Illinois Weed Tax: Excise Tiers, Total Costs, and Revenue Use

Illinois weed tax runs higher than almost anywhere else in the country for recreational buyers. Between a tiered state excise tax of 10%, 20%, or 25%, the 6.25% state sales tax, and local cannabis taxes that can add another 6% or more, a single dispensary purchase in the Chicago area can carry a combined rate approaching 40%. Registered medical patients pay just 1%.1Illinois Department of Revenue. Municipal and County Cannabis Retailers’ Occupation Tax Rate Changes, Effective January 1, 2026

The Three Excise Tax Tiers

The biggest tax on any recreational purchase is the Cannabis Purchaser Excise Tax, set by the Cannabis Regulation and Tax Act. The rate depends on product type and THC concentration:

  • 10% on cannabis flower and pre-rolls with a THC concentration at or below 35%
  • 25% on any non-infused cannabis product with a THC concentration above 35%, which includes most vape cartridges and concentrates
  • 20% on all cannabis-infused products, such as edibles, beverages, and tinctures, regardless of THC level

The distinction trips people up. A vape cartridge testing at 80% THC gets the 25% rate because it exceeds the 35% threshold, even though many buyers think of cartridges as closer to edibles. A low-dose gummy with 5mg of THC still falls under the 20% infused-product rate, because the tax turns on product category, not total milligrams.2Illinois General Assembly. Dispensaries calculate excise tax on the purchase price before state and local sales taxes are applied. The excise tax stacks on top of everything else rather than overlapping with it.2Illinois General Assembly. Illinois Code 410 ILCS 705/65-10 – Tax Imposed

State and Local Sales Taxes

Recreational cannabis is treated like general merchandise for state sales tax purposes, so the standard 6.25% Illinois Retailers’ Occupation Tax applies to every adult-use sale.3Illinois Department of Revenue. What Are the Retailers’ Occupation and Use Tax Rates in Illinois?

Local governments add their own cannabis-specific taxes on top. Municipalities may impose a cannabis retailers’ occupation tax of up to 3% of gross receipts.4Illinois Department of Revenue. Cannabis Tax Frequently Asked Questions Counties can charge up to 3.75% for dispensaries in unincorporated areas or up to 3% for dispensaries inside a municipality.5Illinois Department of Revenue. County Cannabis Retailers’ Occupation Tax (CCAN)

Each local government sets its own rate by ordinance in quarter-percent increments, which is why two dispensaries a short drive apart can total out differently on the same product. Chicago charges the full 3% municipal cannabis tax, and Cook County adds another 3% for dispensaries inside city limits, producing one of the heaviest local burdens in the state.

What a Recreational Purchase Actually Costs

The layers add up quickly. A $50 purchase of cannabis flower at or below 35% THC in Chicago breaks down this way:

  • Excise tax (10%): $5.00
  • State sales tax (6.25%): $3.13
  • Cook County cannabis tax (3%): $1.50
  • Chicago municipal cannabis tax (3%): $1.50
  • Total taxes: $11.13
  • Effective combined rate: roughly 22.25%

Switch that same $50 to a high-potency concentrate taxed at the 25% excise rate, and the total taxes jump to about $18.63, an effective rate above 37%. Product type and dispensary location both move the number at checkout.

How Much Medical Patients Pay

Registered medical cannabis patients pay dramatically less. Purchases made under the Compassionate Use of Medical Cannabis Program Act are exempt from the tiered excise tax and from all local cannabis-specific retailers’ occupation taxes.1Illinois Department of Revenue. Medical cannabis is classified alongside prescription drugs and medical appliances under the Retailers’ Occupation Tax Act, which carries a rate of just 1%.6Illinois General Assembly. Illinois Code 35 ILCS 120/2-10 – Rate of Tax On that same $50 purchase, a medical patient pays $0.50 in state tax instead of $11 or more. Regular patients save hundreds to thousands of dollars per year compared to buying recreationally.

One boundary to know: Illinois does not honor out-of-state medical cannabis cards. A card from another state gets you treated as a recreational buyer, with the full excise, state, and local rates. Only patients registered through Illinois’s own program and verified against the state patient registry qualify for the 1% rate.

The Cultivation Tax Built Into Shelf Prices

Before cannabis reaches a dispensary, cultivators pay a 7% tax on gross receipts from their first sale to a dispensing organization.7Illinois Department of Revenue. Cannabis Taxes This applies only to adult-use cannabis, not medical, and cultivators remit it directly; dispensaries aren’t responsible for it.8FindLaw. Illinois Code 410 ILCS 705/20-50

You never see this tax on a receipt, but it’s baked into the wholesale price the dispensary pays, which shapes the retail price on the menu. It’s one reason Illinois dispensary prices tend to run higher than in states without a separate wholesale-level cannabis tax.
