Florida’s Zero Tolerance Law makes it illegal for anyone under 21 to drive with a blood-alcohol or breath-alcohol level of 0.02 or higher, and the penalty is an immediate license suspension handled entirely by the Department of Highway Safety and Motor Vehicles (FLHSMV) rather than a criminal court. Under Florida Statute 322.2616, the officer at the traffic stop acts on behalf of FLHSMV: no arrest, no judge, and no criminal conviction is needed to take your license away.1Justia Law. The 0.02 Threshold and Who It Applies To
The 0.02 line is far below the 0.08 that triggers a criminal DUI for adults, and for many young people a single beer within the past hour is enough to reach it.2Florida Senate. Florida Statutes 316.193 – Driving Under the Influence The reading does not have to suggest impairment. If an officer has probable cause to believe an underage driver has consumed any alcohol, they can request a breath test, and a 0.02 result alone triggers the suspension.1Justia Law. Florida Code 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review Most drivers caught by this law are not visibly intoxicated. The statute is written to create a near-zero-alcohol rule for anyone below the legal drinking age.
What Happens at the Traffic Stop
Once a breath test confirms a BAC of 0.02 or higher, or the driver refuses to test, the officer takes the physical driver’s license on the spot and issues a written notice of suspension along with a temporary driving permit.1Justia Law. Florida Code 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review The suspension period begins on that date, not later.
One detail trips people up: the temporary permit does not take effect for 12 hours. You cannot legally drive yourself home from the stop. The permit then expires at midnight on the 10th day after it was issued, which is also the deadline for requesting a review.1Justia Law. Florida Code 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review
How Long the Suspension Lasts
Length depends on whether you tested at or above 0.02, refused the test, and whether you have any prior zero tolerance suspension on your record:1Justia Law. Florida Code 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review
- First offense with a BAC of 0.02 or higher: six months.
- Second offense with a BAC of 0.02 or higher: one year.
- First test refusal: one year.
- Second test refusal: 18 months.
Refusing the breath test always draws a longer suspension than taking it and failing. The statute is written that way on purpose, to discourage refusal. A “second” offense counts any prior suspension under this same section, whether from a positive test or a refusal.
What Changes at Higher BAC Levels
At 0.05 or higher, the suspension period stays the same, but FLHSMV will not reinstate your license until you complete a substance abuse education course and evaluation through a DUI program the department licenses. You pay the costs. If you are under 19, your parents or legal guardians are notified of the evaluation results. Skip the course and the suspension effectively continues until you comply.1Justia Law. Florida Code 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review
At 0.08 or higher, the situation shifts entirely. You have now crossed the threshold for a standard criminal DUI under Florida Statute 316.193, and prosecutors can file criminal charges on top of the administrative suspension.2Florida Senate. Florida Statutes 316.193 – Driving Under the Influence The two tracks run independently. A conviction can bring fines, probation, jail time, mandatory DUI school, and a court-ordered revocation that stacks on top of what FLHSMV has already imposed, and the two suspension periods may not run concurrently.
The 10-Day Window to Challenge the Suspension
You have 10 days from the date of the notice to request either a formal or informal review of the suspension through FLHSMV’s Bureau of Administrative Reviews. Either request costs a $25 filing fee submitted to the office listed on your notice.3Department of Highway Safety and Motor Vehicles. Application for Formal/Informal Review of Driver License Suspension/Disqualification Miss the deadline and you lose the right to challenge the suspension at all.
If you file in time, FLHSMV issues a temporary business-purposes-only permit that lasts until your hearing, which must be scheduled within 30 days.4Online Sunshine. Florida Statutes 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review
Informal Review
An informal review is paper-only. A hearing officer reads the materials submitted by the arresting officer along with anything you provide. No witnesses, no testimony. It is faster but your challenge is limited to what the documents show, and if the paperwork supports the stop, the suspension will almost certainly stand.4Online Sunshine. Florida Statutes 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review
Formal Review
A formal review is a live proceeding where the hearing officer takes testimony and can issue subpoenas. You can subpoena the arresting officer and whoever administered the breath test. This is the key practical advantage: if a subpoenaed officer fails to appear, FLHSMV must invalidate the suspension.4Online Sunshine. Florida Statutes 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review If you request a formal review and then fail to show up without good cause, the hearing officer treats it as a waiver and keeps the suspension in place.
Getting a Hardship License
After your temporary permit expires, you can apply for a restricted license for business or employment purposes under Florida Statute 322.271, but not immediately. You have to wait at least 30 days after your last temporary permit expires before applying.4Online Sunshine. Florida Statutes 322.2616 – Suspension of License; Persons Under 21 Years of Age; Right to Review That means at least a month with no driving privilege at all.
A business-purposes-only license covers driving to and from work, on-the-job driving, educational trips, medical appointments, and driving to church. An employment-purposes-only license is narrower and covers only commuting and on-the-job driving required by your employer.5Florida Senate. Florida Statutes 322.271 – Authority of Department to Reinstate Driving Privilege At the hardship hearing you have to show that the suspension creates a serious hardship affecting your work or education. FLHSMV typically requires proof of enrollment in or completion of a substance abuse education course as a condition of the restricted license.
Why Driving on the Suspension Is a Serious Mistake
The administrative suspension does not create a criminal record on its own. Driving on it does. Under Florida Statute 322.34, knowingly driving on a suspended license is a second-degree misdemeanor on a first offense, carrying up to 60 days in jail and a fine. A second conviction is a first-degree misdemeanor with up to a year in jail. A third or later conviction can become a third-degree felony when any of the suspensions tie back to a DUI or test refusal, and zero tolerance suspensions fall into that category.6Online Sunshine. Florida Statutes 322.34 – Driving While License Suspended, Revoked, Canceled, or Disqualified A six-month civil suspension can turn into a felony record. The hardship license route exists so you do not have to take that risk.
The Suspension Follows You Out of State
FLHSMV reports the suspension to the National Driver Register, a federal database maintained by the National Highway Traffic Safety Administration. Its Problem Driver Pointer System flags anyone whose driving privilege has been suspended and directs other states to Florida’s records.7NHTSA. National Driver Register (NDR) Moving to another state will not clear it. Applying for a license elsewhere will not hide it. Employers who run motor vehicle record checks for delivery jobs, rideshare driving, or any position involving a company vehicle will see it. The suspension sits on your driving record rather than a standard criminal background check, but for any job that requires driving, the effect is the same.
