Is Depression a Disability in California? Accommodations and Benefits

Depression is a disability in California whenever it makes a major life activity harder to do, which is a deliberately low bar set by the state’s Fair Employment and Housing Act. Clearing that bar matters because it unlocks three concrete things: the right to reasonable accommodations at work, protection from being punished for asking, and access to state wage-replacement benefits if your symptoms keep you off the job.

When Depression Meets California’s Legal Definition

California Government Code Section 12926 defines “mental disability” to include any mental or psychological disorder that limits a major life activity, and the statute defines “limits” as making the activity “difficult.”1California Legislative Information. California Government Code 12926 That word carries a lot of weight. You do not need to show that depression makes something impossible, or even severely restricted. If concentrating at work, sleeping through the night, maintaining relationships, or caring for yourself has become harder because of depression, the condition likely qualifies.

Three features of the definition matter in daily life. The limitation is evaluated without regard to medication or treatment, so an antidepressant that helps you function does not disqualify you. Episodic depression counts, as long as it would limit a major life activity when symptoms are active. And a documented history of depression can be enough on its own if your employer knows about it.1California Legislative Information. California Government Code 12926

A diagnosis by itself is not the whole picture. What turns a medical condition into a legal disability is the connection between depression and a specific activity it makes harder. That link is what you will need to articulate when asking for help at work or filing a complaint.

Why California Protects More People Than Federal Law

The federal Americans with Disabilities Act requires a condition to “substantially limit” a major life activity. California chose a lower threshold on purpose: the condition only needs to “limit” the activity, meaning make it difficult.1California Legislative Information. California Government Code 12926 Someone whose depression makes focus noticeably harder, but not severely impaired, might lose a close federal case and still clearly qualify under state law. If you work in California, FEHA’s standard is the one that governs your employer.

What Qualifying Gets You at Work

FEHA requires employers with five or more employees to provide reasonable accommodations for workers with mental disabilities, unless doing so would create an undue hardship for the business.2California Civil Rights Department. Reasonable Accommodation The process starts the moment you tell your employer you need a change at work because of a medical condition. You do not need to use the word “accommodation,” file paperwork, or put the request in writing. Telling a supervisor or HR that you need an adjustment because of a health issue is enough.

Once your employer knows, the law requires them to start what’s called an interactive process, a two-way conversation about possible accommodations.3Legal Information Institute. California Code of Regulations Title 2 Section 11069 – Interactive Process The duty to begin and sustain that conversation sits with the employer, not with you. An employer who ignores the request, or flatly says no without exploring options, has violated FEHA on that fact alone.

What Accommodations for Depression Usually Look Like

Accommodations for depression tend to be administrative and low-cost. Common examples include:

  • Modified schedules, such as flexible start times, compressed weeks, or reduced hours during an acute episode
  • Workspace changes, including a quieter location, noise-canceling headphones, or remote work
  • Task adjustments, such as written rather than verbal instructions, breaking large projects into smaller pieces, or temporarily reassigning non-essential duties
  • Unpaid leave for treatment or recovery beyond what FMLA or other leave laws provide
  • Support tools like planners, organizers, or a modified break schedule to manage concentration

Your employer does not have to grant the exact accommodation you ask for. They do have to work with you on something that actually addresses the limitation.

Documentation Worth Having Ready

Nothing in the law requires written proof to start the conversation, but documentation strengthens your position considerably. A letter from your psychiatrist, psychologist, or therapist should describe the diagnosis and spell out how depression affects specific job tasks. The more concretely that connection is drawn, the harder it is for an employer to push back. Treatment records showing the ongoing nature of the condition help if the employer questions whether a disability exists at all.

Protection From Retaliation for Asking

California law makes it illegal for your employer to punish you for requesting an accommodation, whether or not the request is granted.4California Legislative Information. California Government Code 12940 Retaliation covers firing, demotion, cut hours, undesirable shift reassignments, and the creation of a hostile environment. The same protection extends to employees who file discrimination complaints or take part in an investigation.

Asking for help with a mental health condition can feel exposing, and the worry about being labeled difficult is real. The legal protection exists because the legislature recognized that worry. When an employer takes adverse action soon after you request a depression-related accommodation, the timing itself can be strong evidence of retaliation.

