Turning 17 in Texas puts you in a legal middle ground, and the short answer to whether 17 is legal in Texas depends entirely on what you’re asking about. At 17 you’re treated as an adult for criminal prosecution and for sexual consent, you can drive with a provisional license, work without state hour limits, consent to some medical care, register to donate blood, and enlist in the military with a parent’s permission. You still can’t vote, sit on a jury, buy a firearm from a dealer, marry without a court order, or get a tattoo without notarized parental consent. The rest of this guide walks through each area.
Criminal Charges Go to Adult Court
This is the heaviest consequence of turning 17. Texas caps juvenile court jurisdiction at under 17, so any criminal charge filed against a 17-year-old goes to adult court by default. Same procedures, same possible sentences, same adult facilities. There’s no transfer hearing and no judicial discretion involved.
An adult conviction at 17 creates a permanent record. Juvenile records can often be sealed; adult records follow you through college applications, job searches, and housing. Expungement is possible only in narrow situations, such as charges that were dismissed or ended in acquittal. If you completed deferred adjudication for a misdemeanor and stayed out of trouble during the waiting period, you may qualify for a nondisclosure order that hides the record from public view, though it still exists inside the criminal justice system.
Bills to raise the juvenile age to include 17-year-olds have been introduced repeatedly, including HB 2234 in the 89th Legislature (2025–2026), but none has passed. Texas remains one of a small number of states that automatically prosecute 17-year-olds as adults.
Sexual Consent
Texas sets the age of sexual consent at 17. Penal Code Section 22.011 defines “child” as a person younger than 17 for the sexual assault statute, so a 17-year-old can legally consent to sexual activity with an adult partner.1Texas State Law Library. What Is the Legal Age of Consent for Sex in Texas?
That consent has limits. The statute lists situations where consent is legally impossible regardless of age, including when the other person is a public servant who coerces participation, a mental health or healthcare provider exploiting a professional relationship, a member of the clergy exploiting a spiritual advising role, or an employee of a facility where the younger person is a resident.2State of Texas. Texas Penal Code Section 22.011 – Sexual Assault
For couples close in age, the statute provides an affirmative defense when the older person is no more than three years older, the younger is at least 14, and several other conditions are met.1Texas State Law Library. What Is the Legal Age of Consent for Sex in Texas?
Driving
At 17 you’re eligible for a provisional driver’s license if you’ve held a learner’s permit for at least six months and completed driver education, including behind-the-wheel instruction and the Impact Texas Teen Driver program.3Department of Public Safety. Texas Provisional License as a Teen
The provisional license comes with two main restrictions. You can’t drive between midnight and 5:00 a.m. except for work, a school activity, or a medical emergency. And you can’t carry more than one passenger under 21 who isn’t a family member. Violations can bring fines or suspension. The restrictions end automatically at 18.3Department of Public Safety. Texas Provisional License as a Teen
The Texas Department of Insurance says a teen driver in the household needs to be added to the family’s insurance policy. Failing to notify the insurer about a 17-year-old driver can result in a denied claim, a voided policy, or nonrenewal after a wreck.4Texas Department of Insurance. Work
Texas places very few limits on 17-year-old workers. Unlike 14- and 15-year-olds, a 17-year-old has no state cap on hours worked or time of day.5Texas Workforce Commission. Summary of the Texas Child Labor Law
The big restriction is hazardous work. Federal law sets an 18-year minimum for occupations the Department of Labor considers particularly dangerous, and Texas follows the same framework.6eCFR. 29 CFR Part 570 – Child Labor Regulations, Orders and Statements of Interpretation The prohibited list for 16- and 17-year-olds includes explosives, mining, logging, roofing, demolition, power-driven saws or meat-processing machines, and driving commercial vehicles on public roads (with narrow exceptions). Some of these orders allow exemptions for registered apprentices or student-learners.5Texas Workforce Commission. Summary of the Texas Child Labor Law
Texas doesn’t require work permits at any age. Employers can request a certificate of age from the Texas Workforce Commission, but it’s optional.7Texas Workforce Commission. Child Labor Law Poster
Contracts and Bank Accounts
Contracts signed by anyone under 18 are voidable at the minor’s choice. The adult on the other side is bound, but the minor can walk away before turning 18 or within a reasonable time after. The main exception is contracts for necessities like food, clothing, and shelter, which courts will enforce against a minor.
Bank accounts work differently. Texas law lets savings institutions open deposit accounts with a minor as sole owner. The bank can accept withdrawals and instructions directly from the minor. A parent or guardian can file a written notice with the bank restricting the minor’s control, at which point transactions require parental involvement.8State of Texas. Marriage and Emancipation
Nobody under 18 can marry in Texas without a court order removing the disabilities of minority for general purposes. Parental consent alone is no longer enough. A person under 18 also cannot enter into an informal (common-law) marriage or sign a declaration of informal marriage.9State of Texas. Texas Family Code Section 2.003 – Application for License by Minor
To file for emancipation, you must be a Texas resident, be self-supporting and managing your own finances, and be either 17 or at least 16 and living apart from your parents or guardian.10State of Texas. Texas Family Code Section 31.001 – Requirements You can file the petition in your own name without a parent or attorney. The court evaluates financial stability and maturity. If granted, you gain the ability to sign enforceable contracts, make your own medical decisions, and handle legal matters like filing a lawsuit. The order can be general or limited to specific areas.
