Illinois Immigration: Licenses, Healthcare, and RISE Act Aid

Non-citizens living in Illinois have some of the strongest state-level protections in the country: local police cannot hold you for ICE on an administrative detainer alone, you can get a standard driver’s license without a Social Security number, state financial aid is open to undocumented college students, and seniors can still enroll in a state-funded health program. Illinois immigrant rights and benefits also come with real limits, though, including a major adult healthcare program that closed in 2025, a driver’s license that will not get you through airport security, and federal immigration rules that apply no matter what the state offers.

What Local Police Can and Cannot Do

The Illinois TRUST Act (5 ILCS 805) bars state and local law enforcement from detaining anyone solely on a federal immigration detainer or civil immigration warrant. Local police cannot hold you past your normal release date because ICE sent a detainer request. The only exception is a warrant actually signed by a judge.1Illinois General Assembly. Illinois Code 5 ILCS 805 – Prohibition on Enforcing Federal Civil Immigration Laws

The warrant distinction decides what happens at your door. A judicial warrant comes from a court, is signed by a judge, and carries authority to enter private space. An administrative warrant, such as ICE Form I-200 or Form I-205, is issued by immigration authorities without court involvement and does not authorize entry into your home without your consent. If agents arrive with an administrative warrant only, you have no legal obligation to open the door.

The VOICES Act (5 ILCS 825) protects non-citizen crime victims by setting deadlines for law enforcement to process the certifications needed for U-visas and T-visas.2Illinois General Assembly. Illinois Code 5 ILCS 825 – Voices of Immigrant Communities Empowering Survivors Act Those visas offer immigration relief to victims of serious crimes and human trafficking who cooperate with investigators, and they require a signed certification from the investigating agency. The deadlines exist because agencies used to let those requests sit indefinitely, which effectively punished victims for reporting.

Driver’s Licenses Without a Social Security Number

Illinois replaced its old Temporary Visitor Driver’s License with a single licensing system under House Bill 3882. Anyone who cannot obtain a Social Security number can apply for a standard Illinois driver’s license. If you have documentation authorizing your presence in the country, you provide that in place of a Social Security number. If you do not, you submit a valid passport from your country of citizenship and proof that you have lived in Illinois for more than one year.3Illinois General Assembly. Illinois General Assembly HB3882 103rd General Assembly

The license looks identical to every other Illinois license. No marking, color, or visual cue reveals immigration status, which was a deliberate choice to prevent discrimination during traffic stops.4State of Illinois. Gov. Most working-age adults pay $30 for a four-year license.5Illinois Secretary of State. Drivers License and State ID Card Fees

Because everyone is in the same system, there is no separate database flagging non-citizen drivers. Applicants without a Social Security number sign a declaration at the time of application stating they are ineligible for one, rather than filing paperwork that creates a separate record category.

The REAL ID Problem

The standard license issued through this process is not REAL ID compliant. REAL ID requires proof of lawful status and a Social Security number, so applicants who qualified by showing a foreign passport and one year of residency get a standard license without the star.

Federal REAL ID enforcement took full effect in May 2025. A standard license without the star will not get you through a TSA checkpoint for a domestic flight or into a secure federal facility. Alternatives TSA accepts include a valid unexpired foreign passport, a Permanent Resident Card, an Employment Authorization Document, or a DHS trusted traveler card such as Global Entry. TSA also offers a backup identity verification service called ConfirmID for travelers without compliant ID, but verification is not guaranteed.6Defense Travel Management Office. Travelers without REAL ID Could Pay 45 Fee for TSAs ConfirmID Beginning February 1 2026 If you need to fly domestically, keep a valid foreign passport current.

Healthcare: What Is Still Available

Illinois ran two state-funded health programs for non-citizens who did not qualify for federal Medicaid: Health Benefits for Immigrant Adults (HBIA) for ages 42 through 64, and Health Benefits for Immigrant Seniors (HBIS) for ages 65 and older.7Illinois Department of Human Services. Health Benefits for Immigrant Adults and Health Benefits for Immigrant Seniors Both offered coverage similar to Medicaid.

HBIA closed effective July 1, 2025. Anyone enrolled lost coverage on June 30, 2025, and no direct replacement program for the 42-to-64 age group has been announced.8Illinois Department of Healthcare and Family Services. Health Benefits For Immigrant Adults Former enrollees can seek care at Federally Qualified Health Centers and free charitable clinics, which serve patients regardless of immigration status or ability to pay. People with documented non-citizen status may also qualify for coverage through the health insurance marketplace.

