To meet Illinois vehicle title requirements, you have 20 days from taking delivery to file Form VSD 190 with the Illinois Secretary of State, submit the signed-over title from the previous owner (plus a bill of sale for private purchases), pay the $165 title fee, and pay Illinois use tax on the transaction. The same rules apply whether you bought from a private seller, bought from an out-of-state dealer, received the vehicle as a gift, or moved to Illinois with a car titled somewhere else.
The 20-Day Deadline
Illinois gives you 20 days from the date you take delivery to submit your title application. The deadline sits in 625 ILCS 5/3-112 for private party transfers and 625 ILCS 5/3-113 for dealer transactions, and the same 20-day window applies when you move into Illinois with an out-of-state title.1Justia Law. Illinois Code 625 ILCS 5 – Article I Certificates of Title2ILSOS.gov. Apply for Registration and Title
Missing the window can trigger late filing penalties and may prompt the state to demand extra documentation to verify when the transaction actually happened. For mailed applications, the postmark counts as your filing date, so a packet dropped in the mail on day 19 still meets the deadline.
Documents You Need
The core form is the Application for Vehicle Transaction (Form VSD 190). Under 625 ILCS 5/3-104, it asks for the vehicle’s make, model year, VIN, body type, and current odometer reading.1Justia Law. Illinois Code 625 ILCS 5 – Article I Certificates of Title You can pre-fill it through the Secretary of State’s Electronic Registration and Title (ERT) system, which checks your entries against state records before submission.3Illinois.gov. Along with the form, gather:
- The previous owner’s original title, with the assignment section completed and signed over to you.
- A bill of sale showing purchase price and date, if you bought from a private party.
- A signed odometer disclosure statement, unless your vehicle qualifies for an exemption (covered below).4ILSOS.gov. Title and Registration Checklist
- The lienholder’s exact legal name and address, if you’re financing. Confirm the wording with the lender directly. A misspelled or wrong name is a common rejection reason.
- The foreign title or certified ownership documents from the prior state, if the vehicle is coming from out of state.1Justia Law. Illinois Code 625 ILCS 5 – Article I Certificates of Title
Title Fee and Dealer Doc Fee
The certificate of title itself costs $165 under 625 ILCS 5/3-821.5Illinois General Assembly. Illinois Code 625 ILCS 5/3-821 – Miscellaneous Registration and Title Fees That fee covers the title document only; registration and license plates cost extra. In-person offices accept checks, money orders, and credit cards; mailed applications generally require a check or money order.
If you bought from an Illinois dealer, expect a separate documentary fee on the bill of sale. Illinois caps the dealer doc fee at a 2020 base of $300, indexed annually to the Consumer Price Index. For 2026, the cap is roughly $378.6Illinois General Assembly. Illinois Code 815 ILCS 375/11.1 Dealers must disclose that this charge is not a government fee and is not required by law. It’s the dealer’s paperwork fee, not part of the state’s title cost.
Use Tax on the Vehicle
Illinois uses two different forms depending on where the vehicle came from. Vehicles purchased from a registered Illinois dealer don’t require either one, because the dealer collects and remits the sales tax at the time of sale.