Medical Decisions
Minors in Texas generally need parental consent for medical treatment, but state law carves out several areas where a 17-year-old can consent alone. Under Family Code Section 32.003, a minor can consent to diagnosis and treatment for reportable infectious or communicable diseases, drug or chemical dependency, and pregnancy-related medical, surgical, or hospital care (excluding abortion).11State of Texas. Texas Health and Safety Code Chapter 162
In emergencies where waiting for parental consent could cause serious harm, providers can treat a minor under implied consent principles.
Mental Health Counseling
Family Code Section 32.004 lets a minor of any age consent to counseling without parental involvement when the minor is contemplating suicide, dealing with substance abuse, or has experienced sexual, physical, or emotional abuse. A minor who is at least 16, lives apart from their parents, and manages their own finances can also consent to outpatient mental health services. Parents may still have access to counseling records even when their consent wasn’t required for treatment.
Blood and Organ Donation
A 17-year-old can consent to donate blood without parental permission. The law prohibits anyone under 18 from being paid for a blood donation, so paid plasma centers are off-limits until 18.12State of Texas. Texas Health and Safety Code Chapter 162 – Blood Banks and Donation of Blood
Teens ages 15 through 17 can register as organ donors when applying for a learner’s permit or driver’s license. No parental permission is needed to register, but a parent or guardian would need to affirm the decision if the teen actually became a potential donor.13Donate Life Texas. Tattoos and Piercings
Texas Health and Safety Code Chapter 146 regulates both. A tattooist cannot tattoo anyone younger than 18 without written and notarized parental consent. The notarization requirement is stricter than people expect; a verbal “go ahead” from a parent won’t do it.
Piercing has its own rules. A person under 18 can’t get a piercing without parental consent, and the consent must specify which body part will be pierced. The parent satisfies the requirement by being physically present at the studio, signing an affidavit confirming identity and parental status, and showing proof of both. A 17-year-old who falsely claims to be 18 or uses a fake ID to get pierced commits a Class B misdemeanor.14State of Texas. Texas Health and Safety Code Section 146.0125 – Body Piercing Prohibited Without Parental Consent; Exception
School Attendance
Texas has one of the higher compulsory attendance ages in the country. Under Education Code Section 25.085, a child must attend school until their 19th birthday, not their 18th.15State of Texas. Texas Education Code Chapter 25 – Admission, Transfer, and Attendance
Some exemptions open up at 17. A 17-year-old is exempt from compulsory attendance if enrolled in a course preparing for the high school equivalency exam (GED) and one of the following applies: parental permission, a court order to attend the course, a separate residence from parents, or experiencing homelessness. A 17-year-old who has already earned a diploma or GED is also exempt.15State of Texas. Texas Education Code Chapter 25 – Admission, Transfer, and Attendance
Emancipation doesn’t automatically exempt you from compulsory attendance, but an emancipated 17-year-old living independently would likely meet the “separate residence” condition if enrolled in GED preparation.
Voting, Jury Duty, and Military Service
You can’t vote at 17. You can register if you’ll be 18 by Election Day, and the earliest you can submit your registration is at 17 years and 10 months.16VoteTexas.gov. Voter Registration Eligibility in Texas Jury duty eligibility starts at 18.17Texas Judicial Branch. Jury Service in Texas
Military service is the one civic area where 17 opens a door. Federal law allows enlistment in any branch at 17 with the written consent of a parent or guardian who has legal custody.18Office of the Law Revision Counsel. 10 USC 505 – Regular Components: Qualifications, Term, Grade You also need a high school diploma or GED and must pass the Armed Services Vocational Aptitude Battery (ASVAB) and a medical exam.19USAGov. Firearms
Texas Penal Code Section 46.06 makes it illegal to sell or give a firearm to anyone under 18. There’s an affirmative defense if the child’s parent or legal custodian gave written permission for the sale. Federal law adds another layer: licensed dealers cannot sell any firearm or ammunition to someone under 18, and cannot sell a handgun to anyone under 21. Federal law also makes it illegal for a person under 18 to possess a handgun, with limited exceptions.21Texas State Law Library. How Old Do You Need to Be to Buy a Gun?
The practical result: a 17-year-old in Texas cannot walk into a gun store and buy anything. With written parental permission, a private-party transfer of a long gun (rifle or shotgun) may be defensible under state law, but handgun possession remains off-limits under federal law until 18.
