Indiana Habitual Traffic Offender: Suspension, Privileges, Reinstatement

In Indiana, a habitual traffic offender is a driver the Bureau of Motor Vehicles has flagged under Indiana Code 9-30-10 for accumulating a set number of qualifying judgments within a ten-year window, which triggers an automatic license suspension of five years, ten years, or life. The designation happens by operation of law once your record hits the threshold, and the consequences of driving during the suspension are severe enough that understanding the categories and your options for relief is worth doing carefully.

What Puts You in Habitual Violator Status

Indiana Code 9-30-10-4 sets out three separate paths into the designation. Each looks at judgments accumulated within a rolling ten-year window, and the clock runs from the date of each offense, not the date of conviction.1Indiana General Assembly. Indiana Code 9-30-10-4 – Habitual Violators Multiple violations arising out of the same incident count as one.

Category A: Two Judgments for the Most Serious Offenses

Two or more judgments for offenses that caused or risked death will trigger Category A. Qualifying offenses include reckless homicide involving a motor vehicle, voluntary or involuntary manslaughter from a vehicle, leaving the scene of an accident that resulted in death or injury, and operating while intoxicated or over the legal blood-alcohol limit when someone dies.1Indiana General Assembly. Indiana Code 9-30-10-4 – Habitual Violators Every offense in this category involves a fatality or serious bodily harm.

Category B: Three Judgments for Serious Driving Crimes

Three or more judgments for serious driving offenses that don’t necessarily involve injury will land you in Category B. These include operating while intoxicated, reckless driving, and driving on a suspended or revoked license, among others.1Indiana General Assembly. Indiana Code 9-30-10-4 – Habitual Violators The three can be any combination and don’t need to be the same offense repeated.

Category C: Ten Traffic Judgments With at Least One Serious Offense

Category C catches drivers with ten traffic judgments in ten years, as long as at least one of those ten is an offense listed in Category A or Category B, or is driving without ever having obtained a license. The other nine can be ordinary moving violations. Parking and equipment violations don’t count.1Indiana General Assembly. Indiana Code 9-30-10-4 – Habitual Violators

How Long the Suspension Lasts

Once the BMV determines you meet a threshold, it mails a notice. Thirty days after that notice goes out, the suspension takes effect. Length depends on the category:2Indiana General Assembly. Indiana Code Title 9 Motor Vehicles 9-30-10-5

  • Category A, general: ten years.
  • Category A when at least two of the qualifying offenses involve operating while intoxicated or driving over the legal blood-alcohol limit and causing a death: life.
  • Category B: ten years.
  • Category C: five years.

These periods are mandatory. The BMV cannot shorten them, and there is no good-behavior credit built into the statute.

Driving Anyway Is a Felony

Knowingly driving after receiving a habitual violator suspension is a Level 6 felony. The same charge applies if you violate the restrictions on any specialized driving privileges a court has granted you.3Indiana General Assembly. Indiana Code 9-30-10-16 – Operating a Motor Vehicle While Privileges Are Suspended Level 6 Felony A Level 6 felony carries six months to two and a half years in prison, with an advisory sentence of one year, plus a possible fine of up to $10,000.4Indiana General Assembly. Indiana Code 35-50-2-7 – Class D Felony Level 6 Felony

Beyond the criminal exposure, a conviction for driving during a habitual violator suspension can result in a lifetime forfeiture of your driving privileges. Indiana’s rescission statute specifically contemplates people serving lifetime suspensions imposed for driving while designated a habitual violator, which confirms this consequence exists in practice.5Indiana General Assembly. Specialized Driving Privileges: The Main Relief Path

Indiana does not leave habitual violators completely without options. A court can grant specialized driving privileges that let you drive for specific purposes such as work, school, or medical appointments while the suspension continues to run. Not everyone qualifies. The statute bars these petitioners:6Indiana General Assembly. Indiana Code 9-30-16-1 – Applicability Suspension of Driving Privileges

  • Someone who has never been an Indiana resident.
  • Drivers whose suspension stems from refusing a breathalyzer or blood test, with a narrow exception in certain implied-consent cases.
  • Drivers suspended under specific statutes tied to school-zone violations or railroad-crossing offenses.