Private Party Purchases: Form RUT-50
Buying from another individual means filing Form RUT-50 with your title application. When the purchase price or fair market value is under $15,000, the tax is a flat amount tied to the vehicle’s age rather than a percentage of the price.7Illinois Department of Revenue. RUT-50 Instructions for Private Party Vehicle Use Tax Transaction The 2026 schedule runs from $465 for a vehicle one year old or newer down to $100 for a vehicle 11 years old or older.8Illinois Department of Revenue. RUT-5 Private Party Vehicle Use Tax Chart for 2026
Once the price or fair market value reaches $15,000, a separate table applies based on the dollar amount, from $850 in the $15,000–$19,999 range up to $10,100 for vehicles valued at $1 million or more. Motorcycles and ATVs are taxed at a flat $25 regardless of value.7Illinois Department of Revenue. RUT-50 Instructions for Private Party Vehicle Use Tax Transaction
Out-of-State Dealer Purchases: Form RUT-25
If the seller was an unregistered out-of-state dealer, a lending institution, or a leasing company, you file Form RUT-25 instead. The calculation uses the actual purchase price or fair market value.7Illinois Department of Revenue. RUT-50 Instructions for Private Party Vehicle Use Tax Transaction
Gifts
A gifted vehicle still triggers Illinois use tax. Form RUT-50 applies, and because there’s no stated purchase price, tax is based on the vehicle’s fair market value, which a licensed dealer can determine for you.7Illinois Department of Revenue. RUT-50 Instructions for Private Party Vehicle Use Tax Transaction The same age-based and value-based tables apply; there’s no special gift exemption at the state level. On the federal side, the giver (not the recipient) should watch the annual gift tax exclusion, which is $19,000 per recipient for 2026.9Internal Revenue Service. Whats New – Estate and Gift Tax
Odometer Disclosure
Most transfers require the seller to certify the odometer reading and mark whether it reflects actual mileage, exceeds the odometer’s mechanical limit, or is inaccurate. The buyer signs acknowledging that disclosure. This comes from 625 ILCS 5/3-112.1 and mirrors federal odometer fraud rules.10Illinois General Assembly. Illinois Code 625 ILCS 5/3-112.1
Illinois exempts several categories from disclosure:
- Model year 2010 or older vehicles, exempt until January 1, 2031. After that date, any vehicle 20 years old or older qualifies.
- Vehicles with a gross vehicle weight rating over 16,000 pounds.
- Motorcycles, mopeds, and motor-driven cycles.
- Antique and expanded-use antique vehicles.
- Non-self-propelled vehicles and vehicles without odometers.
Federal rules under 49 CFR Part 580 set similar thresholds; for model year 2011 or later vehicles, the federal exemption kicks in 20 years after the model year.11eCFR. 49 CFR Part 580 – Odometer Disclosure Requirements Odometer tampering is a federal felony under 49 U.S.C. § 32709, carrying up to three years in prison and fines up to $250,000 per violation.12U.S. Department of Justice. Submitting the Application
You have two paths. Walking into a Secretary of State Driver Services facility lets a clerk check your packet on the spot, which is faster because errors get caught immediately rather than bouncing back weeks later. Mailing works too, and the postmark determines your filing date for the 20-day deadline.
Once the Secretary of State has a complete application, processing takes about three to four weeks.13ILSOS.gov. Frequently Asked Questions The finished title is mailed to you, or to your lienholder if the vehicle is financed. Keep copies of everything you submitted in case something goes wrong during processing.
Salvage and Rebuilt Titles
If an insurance company declared the vehicle a total loss, it carries a salvage title and cannot legally be driven on public roads until it’s rebuilt and inspected. Illinois requires any rebuilt vehicle to pass a physical inspection by the Secretary of State’s Special Vehicle Identification Section (SVIS).14Cornell Law Institute. Illinois Admin Code Title 92 Section 1020.80 – Inspection of Rebuilt Vehicles The inspection costs $75 and is refundable only if the request is denied before any physical examination begins. You’ll need a completed title application, a properly assigned Illinois or foreign salvage certificate, and affirmation form RT-11.13 listing all used essential parts by VIN and source, plus invoices for new parts. A rebuilt brand stays on the vehicle’s record permanently and is tracked across state lines through NMVTIS.15Bureau of Justice Assistance. Understanding an NMVTIS Vehicle History Report
Electronic Lien and Title Program
If you’re financing, your lienholder’s interest is recorded electronically rather than printed on a paper title. Illinois’s Electronic Lien and Title (ELT) system keeps the record with the Secretary of State until the loan is paid off; the lender then transmits a satisfaction of lien electronically, and a paper title is printed and mailed to you.16Illinois General Assembly. Illinois Admin Code Section 1010.100 – Electronic Lien and Title Program Provisions Lienholder participation becomes mandatory by July 1, 2026, meaning all lien perfections, assignments, and releases will run through ELT after that date.
Lost or Damaged Titles
If your Illinois title is lost, stolen, or damaged, or contains an error, you can request a duplicate or corrected title for $50 using the same VSD 190 form.17ILSOS.gov. Fees If there’s a lien on the vehicle, the lienholder may need to authorize the request. Processing runs on the same three-to-four-week timeline as new titles.
