Illinois unemployment benefits pay eligible workers between $31 and $605 per week for up to 26 weeks after a job loss that was not their fault. The Illinois Department of Employment Security (IDES) runs the program under the state’s Unemployment Insurance Act, and collecting a check depends on meeting earnings requirements, filing correctly, and keeping up with a strict certification schedule every two weeks.1Illinois Department of Employment Security. Who Qualifies
Three things have to line up. Your separation from work has to be involuntary, your past wages have to reach a minimum threshold, and you have to stay ready and looking for work while you collect.
Involuntary means a layoff, a business closure, or a similar situation you did not choose. You can be disqualified if you quit without good cause tied to your employer, were fired for misconduct, were discharged for a felony or theft connected to your job, or are out of work because of a labor dispute.2Illinois Department of Employment Security. Benefit Rights Information for Claimants and Employers Your employer also has to be covered under Illinois law. Some agricultural, domestic, railroad, and government positions fall outside coverage, along with work performed for family members or entirely on commission.
The wage requirement runs on a “base period.” Illinois uses the first four of the last five completed calendar quarters before you file. If your earnings in that window fall short, IDES applies an alternative base period made up of the four most recently completed quarters. The alternative is a fallback only; it cannot be used to push your weekly amount higher than the standard period would produce.3Illinois Department of Employment Security. While you collect, you must be able to work, available to work, and actively searching. IDES requires you to register with IllinoisJobLink.com and create a profile that employers can search.4Illinois Department of Employment Security. 10 Things You Should Know Keep a written log of every application, interview, and contact. IDES can audit it.
Turning down a job offer without good cause ends your benefits, but not every offer is a “suitable” one. Illinois law weighs the health and safety of the position, your physical ability, your training and pay history, how long you have been out of work, and the distance from your home. No job is suitable if it is vacant because of a strike or lockout, if the pay and conditions are substantially worse than what similar workers earn locally, or if you would be required to join a company union or leave a legitimate labor organization as a hiring condition.5Illinois General Assembly. 820 ILCS 405 Unemployment Insurance Act
How to File
File online at the IDES website or in person at a local IDES office. Have your Social Security number, employer names and addresses, dates of employment, tax records, and any pension information ready before you start. Pull your pay stubs, W-2s, and separation documents together first. IDES may schedule an adjudication interview to verify what you filed; responding quickly keeps payments moving.
The Unpaid Waiting Week
Your first eligible week of unemployment is a “qualifying week.” You do not get paid for it. Benefits start with the second eligible week.3Illinois Department of Employment Security. Unemployment Insurance Benefits Handbook File as soon as you become unemployed rather than waiting, because delaying pushes the whole timeline back.
Certifying Every Two Weeks
The initial application is only step one. Every two weeks after that, you have to log in and certify that you are still unemployed, still able and available, still looking, and report any earnings you made.6Illinois Department of Employment Security. FAQs for Claimants IDES assigns you a certification day (Monday, Tuesday, or Wednesday), with Thursday and Friday as makeup days. The online system is open from 3:00 a.m. to 7:30 p.m. on your assigned day. You can also certify by phone at 312-338-4337. Miss your window and the payment for that two-week period stalls until you complete it.
How Much You Get and for How Long
Your weekly benefit amount is calculated from your earnings in the two highest-paying quarters of your base period, run through a wage-bracket table. For benefit years starting on or after January 1, 2025, the weekly minimum is $31 and the maximum is $605. The cap is set at 47 percent of the statewide average weekly wage, rounded up to the next whole dollar.7Illinois Department of Employment Security. Weekly Benefit Amount Tables – 2025 If you support dependents, a dependent allowance can add to the weekly payment.
Regular benefits last up to 26 weeks within a one-year benefit period.1Illinois Department of Employment Security. Unemployment Insurance Information The exact number of weeks depends on your total base-period wages compared to your weekly benefit amount, so not everyone qualifies for the full 26.
Working Part-Time While You Collect
Part-time earnings do not automatically kill your claim. If your gross weekly earnings are less than your weekly benefit amount, you can still collect something. Earn less than half your weekly benefit, and you keep the full check. Earn more than half but less than the full weekly benefit, and IDES deducts only the portion of your earnings above the 50 percent threshold.8Illinois Department of Employment Security. Partial Benefits (Working Part Time)
An example: if your weekly benefit is $400 and you earn $150 in a week, that $150 is under half of $400, so you collect the full $400. If you earn $250, the $50 above the $200 half-mark comes off, and your check is $350. Report every dollar during certification. Unreported income becomes an overpayment IDES will chase.
