Betting is legal in California only in specific, regulated forms: tribal casinos, horse racing (including online account wagering), the state lottery, and licensed card rooms. Everything else — sports betting, online casino games, bookmaking, and offshore sites — is prohibited. California’s rules are stricter than most states, and voters rejected two sports betting measures in 2022, so the list of legal options has not expanded.
What You Can Legally Bet On
Tribal Casinos
Tribal casinos are the only places in California where you can legally play slot machines, blackjack, and other house-banked card games. The authority comes from Article IV, Section 19(f) of the California Constitution, which lets the Governor negotiate gaming compacts with federally recognized tribes, subject to legislative ratification.1California Legislative Information. California Constitution Article IV Section 19 Each compact spells out which games a tribe may offer and the rules it must follow. If you want to pull a slot handle or sit at a blackjack table in this state, a tribal casino is your only legal choice.
Horse Racing
Pari-mutuel wagering on horse racing is one of the oldest legal forms of betting in California. You bet against the pool of other bettors rather than against the house, and the California Horse Racing Board licenses the tracks, jockeys, trainers, and others in the industry.2California Horse Racing Board. Licensing
You can bet trackside, at authorized satellite wagering facilities, or from home through an advance deposit wagering (ADW) account. ADW providers must verify that account holders are at least 18 and confirm identity electronically before accepting any wager.3Legal Information Institute. 4 CCR 2074 – Requirements to Establish an Advance Deposit Wagering Account Horse racing is the only form of sports wagering currently legal in the state.
The California State Lottery
Voters created the lottery in 1984 through Proposition 37, which requires at least 34 percent of revenue to go to public education.4Ballotpedia. California Proposition 37, Gambling Provisions Initiative (1984) The California State Lottery Act, codified at Government Code Section 8880, authorizes scratch-off tickets and draw games including Powerball and Mega Millions. You must be 18 to buy a ticket, and selling one to a minor is a misdemeanor.5California Legislative Information. California Government Code 8880.52
Licensed Card Rooms
Card rooms can host poker and similar games where players compete against each other, but they cannot run house-banked games like traditional blackjack or craps where the house has a stake in the outcome. The room makes its money by collecting a per-hand or time-based fee for hosting the game.6California Legislative Information. California Business and Professions Code 19801 Some card rooms offer games styled like blackjack using a rotating player-dealer position; regulators have scrutinized and sometimes challenged those arrangements.
What Is Not Legal
Sports Betting
Sports betting is illegal in every format in California — retail, online, and mobile. In November 2022, voters rejected Proposition 26, which would have allowed sports betting at tribal casinos and licensed racetracks, and Proposition 27, which would have legalized online and mobile sports betting statewide. No new legalization effort has advanced since. Horse racing remains the sole exception.
Online Casino Games
Digital slots, virtual table games, and similar online casino offerings are illegal under California Penal Code 330. Playing or operating these games is a misdemeanor punishable by up to six months in county jail and a fine of up to $1,000.7California Legislative Information. California Penal Code 330
Bookmaking
Running an unlicensed gambling operation or acting as a bookmaker is prohibited under Penal Code 337a. A first offense can be charged as a misdemeanor, but repeat offenders face wobbler charges that prosecutors can file as felonies with prison time of up to three years.
Offshore Betting Sites
Offshore sportsbooks and casino sites market heavily to Californians, often designed to look identical to licensed U.S. operators. The FBI has warned that these sites fund organized crime, lack consumer protections, and leave bettors vulnerable to fraud and loss of funds with no legal recourse.8Federal Bureau of Investigation. Great Odds, High Risk – The FBI Encourages US Bettors to Know the Risks of Illegal Gambling Under the federal Unlawful Internet Gambling Enforcement Act, U.S. banks and payment processors must block transactions tied to illegal online gambling, so your card or bank transfer may be refused.9eCFR. 12 CFR Part 233 – Prohibition on Funding of Unlawful Internet Gambling If a site asks you to fund with cryptocurrency or gift cards to work around payment blocks, that itself is a warning sign.
Daily Fantasy Sports and Sweepstakes Casinos
Daily fantasy sports contests from platforms like DraftKings and FanDuel sit in a gray area. The California Attorney General has stated these contests are not authorized under state law; the platforms argue they are games of skill and therefore not gambling. The legislature has neither legalized nor explicitly banned them, and no enforcement action has shut them down. They operate without state oversight of fairness or clear legal recourse if a platform withholds winnings.
Sweepstakes-model online casinos use a dual-currency system — purchased coins for entertainment play and free “sweepstakes” coins that can be redeemed for prizes — on the theory that a free alternative method of entry removes the “consideration” element that defines gambling. Whether this complies with California law has not been definitively tested in court. If a platform makes free play significantly harder or less rewarding, regulators can argue the free entry is a sham.
Minimum Ages
The legal age depends on where and what you’re betting on.
- Lottery: 18. Selling to a minor is a misdemeanor.5California Legislative Information. California Government Code 8880.52
- Horse racing and ADW: 18, with age verification required when opening an advance deposit account.3Legal Information Institute. 4 CCR 2074 – Requirements to Establish an Advance Deposit Wagering Account
- Tribal casinos: 21, set through individual tribal-state compacts rather than a single statewide statute.
- Card rooms: typically 21, varying by establishment; rooms that serve alcohol almost always enforce 21-and-over.
Taxes if You Win
Every dollar you win gambling is federally taxable income, no matter the game or the amount, and you report it on your return whether or not tax was withheld.10Internal Revenue Service. Topic No. 419 – Gambling Income and Losses
For 2026, casinos, racetracks, and lottery operators must issue a Form W-2G when winnings reach the reporting threshold, which starts at $2,000 and is adjusted for inflation. When net winnings from sweepstakes, wagering pools, lotteries, pari-mutuel betting, or sports wagering exceed $5,000, the payer must withhold 24 percent for federal income tax before paying you.11Internal Revenue Service. Instructions for Forms W-2G and 5754 If you split a jackpot, the person who collects the prize should file Form 5754 identifying each winner and their share, or the IRS will treat the whole amount as belonging to the collector.12Internal Revenue Service. Form 5754 – Statement by Person(s) Receiving Gambling Winnings
California taxes gambling winnings as ordinary income at your regular state rate, with one exception: winnings from the California State Lottery, including Powerball and Mega Millions tickets purchased in state, are exempt from state income tax.13Franchise Tax Board. Gambling Winnings from tribal casinos, card rooms, horse racing, and out-of-state gambling are fully taxable at the state level.
You can deduct gambling losses, but only if you itemize on your federal return, and only up to the amount of gambling income you reported. You cannot use losses to create a net deduction against other income. The IRS expects detailed records — a log of dates, locations, and amounts for both wins and losses, backed by receipts, tickets, or account statements.10Internal Revenue Service.
