What the Three-Way Actually Covers

A three-way permit bundles a beer retailer’s permit, a wine retailer’s permit, and a liquor retailer’s permit into one authorization for on-premises consumption.1Indiana General Assembly. If your menu includes cocktails, bourbon, or any distilled spirit, the three-way is the only option.

Sales must happen within the physical boundaries described on your application. State excise officers inspect the premises to confirm the actual layout matches what the Alcohol and Tobacco Commission (ATC) approved.

The Quota Is the First Real Hurdle

Indiana limits three-way permits by population. The cap is one three-way, one two-way, and one one-way permit for every 1,500 residents of an incorporated city, town, or unincorporated area.3Indiana General Assembly. Buying a Permit on the Secondary Market

Because new permits are scarce, most people entering the business buy one from a current holder. The ATC publishes transfer sale prices by jurisdiction, and the range is wide. Recent data shows permits in Albion trading for as little as $10,000 and one in Zionsville selling for $1,964,367. Paying the seller does not by itself transfer the license. Every transfer goes through a formal ATC approval process. The current owner has to sign a consent-to-transfer form, all outstanding taxes and pending violations must be resolved, and the buyer has to independently meet every eligibility requirement.4Indiana Alcohol and Tobacco Commission. Who Qualifies

Age and Indiana Residency

You must be at least 21 to hold any alcoholic beverage permit. Individual applicants also have to be continuous, bona fide Indiana residents for at least five years before applying.5Justia. Corporations, limited partnerships, and LLCs face an ownership version of the residency rule. Taxes and Financial Disclosure

The 200-Foot Rule

Location matters. The ATC cannot issue a permit if a wall of your proposed building sits within 200 feet of a wall of a school or church. The measurement runs building wall to building wall, not door to door and not property line to property line. “Wall” means a building wall and does not include fences or other boundary walls.7Justia. Liquor Liability Insurance

Every retailer permit holder must carry liquor liability insurance, or a liquor liability endorsement on a general liability policy, with total coverage of at least $500,000.8Indiana General Assembly. A lapse is serious. The ATC can deny, suspend, revoke, or refuse to renew a permit when coverage is not in place.8Indiana General Assembly. Annual State Fees

The state fee for a standard three-way retailer’s permit (type 209 or 210) is $1,000 per year. A missing document stalls the file. The ATC does not schedule a hearing until the packet is complete.

Posted Notice

Before your hearing, you have to post a sign at the proposed premises stating that a permit application is pending. The sign must be up at least ten days before the local board hearing and visible from the nearest major public road. Local Board Hearing

Every county has a local alcoholic beverage board that hears applications. Community members, local officials, and nearby residents can speak in support or objection. The local board issues a recommendation, not a final decision. Either side can appeal that recommendation to the state ATC within fifteen days.4Indiana Alcohol and Tobacco Commission. Commission Vote and Final Inspection

Once approved, a state excise officer inspects the premises to confirm the layout matches the submitted floor plans. The permit must be displayed prominently in the establishment before any alcohol is served.

Start to finish, this typically runs several months. The timeline depends on how quickly you assemble documents, when the next local board hearing falls, and the commission’s schedule.

Once You Hold the Permit

Hours of Sale

Three-way permit holders can serve alcohol from 7:00 a.m. to 3:00 a.m. the following day, Sunday through Saturday.13Indiana Alcohol and Tobacco Commission. Rules and Laws Those hours apply to on-premises consumption. Retail carryout stores operate under different Sunday hours, but that does not affect three-way holders serving drinks on-site.

Employee Ages

Staff age rules vary by job. A bartender must be 21. Employees at least 19 but under 21 can serve alcoholic beverages in the dining area or family room of a restaurant or hotel if they have completed an ATC-approved server training program and work under appropriate supervision.14IN.gov. Renewal and Violations

Permits must be renewed periodically. After notice and a hearing, the commission can suspend a permit for up to 30 days for violating Indiana’s alcohol code or ATC rules. Suspensions longer than three days require the same formal notice-and-hearing process used for revocations, with at least ten days’ advance notice to the permit holder.15Indiana General Assembly.