What Can Reduce or Block Your Check
Severance pay does not disqualify you in Illinois. Under state administrative rules, lump-sum or periodic payments for past services or for lost pension and seniority rights are severance, not wages, for weeks after your separation.9Legal Information Institute. Illinois Admin Code Title 56 Section 2920.45 – Severance Pay You can collect a severance package and file for unemployment at the same time.
Social Security retirement is different. The Social Security Administration will not cut your retirement check because you collect unemployment, but IDES may reduce your unemployment payment based on the Social Security income you receive.10Social Security Administration. Will Unemployment Benefits Affect My Social Security Benefits? If both apply to you, call IDES Claimant Services for the specifics.
Disqualification for Misconduct
The misconduct standard is narrower than most people think. Under Section 602 of the Unemployment Insurance Act, misconduct means a deliberate and willful violation of a reasonable employer rule about job performance, and the violation either has to harm the employer or other employees or be repeated after a warning. The statute also lists categories that automatically count as misconduct:11Illinois General Assembly. 820 ILCS 405/602 – Discharge for Misconduct
- Lying on your job application or hiring paperwork.
- Letting a required professional license or certification lapse when the employer reasonably requires it, unless the lapse was beyond your control.
- Knowingly violating a written attendance policy after a written warning, unless you made a reasonable effort to address the problem or it was out of your control.
- Damaging the employer’s property through recklessly careless conduct.
- Refusing to obey a lawful and reasonable instruction.
Disqualification is not permanent. To collect again on the same claim, you have to become reemployed and earn at least your weekly benefit amount in each of four separate calendar weeks. If your former employer reinstates you, the requirement is satisfied as of the reinstatement date.11Illinois General Assembly. 820 ILCS 405/602 – Discharge for Misconduct
Taxes on Your Benefits
Unemployment benefits are taxable at the federal level. Every dollar counts as ordinary income on your federal return.12Internal Revenue Service. Unemployment Compensation By January 31 of the following year, IDES sends you Form 1099-G with the total paid and any taxes withheld, and you report the Box 1 amount on Schedule 1 of Form 1040.
You can ask IDES to withhold a flat 10 percent from each payment for federal income taxes. That is the only withholding rate offered.13Employment and Training Administration. Withholding Tax Information on UI Benefit Payments If 10 percent will not cover your actual liability, make estimated quarterly payments to the IRS. Illinois also taxes unemployment benefits as state income, so plan for that too.
If IDES Denies Your Claim
When IDES rules you ineligible, it mails a letter explaining why. You have 30 days from the mailing date to file a written appeal or a Request for Reconsideration.14Illinois Department of Employment Security. Appeals The 30-day window is firm. Miss it and you lose the right to challenge the decision. Employers contesting a claim work under the same deadline.
The first appeal goes to a Referee, an attorney serving as an administrative law judge. The Referee holds a hearing where you and the employer can present testimony, witnesses, and documents, then issues a written decision.
If the Referee rules against you, the next step is the Board of Review. You have 30 days from the date of the Referee’s decision to file, and the Board usually reviews the existing record without holding a new hearing. A loss at the Board can be taken to the county Circuit Court within 35 days.14Illinois Department of Employment Security. Appeals You are allowed to have a lawyer at every stage, and it is worth considering from the Referee hearing on.
Overpayments and Fraud
If IDES pays you more than you were owed, it will come back for the money. The agency can deduct from future benefit payments, intercept state and federal tax refunds, and pursue legal action.
Non-fraud overpayments can sometimes be waived. If IDES made a mistake, or your employer supplied wrong information, and you were not at fault, you may qualify. Federal guidelines allow states to waive non-fraud overpayments when the claimant was not at fault and recovery would be against equity and good conscience.15Employment and Training Administration. Unemployment Insurance Overpayment Waivers
Fraud is a different matter. Deliberately misrepresenting your earnings, employment status, or other facts can lead to criminal prosecution, jail or prison time, full repayment plus penalties and fines, forfeiture of future tax refunds, and permanent loss of eligibility for future unemployment benefits.16Illinois Department of Employment Security.
