Yes, FanDuel is legal in North Carolina. The sportsbook app launched statewide on March 11, 2024 under a license from the North Carolina State Lottery Commission, and FanDuel’s daily fantasy sports contests have been legal in the state since January 1, 2018 under a separate law. You can place real-money wagers if you’re at least 21 and physically inside North Carolina, with one notable exception for tribal lands.
Who Can Legally Bet
You have to be 21 or older to place a sports bet with any licensed operator in North Carolina, FanDuel included.1North Carolina State Lottery Commission. Player FAQs Residency doesn’t matter. What matters is where you are when you tap “place bet.” Every licensed operator uses Commission-approved geofencing to verify your location in real time and block any wager attempted from outside the authorized area.2North Carolina General Assembly. North Carolina Code 18C-902 – Authorization of Sports Wagering Generally
One location detail catches people off guard. Tribal lands within North Carolina are excluded from the authorized betting area for state-licensed operators like FanDuel. The Eastern Band of Cherokee Indians operates under a separate Tribal-State gaming compact, so if you’re physically on tribal land near Cherokee, FanDuel’s geofencing will block your bet. The tribe’s own gaming enterprise holds a separate license under different rules.3Legal Information Institute. North Carolina Code 24 N.C. Admin. Code 06B 0405 – Geolocation Requirements
Several categories of people are barred from wagering regardless of age or location:
- Anyone enrolled in the state’s voluntary self-exclusion program who has not revoked that enrollment.4North Carolina State Lottery Commission. Responsible Gaming
- Athletes, coaches, trainers, referees, and team staff, who cannot bet on events they participate in.
- Employees of sports governing bodies, who cannot bet on events their organization oversees.
- Lottery Commission members and employees.
- Employees and key personnel of a licensed sportsbook, who cannot bet through their own company’s platform.
These prohibitions come straight from the sports wagering statute and apply to every licensed operator in the state.2North Carolina General Assembly. North Carolina Code 18C-902 – Authorization of Sports Wagering Generally
What You Can Bet On
FanDuel can accept wagers on professional sports, college sports, amateur sports, esports, and any other event the Commission approves.2North Carolina General Assembly. North Carolina Code 18C-902 – Authorization of Sports Wagering Generally That covers the major pro leagues, college football and basketball, international soccer, tennis, golf, MMA, and more. Standard bet types are available: moneylines, point spreads, over/unders, player props, and parlays.
College prop bets deserve a flag. North Carolina currently allows prop wagers on individual college athletes, but House Bill 828, filed in April 2025, would ban them. As of early 2026 the bill remains in committee and has not been enacted.5North Carolina General Assembly. House Bill 828 If it passes, wagers like “Player X scores over 20 points” would disappear for college games.
Daily fantasy sports sit on a separate legal track. The Fantasy Contests Act (Chapter 78E) classifies fantasy contests as skill-based competitions rather than gambling, because outcomes depend on participants’ knowledge of real-world athletic statistics.6North Carolina General Assembly. Fantasy Sports Contests FanDuel’s DFS product falls under that framework and has been available in the state since 2018.
Wagers No Operator Can Accept
State law carves out several bet types that no licensed book, FanDuel included, can take:
- Events where most participants are under 18, or are competing on behalf of a preschool, elementary, middle, or secondary school. Professional events and competitions run by national or international athletic bodies that happen to include some under-18 participants are not covered by the ban.
- Whether an injury will occur during a game.
- Whether a specific penalty will be called.
- The result of disciplinary proceedings against a player, coach, or official.
- Whether an official’s call will be overturned on replay.
These restrictions apply across every licensed sportsbook operating in North Carolina.2North Carolina General Assembly. North Carolina Code 18C-902 – Authorization of Sports Wagering Generally
Promotional Offers and Your Protections
FanDuel advertises sign-up bonuses, bonus bets, and promotional credits, and North Carolina regulations give you specific protections around them. Operators must clearly disclose when a promotion starts and expires, the order in which your cash and bonus credits are used for wagers, and any conditions you have to meet before withdrawing winnings tied to a promotion. If a promo uses restricted credits you can’t cash out until you hit a wagering requirement, the operator must give you a clear way to cancel and tell you exactly how much of your own money you’ll get back and how much in bonus credits will vanish.7North Carolina Office of Administrative Hearings. Promotional or Bonus Wagering (24 NCAC 06A .0503)
Two rules are worth remembering. An operator cannot call a promotion “free” unless it truly costs you nothing, and cannot call it “risk-free” if you have to lose your own money before using the offer. New-player promotions cannot stretch the redemption process beyond 30 days or require you to keep your account open longer than 30 days to qualify. Once you’ve met the terms of any promotion, the operator cannot cap or limit the winnings you earn from bets placed with that offer.7North Carolina Office of Administrative Hearings. Taxes on What You Win
Every dollar you win on FanDuel is taxable at both the federal and state level, whether or not you receive a tax form. North Carolina taxes gambling winnings as ordinary personal income at a flat 4.25%, on top of what you owe the IRS at your federal rate.
For tax year 2026, the IRS raised the Form W-2G reporting threshold to $2,000, adjusted for inflation from the previous $600 floor. If your net winnings from a single wager hit that threshold, FanDuel will report the payout to the IRS and may withhold taxes automatically.8IRS. Instructions for Forms W-2G and 5754 (Rev. January 2026) Winnings below $2,000 are still taxable income; you just won’t get a W-2G for them, so keep your own records.
You can deduct gambling losses to offset winnings, but only if you itemize instead of taking the standard deduction. Starting in 2026, new federal tax rules cap the deduction at 90% of your losses rather than the full amount. If you won $5,000 and lost $5,000 in the same year, you can deduct only $4,500 of those losses, leaving $500 in taxable “phantom income.” Sportsbooks report your winnings to the IRS but not your losses, so detailed personal records are essential if you want the deduction.
Signing Up and Funding Your Account
You can download the FanDuel Sportsbook app on iOS or Android or use the website. Creating an account requires your full name, date of birth, home address, and phone number. FanDuel verifies your identity automatically, typically by checking the last four digits of your Social Security Number against public records. If that initial check fails, you may need to upload a photo of a government-issued ID.
Once your account is verified, you can fund it with debit cards, online bank transfers, PayPal, Venmo, or the FanDuel Prepaid Play+ card. After depositing, you can place bets as soon as your phone or computer’s location services confirm you’re inside North Carolina’s authorized boundaries.
