Indiana Fireworks Permits: Types, Fees, and Penalties

Indiana does not require a permit to use consumer fireworks on your own property, but you do need a state permit for a public fireworks display and either a fireworks stand permit or a certificate of compliance to sell fireworks at retail. All three permits come from the Indiana State Fire Marshal through the Indiana Department of Homeland Security. Anyone handling professional-grade display fireworks also needs a federal license from the Bureau of Alcohol, Tobacco, Firearms and Explosives on top of the state permit.

Using Fireworks at Home: No Permit Required

If you just want to set off consumer fireworks in your yard, there is no application to file and no fee to pay. Indiana law lets you use consumer fireworks on your own property, on someone else’s property with their permission, or at a designated special discharge location. Using them anywhere else is a Class C infraction on a first offense, and a repeat within five years becomes a Class C misdemeanor.¹

You have to be 18 to buy consumer fireworks in Indiana.² Anyone younger than that can possess or use them only when a responsible adult is physically present. An unsupervised minor faces a Class C infraction, and a second offense within five years becomes a delinquent act.¹

Legal Hours

Consumer fireworks are allowed between 9 a.m. and 11 p.m. on most days. On state-recognized holidays and December 31 the cutoff extends to midnight. Using fireworks outside those hours is a Class C infraction, escalating to a Class C misdemeanor on a repeat within five years.¹

Protected Windows Local Governments Cannot Override

Cities and counties can pass stricter local rules, but state law carves out specific windows when local governments cannot prohibit consumer fireworks at all:³

June 29 through July 3 and July 5 through July 9, from 5 p.m. to two hours after sunset
July 4, from 10 a.m. to midnight
December 31 at 10 a.m. through 1 a.m. on January 1

Outside those windows your city or town may impose tighter cutoffs or limit the calendar dates. Check the local ordinance before assuming state law is the whole picture.

Public Display Permit

Any organized fireworks show using professional-grade 1.3G fireworks requires a public display permit from the Indiana State Fire Marshal, no matter who is hosting. Municipalities, fair associations, amusement parks, and private events are all treated the same way. Even a private backyard party counts as a public display if it uses 1.3G fireworks. Skip the permit and you are limited to consumer-grade 1.4G product only.³

How to Apply

Applications go through the IDHS Services Gateway and must be received at least five business days before the display. Each display date requires its own permit. The application must name a competent operator, include a written resume of that operator’s fireworks display experience, and describe the location, contact information, and event dates and times.⁴

Contact the local fire department before filing to arrange site approval and confirm the fire chief’s correct email. IDHS emails the processed permit directly to the local fire chief. The permit authorizes possession and transportation of the fireworks, but it does not take effect until the local fire chief approves the operator and inspects the site.³

Permits are not transferable. An operator with a prior conviction under the fireworks chapter is barred from operating any display for one year after that conviction.⁴

Fee and Insurance

The permit fee is $69.³ The hosting municipality also requires a certificate of insurance covering at least $10,000 for personal injury and $10,000 for property damage. The municipality can raise the required coverage to $100,000 for each. Failing to carry the required insurance is a Class A misdemeanor.

Many municipalities and venue owners require liability coverage well above the statutory minimums as a condition of approving the site, so the actual insurance cost varies significantly by location.

Retail Sales Permits

Indiana treats temporary fireworks stands and permanent stores differently, and each has its own licensing path.

Temporary Fireworks Stand Permit

A retailer selling low-risk novelty items (sparklers, fountains, smoke devices, ground spinners, and similar products) from one or more temporary stands needs a fireworks stand retail sales permit from the State Fire Marshal. File the application before June 1 each year and include your retail merchant certificate number and the address of every stand. The Fire Marshal has seven days after receiving the application to issue or deny it.⁵

The permit expires one year after issuance and must be posted at the stand where the public can see it. Every stand must also display a certificate of compliance with a descriptive list of approved fireworks. Salespeople must be at least 16. Selling from a motor vehicle is prohibited, and the more powerful consumer fireworks category may not be sold from or stored at a temporary stand at all.⁵

Certificate of Compliance for Permanent Locations

Retailers selling consumer fireworks from a permanent location need a certificate of compliance from the State Fire Marshal, renewed every year. The fee is $1,000 for the first location, $500 for each additional tent location, and $200 for each additional location in a permanent structure.³ The math adds up quickly for a chain running multiple sites in the summer season.

Federal ATF Licensing Sits on Top

State permits are only half of the picture for professional fireworks. Anyone importing, manufacturing, dealing in, or transporting professional display fireworks also needs a federal explosives license or permit from the Bureau of Alcohol, Tobacco, Firearms and Explosives.⁶ Display fireworks are classified by the Department of Transportation as UN0333, UN0334, or UN0335 and include the aerial shells, cakes, and candles used in professional shows.

Federal law under 18 U.S.C. § 842 makes it illegal to engage in the business of importing, manufacturing, or dealing in explosive materials without the proper ATF license.⁷ The ATF runs background checks on all responsible persons and employees who handle explosive materials.

Display fireworks must be kept in locked magazines that meet the standards in 27 CFR Part 555, Subpart K. The ATF recognizes several magazine types depending on materials, permanence, and portability. Temporary storage in locked, attended vehicles at the display site is permitted under specific conditions.⁸ You cannot keep shells in your garage between shows.

Consumer Fireworks Are Exempt From ATF Licensing

Consumer fireworks that comply with Consumer Product Safety Commission standards and are classified by DOT as UN0336 or UN0337 are exempt from federal explosives licensing and recordkeeping. The exemption holds as long as the devices stay within flash powder limits: 50 milligrams for ground devices and 130 milligrams for aerial devices.⁹ That exemption is why retail tents and stores can sell consumer fireworks without holding an ATF license.

What Happens If You Skip a Required Permit

Operating a public display without a permit violates the fireworks chapter. The statute forbids possessing, transporting, or delivering special fireworks except as authorized by a valid public display permit.⁴ Missing the required insurance for a display is separately charged as a Class A misdemeanor.

Most first-time consumer use violations (wrong location, wrong hours, retailer rule breaks) are Class C infractions. A repeat within five years escalates to a Class C or Class A misdemeanor. If your fireworks cause property damage, the charge jumps directly to a Class A misdemeanor on the first offense, carrying up to one year in jail and a fine of up to $5,000.¹

The consequences get much steeper when someone is hurt. Consumer fireworks use that causes serious bodily injury is a Level 6 felony (six months to two and a half years). Use that causes a death is a Level 5 felony (one to six years).¹