Filing the Petition

File in the court that ordered or imposed the suspension. If multiple courts in different counties suspended your license, you file a separate petition in each. For administrative suspensions imposed directly by the BMV, file in the county where you live.7Indiana General Assembly. Indiana Code Title 9 Motor Vehicles 9-30-16-3

Each petition must include your age, date of birth, and address, along with the specific grounds for relief and the privileges you’re requesting. It must be verified, meaning signed under oath. Attach a current certified copy of your Indiana BMV driving record. You also need proof of financial responsibility, commonly called SR-22 insurance, which is a policy that notifies the BMV if your coverage lapses.7Indiana General Assembly. Indiana Code Title 9 Motor Vehicles 9-30-16-3

Be specific. List the exact hours, days, and routes you need to drive, along with the purpose of each trip. A vague request for general driving privileges won’t get far. Judges want to see that you have thought through exactly what you need and nothing more.

After filing, serve copies on the prosecuting attorney in the county where you filed and on the Indiana BMV Commissioner.7Indiana General Assembly. Indiana Code Title 9 Motor Vehicles 9-30-16-3 Service can go by mail, electronic transmission, or hand delivery. Missing this step gives the court grounds to deny or dismiss the petition outright.

The Hearing and Any Conditions

The court schedules a hearing where the judge reviews your driving history, the nature of your violations, and your stated need to drive. The prosecutor can object, and often does when the record shows repeated dangerous behavior. Expect the court to weigh public safety against your need.

If the judge grants the petition, the order stays your habitual violator suspension for the approved privileges only and spells out exactly when, where, and why you can drive. Judges have broad discretion to attach conditions. Common ones include installation of an ignition interlock device, geographic restrictions, and time-of-day limits. Indiana leaves interlock requirements to judicial discretion rather than imposing a statewide mandate. Violating any condition puts you back into felony territory under IC 9-30-10-16.3Indiana General Assembly. Rescinding a Lifetime Suspension

A lifetime suspension is not necessarily permanent. Indiana law allows a person serving one to petition a court in a civil action to rescind the suspension and reinstate driving privileges, but the waiting periods and requirements are steep.5Indiana General Assembly. Indiana Code 9-30-10-14.1 – Petition for Rescission of Lifetime Suspension of Driving Privileges Contents Service

The general rule is ten years from the date of the lifetime suspension order, and the petitioner must have no Category A convictions. A shorter three-year waiting period applies in one situation: when the lifetime suspension resulted from a conviction for driving while already suspended as a habitual violator, and you have no Category A or Category B convictions other than that driving-while-suspended offense.5Indiana General Assembly. Indiana Code 9-30-10-14.1 – Petition for Rescission of Lifetime Suspension of Driving Privileges Contents Service

At the hearing you carry the burden of proving, by a preponderance of the evidence, that you have complied with the suspension terms throughout the waiting period, have no traffic or felony convictions during that time, and have no pending criminal charges.

Reinstatement After the Suspension Ends

Once your five-year or ten-year suspension runs its course, your license does not come back on its own. You go through the BMV’s reinstatement process, which requires proof of financial responsibility (SR-22 insurance) and a reinstatement fee. The SR-22 requirement generally runs 180 consecutive days for insurance-related suspensions, though the BMV may require a longer period depending on the circumstances.8Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility If the BMV is notified that your SR-22 has been cancelled during the required period, your license goes right back into suspension.

Reinstatement fees vary, and you may owe additional amounts for outstanding civil penalties or other suspensions stacked on top of the habitual violator designation. Before paying anything, pull a current copy of your driving record from the BMV and confirm what suspensions remain active and what each requires for clearance. Overlapping suspensions from separate incidents, each with its own reinstatement conditions, are a common surprise.