HBIS remains active for non-citizens 65 and older. Eligibility follows the same criteria used for the state’s Aid to the Aged, Blind or Disabled program, and the program is entirely state-funded.7Illinois Department of Human Services. College Financial Aid Through the RISE Act

The Retaining Illinois Students and Equity (RISE) Act opens state financial aid to undocumented students and other non-citizens who cannot get federal student aid. Qualifying students apply for Illinois Monetary Award Program (MAP) grants through an alternative application that does not require a FAFSA or Social Security number.9Illinois Student Assistance Commission. Alternative Application for Illinois Financial Aid MAP grants cover tuition at eligible Illinois colleges, universities, and career programs. Awards are based on financial need, and eligibility depends on income, not immigration status.

How State Benefits Interact With Public Charge

If you have a pending or future application for a green card or visa, the federal public charge rule matters. A public charge finding means the government believes you are likely to become primarily dependent on government assistance for basic needs. The determination is prospective and considers age, health, family size, assets, income, education, and past benefit use.

Not all benefits count. Federal policy excludes Medicaid, with a narrow exception for long-term institutionalization in a nursing facility or mental health institution, and excludes the Children’s Health Insurance Program. What counts is public cash assistance for income maintenance and long-term institutionalization at government expense, including state-funded versions of those programs.10U.S. Citizenship and Immigration Services. How Receiving Public Benefits Might Impact the Public Charge Ground of Inadmissibility

Illinois programs like HBIS provide Medicaid-like medical coverage and are not cash assistance. Certain immigration categories are also entirely exempt from public charge analysis, including refugees, asylees, VAWA self-petitioners, and T-visa and U-visa holders. Benefits received while in an exempt category are not counted even if you later apply for adjustment of status in a non-exempt category.10U.S. Citizenship and Immigration Services. How Receiving Public Benefits Might Impact the Public Charge Ground of Inadmissibility Fear of public charge consequences keeps many eligible people from using benefits they are legally entitled to. Before declining medical care or benefits based on general anxiety, talk to an immigration attorney who can look at your specific situation.

Filing Taxes With an ITIN

Federal tax obligations apply to everyone earning income in the United States. Non-citizens who cannot get a Social Security number file using an Individual Taxpayer Identification Number (ITIN), a nine-digit processing number issued by the IRS through Form W-7.11Internal Revenue Service. About Form W-7 Application for IRS Individual Taxpayer Identification Number

Applying for an ITIN usually means attaching a completed federal tax return to Form W-7, with exceptions for dependents, spouses, and people claiming tax treaty benefits. A valid passport is the single most useful document because it satisfies both the identity and foreign status requirements by itself. Without a passport, you need at least two separate documents covering both requirements, one of which must include a recent photograph. There is no application fee, and the IRS estimates processing at 7 to 11 weeks.

An ITIN does not authorize employment and does not create eligibility for Social Security benefits. It also expires if you do not use it on a tax return for three consecutive years. Filing matters beyond legal compliance: tax records are evidence of continuous U.S. presence that can support future immigration applications, and they build a financial history that demonstrates self-sufficiency.

Documents You Will Need

Almost every Illinois program for non-citizens requires proving who you are and where you live. A valid foreign passport is the strongest single identity document because it works across the driver’s license application, the ITIN filing, and more. A consular identification card from your country’s consulate is another accepted identity document.

For a driver’s license, applicants without documentation of authorized presence must show residency of more than one year.3Illinois General Assembly. Illinois General Assembly HB3882 103rd General Assembly The Secretary of State accepts documents such as bank statements dated within 90 days, lease or rental agreements, homeowner’s or renter’s insurance policies, and official mail from a government agency showing your name and current address. A standard first-time license needs at least one residency document; a REAL ID application or address change needs two.12Illinois Secretary of State. Illinois Secretary of State Document Requirements to Obtain a Drivers License or State ID Card Make sure your name appears consistently across every document, since a mismatch between your passport name and a utility bill is a common cause of processing delays.

For HBIS, expect to provide proof of income such as pay stubs or employer letters. For MAP grants, the alternative application collects financial information directly.

Where to Get Help

Schedule a driver’s license appointment through the Illinois Secretary of State’s website before visiting a facility, since some locations require appointments for first-time applicants and walk-ins can face long waits.

Illinois Welcoming Centers, operated through the Department of Human Services, connect people with information about Medicaid applications, food assistance, housing, education, and other services.13Illinois Department of Human Services. Illinois Welcoming Center They provide case management and referrals rather than processing applications directly, which makes them a reasonable starting point if you are not sure which programs you qualify for.

For anything involving a pending or future immigration case, especially questions about how a benefit might affect an adjustment of status application, consult an immigration attorney before acting on secondhand information. Nonprofit legal organizations across Illinois also provide free or low-cost immigration legal services.
