Illinois Tax on Weed: Rates, Tiers, and Medical Discounts

The Illinois tax on weed comes in layers. Recreational buyers pay a state excise tax of 10%, 20%, or 25% depending on the product’s potency and type, plus the 6.25% state sales tax, plus any local cannabis taxes imposed by the city and county where the dispensary sits. Depending on what you buy and where you buy it, the combined tax on a recreational purchase runs from roughly 16% at the low end to about 37% at the high end. Medical patients pay far less.

Excise Tax Tiers by Product and Potency

The excise tax is the largest and most variable piece. Under 410 ILCS 705/65-10, the rate depends on what’s in the package:

  • Flower and other products with adjusted THC at or below 35%: 10% of the purchase price
  • Cannabis-infused products such as edibles, tinctures, and topicals: 20% of the purchase price
  • Products with adjusted THC above 35%, including concentrates and high-potency vapes: 25% of the purchase price

Dispensaries add this tax at the register on top of the shelf price and remit it to the state.1Illinois Department of Revenue. Excise Tax Rates and Fees Every adult-use dispensary in Illinois charges these same three rates.

How Adjusted THC Is Calculated

The potency number that decides your tier isn’t the delta-9 THC figure printed on the front of the label. Illinois uses a formula that also counts THCA, the precursor that converts to active THC when heated. Adjusted THC equals the delta-9 THC percentage plus 87.7% of the THCA percentage.1Illinois Department of Revenue. Excise Tax Rates and Fees A flower product labeled 22% THCA and 1% delta-9 THC works out to about 20.3% adjusted THC, well within the 10% tier. Cannabis-infused products skip the calculation entirely and always sit in the 20% tier regardless of potency.

State and Local Sales Taxes

Every recreational cannabis purchase also carries the standard Illinois retailers’ occupation tax of 6.25%, the same rate charged on general merchandise.2Illinois Department of Revenue. These stack. Not every jurisdiction imposes the maximum, and some have no local cannabis tax at all. What a Receipt Can Actually Look Like

Put the pieces together on a worst-case purchase. In a city where both the municipality and county charge the maximum, the sales-tax side comes to 6.25% + 3% + 3% = 12.25%. Add the 25% excise on a high-potency concentrate and the total tax load reaches 37.25%. A $50 gram of concentrate in that scenario carries about $18.63 in tax, bringing the register total close to $69. Flower in a low-tax jurisdiction looks very different: 10% excise plus 6.25% state tax, with little or no local add-on, lands near 16%.

Medical Patients Pay a Fraction of That

Registered medical cannabis patients skip the excise tax entirely. Medical cannabis is taxed at just 1% under the state retailers’ occupation tax, the same reduced rate Illinois applies to qualifying pharmaceuticals, and is generally exempt from local cannabis retailers’ occupation taxes, with narrow exceptions for the Regional Transportation Authority and Metro-East Transit District areas.5Illinois Department of Revenue. The gap is dramatic. The $50 concentrate that costs a recreational buyer close to $69 in a max-rate jurisdiction costs a medical patient about $50.50. You need a valid medical cannabis registry card and must present it at the time of purchase. For regular users who qualify, the tax savings alone can cover the cost of registering within a handful of purchases.

The 7% Tax You Never See on a Receipt

Before cannabis ever reaches a dispensary shelf, Illinois collects a 7% cultivation privilege tax on the first sale from a cultivator to a dispensary or processor.6Illinois General Assembly. Illinois Code 410 ILCS 705/60-10 – Tax Imposed It applies to the gross receipts of that wholesale transaction. Consumers don’t see it as a line item, but it’s built into the shelf price you then pay the other taxes on.

Where the Money Goes

All cannabis tax revenue flows into the Cannabis Regulation Fund under 30 ILCS 105/6z-112. After the state covers administrative costs, the remainder is divided by fixed percentages: 25% to the Restore, Reinvest, and Renew (R3) Program for communities most affected by past drug enforcement; 8% to the Local Government Distributive Fund for enforcement and impaired-driving work; 2% to the Drug Treatment Fund for public education and public-health data; and 35%, or whatever balance remains, to the General Revenue Fund.7Illinois General Assembly.
