Is Food Taxed in New York? Exempt Items, Rate, and SNAP

Food is taxed in New York only in specific situations: most unprepared groceries you take home from a store carry no sales tax, but prepared meals, restaurant food, sandwiches, candy, soft drinks, and fruit drinks with less than 70% juice are taxable. The dividing lines get specific once you leave the produce aisle, so the details below matter more than the general rule.

Groceries That Carry No Sales Tax

New York exempts food and food products sold for human consumption, as long as they’re sold unheated and in the same packaging you’d find at a typical retail food store.1New York State Senate. New York Tax Law 1115 – Exemptions From Sales and Use Taxes That covers the bulk of a normal grocery run:

  • Fresh fruits, vegetables, meat, poultry, fish, seafood, and eggs
  • Milk, butter, cheese, yogurt, and prepackaged ice cream
  • Bread, cereal, pasta, rice, flour, sugar, cooking oil, spices, sauces, and condiments
  • Canned goods and frozen foods, including frozen dinners and entrees
  • Plain snack foods like potato chips, pretzels, popcorn, crackers, and cookies
  • Dietary foods, health supplements, and vitamins

The snack category has a catch. Plain pretzels are exempt, but chocolate-covered pretzels are taxable. Regular peanuts are exempt, but honey-roasted or candy-coated nuts are not.2Department of Taxation and Finance. Groceries That Are Taxable

Several categories get taxed even when you buy them at a supermarket and take them home.

Candy, confectionery, and gum are always taxable. That includes candy bars, chocolates, fudge, licorice, gummies, mints, chewing gum, cotton candy, peanut brittle, and candied apples.3Department of Taxation and Finance. Candy and Confectionery Sugar-free and dietetic candy is taxed the same way. Any fruit, nuts, or popcorn combined with chocolate, sugar, honey, or caramel falls into this category too.

Hot food and prepared items are taxable regardless of where you buy them. Rotisserie chicken, soup from a hot bar, heated sandwiches, and anything sold from a steam table gets taxed. So do deli salads, prepared meal kits, and catering platters.

Sandwiches are taxable whether hot or cold, and New York’s definition is wider than most shoppers assume. A sandwich is any prepared, ready-to-eat food served on bread, a bagel, a roll, in a pita, or in a wrap. A buttered bagel counts. So does a burrito, a gyro, a hot dog on a bun, and a six-foot submarine sandwich.4Department of Taxation and Finance. Sandwiches If it involves bread or a bread-like wrapper with any filling or spread, it’s taxable.

Restaurant, cafe, deli, food truck, and catered meals are always taxable, whether you eat in or take out.5New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax Any cover charges or service fees on the receipt get taxed too.

Which Drinks Get Taxed

Beverage rules trip people up because the tax turns on what’s in the bottle, not where you bought it.

Exempt at grocery stores and beverage centers:

  • Bottled water
  • Fruit juice containing 70% or more natural juice
  • Coffee, tea, and cocoa sold unbrewed in retail packaging (ground coffee, tea bags, cocoa powder)
  • Milk and milk-based drinks

Taxable even at a grocery store:

  • All carbonated soft drinks and sodas
  • Fruit drinks with less than 70% juice, which catches many popular brands that look like juice but are mostly water and sugar
  • Beer, wine, and all alcoholic beverages

The 70% threshold is worth checking on the label. A bottle of 100% orange juice is tax-free; a fruit punch or lemonade with 20% juice is taxed the same as soda.1New York State Senate. New York Tax Law 1115 – Exemptions From Sales and Use Taxes

Vending Machines

Vending machines follow their own rules. Unheated food from a vending machine, other than sandwiches, is generally exempt just as it would be in a grocery store.6Department of Taxation and Finance. Food and Beverages Sold from Vending Machines

Items that would normally be taxable in a store, like candy, soft drinks, low-juice fruit drinks, and bottled water, get a low-price exemption from vending machines:

  • $1.50 or less from a machine that accepts only coins and cash
  • $2.00 or less from a machine that accepts credit or debit cards

Hot beverages from vending machines are always exempt regardless of price.5New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax A cup of vending machine coffee carries no tax even though a cafe would charge tax on the same drink.

The low-price vending machine exemption for candy, soft drinks, and bottled water is written into the Tax Law with an expiration date of May 31, 2026.1New York State Senate. New York Tax Law 1115 – Exemptions From Sales and Use Taxes Unless the legislature renews it, those items become taxable at any price from a vending machine after that date. The exemption for other unheated food items is not affected.

Pet Food

The grocery exemption only covers food for human consumption, so dog food, cat food, treats, and other animal feed are taxable wherever you buy them.2Department of Taxation and Finance. Listings of Taxable and Exempt Foods and Beverages Sold by Food Stores and Similar Establishments Food bought specifically for a guide dog, hearing dog, or service dog is the one exception.

The Rate When Food Is Taxable

The state sales tax rate is 4%, and counties (and some cities) add their own local rate on top.7Department of Taxation and Finance. Find Sales Tax Rates Localities within the Metropolitan Commuter Transportation District, which covers New York City and surrounding counties, add a 0.375% surcharge. The combined rate in New York City reaches 8.875%, among the highest in the state. Most other areas fall between 7% and 8%. The Department of Taxation and Finance publishes an online lookup tool for the exact rate at any address.

SNAP and WIC Purchases

Food paid for with SNAP benefits is exempt from all sales tax. Federal law prohibits any state that participates in SNAP from collecting sales tax on purchases made with program benefits.8GovInfo. 7 USC 2013 – Establishment of Program This overrides every other rule on this page. Candy, soft drinks, and other items that would normally be taxed become tax-free when purchased with SNAP.

WIC works the same way. Federal regulations prohibit vendors from collecting sales tax on authorized foods bought with WIC food instruments or cash-value vouchers.9eCFR. 7 CFR Part 246 – Special Supplemental Nutrition Program for Women, Infants and Children If tax appears on a WIC-eligible purchase paid with WIC benefits, that’s an error to raise at the register.
