Illinois Mesothelioma Lawsuit: Deadline, Courts, and Trust Funds

An Illinois mesothelioma lawsuit must generally be filed within two years of diagnosis, or within two years of death for a wrongful death claim brought by surviving family. Cases are typically filed in Madison, Cook, or St. Clair County — the three jurisdictions that together handle roughly half of all new asbestos lawsuits in the United States each year — and compensation can come from a civil verdict or settlement, from bankruptcy trust funds set up by defunct asbestos companies, and, for veterans, from the VA.1HeplerBroom. The Two-Year Deadline

Illinois gives a living mesothelioma patient two years to file a personal injury lawsuit. The clock starts when two things are true: the patient has a formal diagnosis, and the patient knows or should know the disease was caused by asbestos exposure.2O’Brien Law Firm. What Is the Statute of Limitations on Asbestos Claims This “discovery rule” matters because mesothelioma can take decades to appear after the exposure that caused it.3Vogelzang Law. State-Specific Laws for Filing Asbestos Lawsuits: Deadlines and Rules To Know in Illinois

For wrongful death claims brought by surviving family after a patient dies, the two-year period runs from the date of death.4ELS Law. Illinois

One trap deserves attention. If a living patient lets the two-year personal injury deadline pass without filing, the family loses the ability to bring a wrongful death claim on the same asbestos injury later.2O’Brien Law Firm. What Is the Statute of Limitations on Asbestos Claims A missed deadline during life closes the door after death.

Who Can Bring the Claim

A mesothelioma patient can file a personal injury lawsuit while alive. If the patient has already died, a surviving spouse, child, parent, or estate representative can file under the Illinois Wrongful Death Act.5TorHoerman Law. Illinois Wrongful Death Act Explained

Two different claims may be available after a death, and they pay different people. Wrongful death proceeds go to the next of kin based on family relationship and dependency, outside of any will. A separate survival action covers damages the patient could have recovered before death; that money flows into the estate and is distributed through probate.6Justia. In September 2024, Judge Andrew Carruthers revised the county’s standing case management order. The revisions removed previous caps on annual trial settings, on the number of plaintiff firms per docket, and on priority cases per jury week. They also lowered the age threshold for an expedited trial setting from 70 to 67 and set up mesothelioma plaintiffs to receive a trial date within six months of a hearing. Plaintiffs seeking an expedited setting no longer need a physician’s life-expectancy report.8KCIC. Madison County Standing Order Revisions1HeplerBroom. Damages in an Illinois mesothelioma case fall into three categories. Economic damages cover medical bills, lost wages, reduced earning capacity, in-home care, and funeral costs. Non-economic damages address pain and suffering, emotional distress, loss of enjoyment of life, and loss of companionship. Punitive damages may be awarded when a defendant’s conduct was especially egregious, such as knowingly concealing asbestos hazards from workers.12Sam & Dan. Mesothelioma Compensation

Asbestos Trust Fund Claims

When the company responsible for a claimant’s exposure has gone through bankruptcy, compensation runs through an asbestos trust fund rather than a lawsuit. More than 60 active trusts hold over $30 billion in assets and have paid out more than $17 billion since 1988.14Asbestos.com. Asbestos Trust Funds

What a trust actually pays varies widely. Each trust sets its own payment percentage applied to a scheduled claim value. Johns Manville, one of the largest, currently pays 5.1% of scheduled value; W.R. Grace pays 30.1%; North American Refractories pays 100%.20Mesothelioma.com. Asbestos Trust Funds Individual trust claims range from $7,000 to $1.2 million, with a median value around $180,000. Because most patients were exposed through multiple sources, claimants typically file with 20 or more trusts and collect a combined total in the $300,000 to $400,000 range.14Asbestos.com. Trust claims move faster than lawsuits. Most resolve in three to six months, and expedited claims for terminally ill patients can resolve in under 90 days. Each trust sets its own filing deadline, usually two to three years after diagnosis, independent of the state statute of limitations. Trust compensation is generally not taxable because it is treated as payment for physical injury.14Asbestos.com. Asbestos Trust Funds20Mesothelioma.com. Asbestos Trust Funds

VA Benefits for Veterans

Veterans are a large share of mesothelioma claimants because asbestos was heavily used in shipbuilding, base construction, and military equipment through the 1970s. In Illinois, documented exposure sites include the Great Lakes Naval Station.21ELS Law. Asbestos Jobsites

A veteran can pursue VA disability benefits separately from any lawsuit or trust fund claim; one does not replace the other. Eligible veterans receive tax-free monthly compensation and access to VA health care. The VA requires medical records, service records showing the veteran’s job or specialty, and a physician’s statement linking the condition to military asbestos exposure.22U.S. Department of Veterans Affairs. Recent Changes That Expand Who You Can Sue

Suing an Employer After Decades: Martin v. Goodrich Corp.

On January 24, 2025, the Illinois Supreme Court decided Martin v. Goodrich Corp., significantly expanding the ability of workers with latent occupational diseases to sue their employers. The case involved Rodney Martin, exposed to vinyl chloride while working for Goodrich 45 years before his 2019 liver cancer diagnosis; his widow sued after his death.23FindLaw. Martin v. Goodrich Corporation

The court held that Section 1(f) of the Workers’ Occupational Diseases Act, which had cut off employer liability after a set period, functions as a statute of repose. Because the General Assembly enacted Section 1.1 in 2019 to create an exception for repose-barred claims, workers whose diseases emerge decades after exposure can now pursue civil lawsuits against their employers. The court found no due process problem, holding that an employer’s right to use the Act’s exclusivity defense does not vest until the worker’s cause of action accrues, which happens at diagnosis.24Illinois Courts. Goodrich Corporation The case involved vinyl chloride, but the ruling applies directly to mesothelioma claims, which commonly surface decades after exposure ended.

Suing Out-of-State Companies: Senate Bill 328

On August 15, 2025, Governor J.B. Pritzker signed Senate Bill 328, making Illinois a general jurisdiction state for toxic-exposure lawsuits. A company registered to do business in Illinois, or one that transacts business here, can now be sued in Illinois courts even when the exposure happened elsewhere, as long as at least one co-defendant is already subject to jurisdiction in the state. For companies already registered in Illinois, the consent provision attaches on the due date of their next annual report.25Tucker Ellis. Illinois SB 328 Signed: Consent-by-Registration Jurisdiction Now Law for Toxic Exposure Cases

SB 328 faces a legal challenge. A Sangamon County circuit court dismissed a constitutional challenge brought by 47 Republican state lawmakers on August 21, 2025, and the lawmakers appealed on September 11, 2025. As of late 2025, that appeal remained pending and SB 328 stayed in effect.26Greenberg Traurig. Circuit Court Rejects Illinois Lawmakers’ Challenge to Senate Bill 328
