Is DraftKings legal in Alaska? Partly. Daily fantasy sports contests are available to Alaska residents and the state has never moved against them, but the DraftKings Sportsbook, DraftKings Casino, and DK Horse are all blocked. The DFS situation is best described as unregulated rather than clearly authorized, because Alaska’s gambling statute is broad and no court or attorney general has carved out a fantasy exception.
Daily Fantasy Sports: Available but in a Gray Zone
DraftKings accepts DFS entries from Alaska. You can build lineups, pay entry fees, and collect winnings the same way players do in states with explicit fantasy laws. No enforcement action has been taken against fantasy operators or their users in Alaska.
That’s different from saying DFS is legal. Alaska defines gambling as staking something of value on a “contest of chance” or a “future contingent event” outside your control. A contest of chance is one where the outcome depends “in a material degree upon an element of chance, notwithstanding that the skill of the contestants may also be a factor.”1FindLaw. Under that standard, paid fantasy contests are vulnerable. Injuries, weather, and coaching decisions all inject randomness that no amount of research can eliminate. What keeps DFS running here is practical: Alaska has no gaming commission, no online contest regulator, and no history of prosecuting fantasy play. Until the legislature acts or a prosecutor tests the question, DFS sits between authorized and prohibited.
Sports Betting Is Blocked
The DraftKings Sportsbook does not work in Alaska. Spreads, moneylines, totals, parlays, live betting — all of it is disabled when the app detects you inside the state. Alaska has no law authorizing sports wagering and no agency to license operators, so DraftKings has no legal path to offer a sportsbook here. Betting on a game’s outcome fits directly inside the statutory definition of gambling on a “future contingent event not under the person’s control or influence.”1FindLaw. Casino and Horse Racing Are Also Unavailable
DraftKings Casino, which offers slots, blackjack, and roulette, currently runs only in Connecticut, Michigan, New Jersey, Pennsylvania, and West Virginia.3DraftKings. DK Horse, the company’s pari-mutuel horse racing product, depends on state-level authorization for online race wagering. Alaska has no such framework, and Alaska residents should expect DK Horse to be unavailable.
Why VPNs and Spoofing Don’t Work
DraftKings verifies location using GPS, Wi-Fi, and cell tower data, not just IP addresses, so a VPN alone won’t unlock the sportsbook. The check runs every time you enter a contest lobby or try to place a wager. If the platform detects location manipulation, consequences range from warnings to permanent account closure, and any winnings tied to spoofed activity can be forfeited. Placing bets from a state where wagering is illegal could also expose you to criminal liability in both jurisdictions.
Pending Sports Betting Legislation
Alaska lawmakers have tried more than once to authorize sports betting. House Bill 385 in the 32nd Legislature would have created a mobile sports gaming framework and a tax on operator revenue, and would have limited applicants to companies already licensed in at least three other states.4Alaska State Legislature. Supporters point to tax revenue in a state with no income tax and recurring budget pressure, but the bill has not moved.
Gambling Penalties in Alaska
Enforcement against individual DFS players hasn’t happened, but the underlying penalties are worth knowing. A first gambling offense is a violation, the lowest category of offense in Alaska, and carries no jail time. A second or subsequent offense can bring a fine up to $1,000.7FindLaw. That defense does not extend to paid contests run by a commercial platform.
The bigger practical risk isn’t state prosecution. It’s using an unregulated offshore sportsbook and having no recourse if the site refuses to pay out or mishandles your data.
Taxes on DraftKings Winnings

Starting in 2026, the reporting threshold for Form W-2G is $2,000, up from the longstanding $600 figure.9Internal Revenue Service. Instructions for Forms W-2G and 5754 (01/2026) When net winnings from a single contest hit that amount, DraftKings will issue a W-2G and report the payout to the IRS. On payouts over $5,000, DraftKings must withhold 24% for federal taxes before paying you.
Even if no single payout reaches $2,000, you still have to report all winnings on Schedule 1 of Form 1040. Losses can be deducted against winnings if you itemize, but only up to the amount of winnings you report. Keep records of entry fees and payouts to make filing easier.
Account Setup and Age Requirement
You must be at least 18 years old to play DFS contests on DraftKings from Alaska. The platform verifies age and identity when you register, usually by cross-referencing your personal information, and sometimes by asking for a government-issued ID. If verification fails, you can’t enter paid contests.
Location is checked every session, not just at signup. Travel to a state where DFS is restricted and access drops until you return to an eligible location.
Self-Exclusion
DraftKings offers self-exclusion to all account holders, including Alaska residents. Standard exclusion periods are one year or five years, with shorter three- or six-month options for fantasy sports.10DraftKings.
