The Iowa drug tax stamp is an excise tax the state charges on possession of controlled substances above set threshold amounts, paid by buying physical stamps from the Iowa Department of Revenue and attaching them to the package holding the substance. If you hit the threshold and do not have the stamps, you owe the tax plus a 100% penalty, and you can be charged with a Class D felony separate from any underlying drug charge.
When the Tax Applies
The obligation is triggered the moment you possess, manufacture, or bring into Iowa a controlled substance in a taxable quantity. There is no grace period. Below the thresholds, the tax does not apply at all.1Justia. Iowa Code 453B.3 – Tax Payment Required for Possession – Payment Due

- 42.5 grams or more of processed marijuana
- One or more unprocessed marijuana plants
- Seven grams or more of any other controlled substance sold by weight, including mixtures that contain marijuana together with another substance
- Ten or more dosage units of a controlled substance not sold by weight
Counterfeit and simulated controlled substances count as taxable substances too, and any mixture containing a controlled substance qualifies regardless of the proportion.2Justia. Iowa Code 453B.1 – Definitions
People who lawfully possess a controlled substance are outside the definition of “dealer” and owe nothing. That covers licensed pharmacists, researchers with DEA authorization, and patients holding valid prescriptions.
How Much You Owe

- Processed marijuana: $5 per gram or fraction of a gram
- Other controlled substances sold by weight: $250 per gram or fraction of a gram
- Unprocessed marijuana plants: $750 per plant
- Controlled substances not sold by weight: $400 per ten dosage units or any portion of ten
Partial units round up. Possess 7.1 grams of a non-marijuana substance and you owe tax on eight grams, so that extra tenth of a gram costs another $250. Eleven dosage units are taxed as twenty. At the seven-gram threshold for a non-marijuana substance, the tax runs $1,750. At the 42.5-gram threshold for processed marijuana, it comes to $215.
Buying and Attaching the Stamps
Stamps are ordered from the Iowa Department of Revenue using Form 70-510, the Drug Tax Stamp Order Form. Once you have the physical stamps, they have to be permanently affixed to the package or container holding the substance, in a visible location, so they cannot easily be pulled off and moved to something else. Each stamp is good for one use and cannot be reused after its expiration date.1Justia. Iowa Code 453B.3 – Tax Payment Required for Possession – Payment Due
Having stamps does not legalize anything. A valid stamp settles the tax obligation and does nothing else. Law enforcement can still charge you with drug crimes based on evidence gathered through normal investigation.
Penalties for Possessing Without Stamps
Getting caught with a taxable quantity and no stamps creates two problems on top of any underlying drug charge.
Civil Tax and 100% Penalty
The state assesses the full unpaid tax plus a penalty equal to 100% of that tax. Owing $1,750 in tax on seven grams of a non-marijuana substance becomes $3,500 with the penalty. Interest then accrues from the date of assessment until payment, and any partial month counts as a full month.6Justia. Class D Felony
Possessing a taxable substance without the required stamps is itself a Class D felony, carrying up to five years in prison and a fine between $1,025 and $10,245.7Iowa Legislature. Iowa Code 902.9 – Maximum Sentence for Felons This charge is separate from any drug possession or distribution charge, and prosecutors routinely stack it on.
Can Buying a Stamp Be Used Against You
The statute builds in confidentiality, but it has a hole worth knowing about.8Iowa Legislature. Iowa Code Chapter 453B – Excise Tax on Unlawful Dealing in Certain Substances, Section 453B.10
The Department of Revenue and its employees are prohibited from disclosing information they obtain from a buyer, and a department employee who leaks that information commits a simple misdemeanor. Information collected through the purchase process cannot be used against the buyer in a criminal case unless the state got the same information independently by other means. The stamp itself cannot be introduced as evidence in a criminal prosecution.
The exception: none of that confidentiality applies to proceedings to enforce the drug tax itself, whether by Iowa or by another state or local government pursuing a similar tax. If the state is coming after you for unpaid drug tax or penalties under Chapter 453B, the purchase information and the stamp are fair game.
Federal Tax Is a Separate Matter
Paying Iowa’s drug tax does not resolve anything on the federal side. Federal law requires all income to be reported, including income from illegal activity, and the IRS does not carve out an exception because the underlying conduct is a crime. Unreported drug proceeds can support federal tax evasion charges stacked on top of the state charges.
Sellers face a second federal problem under Section 280E of the Internal Revenue Code, which bars any deduction or credit for expenses incurred in a business that traffics in Schedule I or Schedule II controlled substances.9Office of the Law Revision Counsel. 26 USC 280E – Expenditures in Connection With the Illegal Sale of Drugs The IRS taxes gross revenue from those sales with no deductions for operating costs, which can push the effective tax rate above 70% of actual profit. The cost of the Iowa stamps is one of the expenses the IRS will not let you deduct.
