Illinois Marijuana Tax Rates: Excise, Sales, Local, and Medical

The Illinois marijuana tax rate on adult-use purchases runs from about 20% to more than 35% once you stack the state’s potency-based excise tax, the 6.25% state sales tax, and any local cannabis taxes where you buy. Medical cardholders pay far less, usually around 1%. What you actually owe at the register depends on two things: what you’re buying and where you’re buying it.

State Excise Tax by Product Type

Illinois taxes adult-use cannabis at three different excise rates tied to potency and product form:1Illinois Department of Revenue. Excise Tax Rates and Fees

  • 10% on flower and other cannabis products with a THC concentration at or below 35%.
  • 25% on cannabis products above 35% THC, which covers most concentrates and high-potency vape cartridges.
  • 20% on cannabis-infused products such as edibles and tinctures, regardless of THC level.

The tax is technically a privilege tax on the retailer, but dispensaries pass it directly to consumers on the receipt. A gram of standard flower is taxed noticeably less than a gram of live resin, which is how the state pushes higher potency into a higher tax bracket.

The 6.25% State Sales Tax

On top of the excise tax, every adult-use cannabis sale is subject to Illinois’s 6.25% state Retailers’ Occupation Tax, the same rate that applies to general merchandise.2Illinois Department of Revenue. It stacks on top of the excise rate, not inside it, so a $50 edible is hit with the 20% excise, the 6.25% sales tax, and whatever local taxes apply.

Local City and County Cannabis Taxes

Municipalities and counties can add their own cannabis taxes on top of the state charges, and the caps are generous enough to push the total well past what you’d pay in a tax-free suburb.

Municipal Rates

Any incorporated city or village can impose a cannabis retailers’ occupation tax of up to 3%, set in quarter-percent increments.3Illinois Department of Revenue. Municipal Cannabis Retailers’ Occupation Tax (MCAN) Not every town charges the maximum, and some charge nothing, so the rate shifts from one municipality to the next.

County Rates

Counties have separate authority. In unincorporated parts of a county the cannabis tax can reach 3.75%, and for dispensaries located inside a municipality the county can still charge up to 3%.4Illinois Department of Revenue. Chicago and Cook County

Home rule jurisdictions can also apply their general sales taxes to cannabis. Chicago imposes its 3% municipal cannabis tax while Cook County adds its own 3% county cannabis tax, for a 6% local cannabis layer alone. Add the state excise and general sales taxes, and a Chicago buyer picking up high-THC concentrate can face a total effective rate above 40%. Shop in a suburb outside Cook County that hasn’t adopted a local cannabis tax and the number drops sharply.

What a Real Receipt Looks Like

Take a customer in a mid-sized Illinois city with a 3% municipal cannabis tax and no county cannabis tax, buying $100 of standard flower at 35% THC or below:

  • State excise tax (10%): $10.00
  • State sales tax (6.25%): $6.25
  • Municipal cannabis tax (3%): $3.00
  • Total taxes: $19.25
  • Out the door: $119.25

Now run the same $100 as high-THC concentrate in Chicago. The excise tax alone jumps to $25, the local cannabis taxes add $6, and general sales taxes in Chicago push the total tax burden well past $35 on that same purchase. Product choice and location together set the number.

Medical Cannabis Rate

Registered patients under the Compassionate Use of Medical Cannabis Program Act get a very different bill. Medical purchases are exempt from the tiered adult-use excise taxes and are instead taxed at the 1% state Retailers’ Occupation Tax rate that applies to prescription drugs and qualifying medications.5Illinois Department of Revenue. Cannabis Tax Frequently Asked Questions Medical purchases are also generally exempt from local retailers’ occupation taxes, with narrow exceptions for certain regional transit authority taxes.

To pay the medical rate, you need a valid state-issued medical cannabis registry card and you have to buy from a licensed dispensary, which verifies your status in the state tracking system before ringing you up. For a regular buyer the swing is significant: roughly 1% versus 20% or more on the same product.

Two Things That Move Your Total

If you want to predict what you’ll pay before you walk in, focus on the two variables the state has built into the system. The first is potency and product form, because that decides whether the excise tax is 10%, 20%, or 25%. The second is location, because a dispensary in Chicago and one in a rural municipality with no local cannabis tax are working from very different starting points. Everything else on the receipt is fixed.
