Illinois Marijuana Tax Rates: Excise, Sales, and Medical

Illinois marijuana tax rates run from about 20% to over 40% of the sticker price for recreational buyers, depending on the product and where you shop. The state charges a Cannabis Purchaser Excise Tax of 10%, 20%, or 25% based on product type and THC content, then stacks the standard 6.25% state sales tax and local city and county taxes on top. Medical cardholders skip the excise tax entirely and pay roughly 1% at the state level.

The Three Excise Brackets

The Cannabis Purchaser Excise Tax is the biggest line most shoppers notice, and it splits three ways:

  • 10% on cannabis flower and other non-infused products with THC at or below 35%. Most standard flower and pre-rolls sit here.
  • 20% on cannabis-infused products such as edibles, tinctures, and topicals, regardless of THC concentration. The infusion itself triggers the higher rate.
  • 25% on non-infused cannabis above 35% THC. Concentrates, live resin, and high-potency flower typically land in this tier.

These rates come from the Cannabis Regulation and Tax Act, which took effect January 1, 2020, and the dispensary collects the tax at the point of sale.1Illinois Department of Revenue. Excise Tax Rates and Fees Check the THC percentage on the label before you reach the register. A $60 gram of live resin at the 25% tier adds $15 in excise tax alone, before any sales taxes touch it. A $30 pack of edibles at the 20% tier adds $6.

State and Local Sales Tax on Top

Every recreational cannabis sale also carries the standard Illinois sales tax of 6.25%, which applies to tangible personal property statewide.2Illinois Department of Revenue. Use Tax Rates That rate is fixed. What swings your total is the local layer.

Municipal Cannabis Tax

Cities and villages can impose a cannabis retailers’ occupation tax of up to 3%, set in quarter-percent increments.3Illinois General Assembly. Illinois Code 65 ILCS 5 – Illinois Municipal Code Most municipalities that opted in went straight to the 3% ceiling, though some set lower rates and a few charge nothing cannabis-specific. Rates can differ between neighboring towns, so a short drive sometimes changes the math.

County Cannabis Tax

Counties add another layer: up to 3.75% in unincorporated areas and up to 3% within an incorporated municipality.4Illinois Department of Revenue. County Cannabis Retailers’ Occupation Tax (CCAN) Cook County, for example, applies its 3% on top of whatever the city charges. A Chicago dispensary carries both the Cook County tax and the City of Chicago’s own cannabis tax, which is why the Chicago area sees some of the highest effective rates in the state.

What the Total Looks Like at the Register

Stack it all together and a buyer picking up high-potency concentrate in a high-tax jurisdiction can face a combined rate above 40%. Even in a lower-tax area, standard flower generally lands around 20% once excise, state sales, and local taxes combine.

Here is the math on a $60 gram of concentrate in a city hitting the local maximums: $15 in excise tax at the 25% rate, $3.75 in state sales tax, and roughly another $3.60 or more in local taxes. The $60 product rings up at over $82.

Medical Cardholders Pay About 1%

A valid medical cannabis registry card changes the picture entirely. The Cannabis Purchaser Excise Tax statute defines “purchaser” to exclude medical cardholders, so the three-tier excise tax doesn’t apply.6Illinois Department of Revenue. About Cannabis Taxes Medical cannabis is taxed at the state’s qualifying food and drug rate of 1%.2Illinois Department of Revenue. Use Tax Rates

The practical gap is large. A $50 purchase incurs about $0.50 in state tax for a cardholder. The same product bought recreationally could carry $10 to $12.50 in excise tax alone, with another $3 or more in state and local sales taxes stacked on. For anyone buying regularly, the card pays for itself within a few trips.

Illinois recognizes a long list of qualifying conditions, including chronic pain, PTSD, cancer, epilepsy, Crohn’s disease, migraines, and multiple sclerosis, among several dozen others. Access to medical pricing at a dispensary requires a physician certification and a state-issued registry identification card.

Discounts Do Not Lower the Taxed Amount

One quirk catches shoppers at checkout: the excise tax is calculated on the purchase price before store-level discounts. Illinois defines “purchase price” as the consideration paid for cannabis, determined without deductions for cost of materials, labor, or other expenses.7Illinois Department of Revenue. Cannabis Tax Frequently Asked Questions If a dispensary runs a buy-one-get-one-half-off promotion, the tax can reflect the full pre-discount price, so the final bill may run higher than the advertised deal suggests.

Rates are the same for Illinois residents and out-of-state visitors; what differs is how much you can legally carry, not what you pay in tax on it.
