Ayahuasca is not legal in Florida. The brew contains N,N-dimethyltryptamine (DMT), which Florida and the federal government both classify as a Schedule I controlled substance, so brewing it, possessing it, serving it, or carrying it is a felony. The only people in the United States who can use ayahuasca lawfully belong to a small number of religious organizations that won federal court orders recognizing their sacramental use, and no such exemption has been granted to any Florida operation.
Why the Brew Itself Is Illegal
Ayahuasca is made by combining the Banisteriopsis caapi vine with a DMT-containing plant, typically Psychotria viridis. The DMT is what triggers the drug laws. Under the federal Controlled Substances Act, DMT is a Schedule I hallucinogen, meaning the government treats it as having a high potential for abuse and no accepted medical use.1Office of the Law Revision Counsel. 21 USC 812 – Schedules of Controlled Substances Florida Statutes Section 893.03 lists DMT the same way.2Online Sunshine. Florida Statutes 893.03 – Standards and Schedules Because the finished brew always contains DMT, every step of making or holding it is a controlled substance offense.
The Banisteriopsis caapi vine on its own is a different story. The vine contains harmala alkaloids, not DMT, and it is not specifically scheduled under Florida or federal law. In practice, though, importing or stockpiling the vine can draw scrutiny as evidence of intent to manufacture a DMT-containing substance, so “the vine is unscheduled” is not a reliable shield.
Florida Penalties for Possessing or Sharing Ayahuasca
Simple possession of ayahuasca is a third-degree felony in Florida, punishable by up to five years in prison.3Online Sunshine. Florida Statutes 893.13 – Prohibited Acts; Penalties4Florida Senate. Florida Statutes 775.082 – Penalties; Applicability of Sentencing Structures; Mandatory Minimum Sentences The quantity does not matter. A single bottle brought home from a trip is enough.
Selling or delivering the brew is a second-degree felony, carrying up to 15 years. Pouring cups for others at a ceremony fits the statutory definition of delivery, even without money changing hands. If the delivery occurs within 1,000 feet of a school, daycare, church, or public housing facility, it becomes a first-degree felony with a three-year mandatory minimum.3Online Sunshine. Florida Statutes 893.13 – Prohibited Acts; Penalties
One narrow point of relief: Florida’s drug trafficking statute, which carries the state’s harshest mandatory minimums, does not list DMT.5Florida Senate. Florida Statutes 893.135 – Trafficking; Mandatory Sentences The trafficking tiers that apply to cocaine, opioids, LSD, and certain phenethylamines do not reach tryptamines like DMT. The underlying conduct is still a felony; it just doesn’t trigger those specific trafficking minimums.
Federal Charges Can Stack on Top
State charges are not the only exposure. Federal prosecutors can bring their own case for the same conduct. First-offense simple possession of a Schedule I substance is a federal misdemeanor with up to a year in prison and a $1,000 minimum fine.6GovInfo. 21 USC 844 – Penalties for Simple Possession Distribution of a Schedule I drug is a federal felony with up to 20 years for a first offense.7Office of the Law Revision Counsel. 21 USC 841 – Prohibited Acts A Anyone running ceremonies and serving the brew is squarely within that provision.
The Religious Exemption Almost Nobody Qualifies For
There is one lawful pathway, and it is narrow. The Religious Freedom Restoration Act bars the federal government from substantially burdening a person’s religious exercise unless the burden is the least restrictive means of serving a compelling interest.8Office of the Law Revision Counsel. 42 U.S. Code 2000bb-1 – Free Exercise of Religion Protected In Gonzales v. O Centro Espírita Beneficente União do Vegetal (2006), the Supreme Court unanimously held that the government could not block the UDV church from importing and using ayahuasca as a sacrament.9Justia. Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal, 546 U.S. 418 (2006) A federal court in Oregon later extended similar protection to the Santo Daime church. Those rulings cover those specific congregations and their members, not ayahuasca drinkers generally.
Individual defendants who invoke RFRA after being arrested rarely succeed. Courts look hard at whether the practice is tied to a sincere, structured religious tradition, and personal spiritual conviction alone has not been enough. One federal defendant who described his marijuana use as Rastafarian meditation lost because he had no church affiliation or organized community backing the claim.10Justia. United States v. Jefferson A judge is unlikely to treat an unaffiliated ayahuasca practice any differently.
The DEA does have a formal petition process for religious exemptions, requiring detailed disclosures about the religion’s beliefs, structure, membership, and planned use of the substance.11Drug Enforcement Administration. Guidance Regarding Petitions for Religious Exemption from the Controlled Substances Act Pursuant to the Religious Freedom Restoration Act On paper this looks like a route in. In reality, a Government Accountability Office review found that from 2016 through January 2024, the DEA received 24 religious exemption petitions and granted zero. Two were denied, 14 were still pending, and eight were withdrawn.12U.S. Government Accountability Office. GAO-24-106630 – Drug Control: DEA Should Improve Its Process for Petitions for Religious Exemption The churches that drink ayahuasca legally today got there through federal lawsuits, not through DEA paperwork.
Ayahuasca Retreats Advertised in Florida
Commercial ayahuasca retreats have operated in Florida despite the illegality. The best-known example is Soul Quest Ayahuasca Church of Mother Earth, which petitioned the DEA for a religious exemption. The DEA denied the petition, and in 2023 the Eleventh Circuit Court of Appeals upheld that denial.13Justia. Soul Quest Church of Mother Earth, Inc. v. Attorney General of the United States A Florida jury later ordered Soul Quest to pay $15 million in a wrongful death case brought by the family of a participant who died during a 2018 ceremony after consuming ayahuasca and kambo and developing a dangerous drop in sodium.
If you attend a Florida retreat, you are almost certainly participating in federal drug activity, and you have essentially no consumer protections if a medical emergency happens. The operator cannot shield you with a church membership card the federal courts never approved.
Traveling or Shipping Ayahuasca
Moving the brew around makes the problem bigger, not smaller. TSA screeners are looking for security threats, but when they come across a controlled substance they are required to refer it to law enforcement.14Transportation Security Administration. Medical Marijuana Carrying ayahuasca between states adds federal trafficking exposure, and bringing it in from South America layers customs violations on top of the drug charges. There is no legal way to import ayahuasca into Florida for personal use.
