Is Delta 8 Legal in WV? Penalties, Legal Hemp, and Driving

Delta-8 THC is not legal in West Virginia. Since June 8, 2023, state law has classified delta-8 THC as a Schedule I controlled substance, the same category as heroin and LSD. Possessing it is a misdemeanor, and selling or manufacturing it is a felony.

What the 2023 Law Changed

Governor Jim Justice signed Senate Bill 546 on March 29, 2023, and it took effect that June.1West Virginia Legislature. Bill Status – Senate Bill 546 The bill rewrote the state’s Schedule I list to name delta-8 THC, delta-10 THC, and their optical isomers directly. It also added a catch-all for synthetic and non-naturally occurring cannabinoids.2West Virginia Legislature. West Virginia Code 60A-2-204

That catch-all matters because most commercial delta-8 is not pulled straight from the plant. Manufacturers chemically convert CBD into delta-8, and the resulting product is a non-naturally occurring cannabinoid under the statute. A “hemp-derived” label on the package does not change that. If it contains delta-8 THC, West Virginia treats it as contraband.2West Virginia Legislature. West Virginia Code 60A-2-204

Penalties for Possession

Simple possession of delta-8 THC without a valid prescription or other legal authorization is a misdemeanor. A conviction can bring 90 days to six months in jail, a fine of up to $1,000, or both.3West Virginia Legislature. West Virginia Code 60A-4-401 – Prohibited Acts; Penalties

This catches people who bought delta-8 gummies or vapes legally before June 2023 and still have them sitting in a drawer. The product is now a controlled substance regardless of when it was purchased.

Penalties for Selling or Manufacturing

Manufacturing, delivering, or possessing delta-8 with intent to distribute is a felony. Because delta-8 is classified as a non-narcotic Schedule I substance, a conviction carries one to five years in a state correctional facility, a fine of up to $15,000, or both.3West Virginia Legislature. West Virginia Code 60A-4-401 – Prohibited Acts; Penalties Retailers who kept delta-8 on the shelf after June 8, 2023 face this level of exposure.

What Hemp Products Are Still Legal

The ban did not sweep in every hemp product. The Schedule I listing exempts products lawfully produced under West Virginia’s Industrial Hemp Development Act or its medical cannabis program.2West Virginia Legislature. West Virginia Code 60A-2-204 In practice:

  • Hemp-derived CBD that contains no more than 0.3 percent delta-9 THC and complies with state hemp regulations remains legal. CBD was not added to the controlled substance schedule.
  • Hemp seed oil, hemp fiber, and non-intoxicating topicals that meet state hemp rules are unaffected.
  • Medical cannabis products dispensed through the state’s Chapter 16H program are exempt, but only with a valid patient card and only when purchased from a licensed dispensary.

The line the statute draws is between non-intoxicating hemp compounds and the intoxicating THC variants SB 546 targeted. Delta-8, delta-10, and other synthetic cannabinoids fall outside the exemption even when the starting material was legal hemp.

A Medical Card Does Not Cover Delta-8

West Virginia’s medical cannabis program is operational, but a medical card does not legalize delta-8 for the cardholder. The exemption in the controlled substance statute reaches products “lawfully manufactured, distributed, or possessed” through the medical program.2West Virginia Legislature. West Virginia Code 60A-2-204 Delta-8 bought online or at a gas station was not produced or sold through that regulated system, so the card gives no protection for it.

Ordering From a State Where It Is Legal

Buying delta-8 online from a state where it is lawful does not protect you once the package arrives. The moment it crosses into West Virginia, you are in possession of a Schedule I controlled substance under state law, no matter where the shipper is located or what the rules were on the sending end. Federal mailability does not override state criminal law.

Driving After Using Delta-8

West Virginia’s DUI statute defines an impaired state to include being under the influence of any controlled substance or drug.4West Virginia Legislature. West Virginia Code 17C-5-2 – Driving Under Influence of Alcohol, Controlled Substances, or Drugs; Penalties Because delta-8 is now a controlled substance, detectable impairment from it can support a DUI charge. The state uses Drug Recognition Experts trained to identify drug impairment, so a clean breathalyzer does not end the inquiry.
