracking system before destroying product.11Legal Information Institute. Illinois Administrative Code Title 8, 1000.460 – Waste Disposal

On the tax side, craft growers pay a 7% cultivation privilege tax on the gross receipts from the first sale of cannabis. It applies to the full selling price and is on top of all other state and local taxes. When buyer and seller are related or the deal is not at arm’s length, the Department of Revenue can set the price based on comparable products.12Justia Law. Illinois Code 410 ILCS 705 – Article 60 Cannabis Cultivation Privilege Tax The tax is legally the cultivator’s, though you can separately state and pass it to the buyer. Returns are filed electronically on Form CC-1 through MyTax Illinois, with Schedule CC-2 for multiple sites. A 1.75% filing discount applies, capped at $1,000 per period.13Illinois Department of Revenue. CC-1 Instructions

Renewing the License

Craft grower licenses renew annually. The renewal fee is $40,000, and the renewal application is due at least 45 days before the current license expires. The Department of Agriculture sends written notice at least 90 days out, but not receiving notice is not an excuse for missing the deadline.14Illinois General Assembly. Illinois Administrative Code 8-1300.320 – License Renewal

Renewal is not just a check. The Department reviews your compliance history, including violations, corrections, and penalties. You also submit an agent, employee, contracting, and subcontracting diversity report along with an environmental impact report. If your license expires before you renew, all operations must stop until the renewal is approved.14Illinois General Assembly. Illinois Administrative Code 8-1300.320 – License Renewal

The Banking Problem

Cannabis remains illegal under federal law, and that friction reaches every licensee in Illinois. Many banks and credit unions will not offer standard checking accounts, business loans, electronic payroll, or card processing to cannabis businesses because handling the money technically involves proceeds from a federally illegal activity. Banks that do serve the industry file Suspicious Activity Reports under FinCEN guidance. As of 2026, no major federal banking reform has passed and those obligations remain in place.15Congressional Research Service. Marijuana Banking – Legal Issues and the SAFE(R) Banking Acts

For a craft grower, that translates into higher banking fees, the risk of account closures on short notice, limited access to credit, and often more cash on hand than a comparable business would carry. Plan for it before you open the doors, because it shapes both your security posture and your tax compliance.
