Industrial Disability Leave in California: Eligibility, Pay, and Enhanced IDL

Industrial Disability Leave in California is a salary-continuation benefit for state employees who are temporarily unable to work because of a job-related injury or illness. For the first 22 working days you receive your full net pay. Starting on the 23rd working day, the benefit drops to two-thirds of your gross salary, continuing up to a combined total of 52 weeks within two years from your first day of disability.1California Legislative Information. California Code Government Code 19871 – Industrial Disability Leave That is considerably more generous than the standard workers’ compensation checks most private-sector employees receive, which are capped at $1,764.11 per week in 2026.2Department of Industrial Relations. Who Qualifies

IDL covers California state officers and employees with a work-related temporary disability. There is no minimum service requirement, so a recent hire qualifies if the injury arose out of and in the course of state employment.1California Legislative Information. California Code Government Code 19871 – Industrial Disability Leave California State University employees have a parallel benefit under the Education Code.3Justia. California Education Code 89529-89529.11 – Industrial Disability Leave

Two conditions have to be met. A physician must certify that the disability is temporary and work-related, and the workers’ compensation claim must be accepted by the claims administrator. If the claim is denied, there is no IDL entitlement. The disability must prevent you from performing your job duties, though a later modified-duty assignment can end IDL before you have fully recovered.

How Payments Are Calculated

During the first 22 working days (176 hours for a full-time employee), you receive your full net salary. “Net” means your regular pay minus the withholdings in effect on the date of your injury: federal and state income taxes, Social Security, and Medicare.1California Legislative Information. California Code Government Code 19871 – Industrial Disability Leave Take-home pay stays the same.

Starting on the 23rd working day, the payment drops to two-thirds of your gross salary, continuing up to a combined 52 weeks (2,080 hours for full-time employees, prorated for part-time schedules) within two years of your first day out.4California Department of Human Resources. Supplementing Industrial Disability Leave IDL is also reduced to offset other employer-subsidized disability benefits, but the combined total cannot exceed three-quarters of your full pay.

Income in the two-thirds phase is not subject to state or federal income tax.4California Department of Human Resources. Supplementing Industrial Disability Leave Because that income is tax-free, the real reduction in take-home pay is smaller than a one-third cut sounds.

The 15-Day Supplementation Deadline

If the drop to two-thirds pay creates a hardship, you can supplement IDL with accrued leave credits (sick leave, vacation, or annual leave) to bring your paycheck back up to its normal level. The election has a short, strict deadline that catches people off guard.

Your department must notify you of the supplementation option within 15 days of the workers’ compensation claim being approved. You then have 15 calendar days from that written notification to decide. If you do not respond in time, you are placed on unsupplemented IDL and permanently lose the right to supplement for the rest of the claim.5Legal Information Institute. California Code of Regulations Title 2 Section 599.759 – Supplementation This is the single most consequential deadline in the IDL process. If you are recovering from surgery or otherwise not tracking your mail closely, have someone watch for the notice (the STD 618S form).

Enhanced IDL

Some state employees qualify for Enhanced Industrial Disability Leave, which removes the drop to two-thirds pay. Under EIDL, after the first 22 days you keep receiving full net pay for the remainder of your eligibility.6CalHR. 1412 – Industrial Disability Leave – Human Resources Manual

Eligibility depends on your bargaining unit’s memorandum of understanding with the state, and the benefit applies only to physical injuries sustained in the official performance of duties. Stress-related disabilities, presumptive conditions, and physical disabilities of mental origin do not qualify.6CalHR. 1412 – Industrial Disability Leave – Human Resources Manual Excluded (non-represented) employees who supervise workers in EIDL-eligible units can also qualify, provided the injury meets the criteria in the relevant MOU.7Legal Information Institute. California Code of Regulations Title 2 Section 599.769 – Enhanced Industrial Disability Leave Check your collective bargaining agreement or ask your personnel office whether your unit has negotiated EIDL. If you are eligible, the enhancement kicks in automatically on the 23rd working day.