If Your Employer Refuses: Filing With the CRD

When an employer refuses to accommodate, retaliates, or discriminates based on depression, you can file a complaint with the California Civil Rights Department. You have three years from the date of the last harmful action to submit an intake form.5California Civil Rights Department. Complaint Process

The intake goes in online through the California Civil Rights System. A CRD representative interviews you, assesses whether the allegations fall within FEHA, and decides whether to accept a formal complaint for investigation. Bring whatever you have: emails showing the accommodation request, written denials, medical records, and contact information for witnesses. You can also skip the CRD investigation and sue directly, but for employment cases you must first obtain a Right-to-Sue notice from CRD before filing in court.5California Civil Rights Department. Wage Replacement Through State Disability Insurance

If depression keeps you from working, California’s State Disability Insurance program provides short-term wage replacement for non-work-related conditions. Weekly benefits range from $50 to $1,765 and can last up to 52 weeks.6Employment Development Department. Disability Insurance Benefits The replacement rate runs from 70 to 90 percent of your wages during a base period roughly 5 to 18 months before the claim, with higher earners receiving the lower percentage.7Employment Development Department. Disability Insurance Benefit Payment Amounts

To qualify, your depression has to prevent you from doing your regular work for at least eight consecutive days, you must be losing wages because of it, and you must be under the care of a licensed health professional. A seven-day waiting period applies before benefits begin, and no benefits are paid for that first week.8Legal Information Institute. California Code of Regulations Title 22 Section 2627(b)-1 – Waiting Period

The claim has two parts. You file your portion online through SDI Online, or by mailing form DE 2501, no earlier than nine days and no later than 49 days after your disability begins. Your treating physician or mental health provider completes and submits the medical certification within the same 49-day window. If either part arrives late, you risk losing benefits or disqualification.9Employment Development Department. Disability Insurance Claim Process

If EDD Denies Your Claim

You have 30 days from the date on the denial notice to appeal. Appeals can go in electronically or by mailing the Appeal Form (DE 1000A) that comes with the denial.10Employment Development Department. State Disability Insurance Appeals Missing the 30-day window is not automatically fatal, but you will have to show an Administrative Law Judge good cause for being late. EDD first re-evaluates the claim internally. If the denial stands, the case goes to the California Unemployment Insurance Appeals Board for a hearing before an Administrative Law Judge, where both you and an EDD representative present your sides. Failing to show up to the hearing results in automatic dismissal.

If Your Depression Was Caused by Work

SDI covers depression unrelated to the job. Depression caused or significantly worsened by workplace conditions runs through workers’ compensation instead. California Labor Code Section 3208.3 recognizes psychiatric injuries as compensable, but the requirements are stricter than for physical injuries: generally you must have worked for the employer at least six months, your condition must be a recognized DSM diagnosis, and actual work events must account for at least 51 percent of the cause. That 51 percent threshold is where most psychiatric claims get contested, so documenting specific incidents, conditions, and the timeline of symptoms against those events matters if you go this route.

If You Cannot Work Long-Term: Federal Benefits

When depression is severe enough to prevent work for at least 12 months, federal disability benefits may be available through Social Security. SSDI is for people with a sufficient work history; SSI is for people with limited income and resources regardless of work history, with countable resources capped at $2,000 for an individual or $3,000 for a married couple.11Social Security Administration. How Much You Could Get From SSI The maximum federal SSI payment in 2026 is $994 per month, with a California state supplement on top. Initial decisions typically take six to eight months.12Social Security Administration. How Long Does It Take to Get a Decision After I Apply for Disability

The federal bar is considerably higher than California’s. Social Security evaluates depression under Listing 12.04, which requires documented depressive symptoms plus either significant limitations across multiple areas of mental functioning or a medically documented history of at least two years with minimal capacity to adapt to change.13Social Security Administration. Mental Disorders – Adult Most initial applications are denied, and many claimants go through one or two appeals before approval. State SDI replaces wages while you recover; federal disability is built for long-term or permanent inability to work and requires proving you cannot perform any substantial work available in the national economy.