Benefits and Retirement While on Leave

Government Code section 19871.1 provides that a state employee receiving IDL “shall continue to receive all employee benefits which he or she would have received had he or she not incurred disability.”8California Legislative Information. California Code Government Code 19871.1 That covers health insurance, dental coverage, and other employer-provided benefits.

Retirement contributions continue based on your full pay, not the reduced two-thirds amount. Both your employee contribution and the state’s employer contribution to CalPERS or CalSTRS are calculated as if you were still earning full salary.9Justia. California Government Code Article 4 – Industrial Disability Leave Voluntary deductions continue unless you cancel them. One wrinkle: because IDL income after the first 22 days is not taxable, any deductions previously taken on a pre-tax basis revert to post-tax during the two-thirds phase.6CalHR. 1412 – Industrial Disability Leave – Human Resources Manual

How IDL Differs From Standard Workers’ Comp Temporary Disability

IDL replaces standard temporary disability payments for eligible state employees; you cannot collect both at the same time. Workers’ compensation TD pays two-thirds of your average weekly wage, subject to a statutory cap of $1,764.11 per week in 2026.2Department of Industrial Relations. DWC Announces Temporary Total Disability Rates for 2026 IDL has no weekly cap and starts with full net pay for 22 days, so for most state employees earning above the TD cap, IDL pays substantially more.

The California Supreme Court confirmed in 2025 that IDL is a Government Code benefit layered on top of the workers’ compensation system rather than part of it. In a case involving a correctional officer named Ayala, the court held that IDL payments are not “compensation” under Labor Code section 3207, so a serious-and-willful misconduct penalty under Labor Code section 4553 is calculated against the lower TD rate rather than the higher IDL amount actually paid.10Justia. Dept. of Corrections and Rehabilitation v. Workers Comp. Appeals Bd.

Local Safety Officers Have a Different Benefit

IDL does not apply to local government safety employees. City, county, and district police officers, firefighters, and certain other safety officers have a separate salary-continuation benefit under Labor Code section 4850, which provides full salary for up to one year of disability and explicitly does not count against FMLA or CFRA entitlement.11California Legislative Information. California Labor Code Section 4850 IDL has no equivalent statutory carve-out, so state employees should ask their personnel office how FMLA and CFRA leave interact with their IDL absence.

Filing a Claim

Report the injury to your supervisor as soon as possible, then complete and submit a Workers’ Compensation Claim Form (DWC-1). That form triggers your employer’s obligation to investigate and respond to the claim.12Department of Industrial Relations. Workers Compensation Claim Form DWC 1 and Notice of Potential Eligibility Your physician must provide medical documentation showing the injury is work-related and that you are temporarily disabled from performing your duties.

Your department’s personnel office coordinates with the claims administrator to verify the disability period. Once the claim is accepted, the personnel office should send you the supplementation election form (STD 618S) within 15 days, starting the 15-day clock discussed above.5Legal Information Institute. California Code of Regulations Title 2 Section 599.759 – Supplementation You also have to cooperate with medical examinations requested by the claims administrator, including evaluations by a Qualified Medical Examiner or Agreed Medical Examiner. Refusing or failing to attend can suspend your IDL payments.

How IDL Ends

IDL stops under any of these circumstances:

  • You hit the 52-week cap. Once you have used 2,080 hours (or the prorated equivalent) within two years, the benefit is exhausted.1California Legislative Information. California Code Government Code 19871 – Industrial Disability Leave
  • Your doctor declares maximum medical improvement. Once you have recovered as much as you are going to, the temporary disability period ends regardless of how many weeks are left.
  • You are cleared for work. If your physician releases you to your regular duties or a modified-duty assignment, IDL payments stop.

If you exhaust the 52 weeks but remain temporarily disabled, you transition to standard workers’ compensation temporary disability payments. That means a significant pay cut, from two-thirds of your actual gross salary (or full net pay on EIDL) down to the TD rate, which is capped at $1,764.11 per week in 2026.2Department of Industrial Relations. DWC Announces Temporary Total Disability Rates for 2026 Planning for that possibility early is worth the effort if your recovery timeline is uncertain.
