Gabapentin is not a controlled substance in Indiana under either federal or state drug schedules, but Indiana treats it more strictly than most states do. Since July 1, 2019, every gabapentin prescription has been tracked through the state’s prescription monitoring database, and possessing gabapentin without a valid prescription is a Level 6 felony under Indiana’s Legend Drug Act.1Indiana Professional Licensing Agency. News and Important Announcements That middle-ground status surprises a lot of patients who assume a widely prescribed nerve-pain medication carries no criminal exposure.
Monitored, Not Scheduled
The federal Controlled Substances Act does not list gabapentin, and Indiana has not added it to the state’s controlled-substance schedules. What Indiana did in 2019, through House Enrolled Acts 1246 and 1542, was fold gabapentin into the Indiana Scheduled Prescription Electronic Collection and Tracking program, known as INSPECT. The state was explicit that the change “does not schedule or affect the prescribing of Gabapentin.”1Indiana Professional Licensing Agency. News and Important Announcements
The statutory mechanism is a definitional one. Under IC 25-26-24-2.5, the term “controlled substance” as used in the INSPECT chapter “includes gabapentin,” even though gabapentin itself remains unscheduled.2Indiana General Assembly. Indiana Code 25-26-24-2.5 – Controlled Substance In practical terms, gabapentin is monitored like a controlled substance without carrying the refill limits, quantity caps, or special prescription forms that true scheduling would impose. Pharmacies report every gabapentin dispensation to INSPECT within 24 hours, and prescribers can query the database before writing a new prescription.
Indiana’s approach is unusual but not unique. A handful of states have gone further and classified gabapentin as a Schedule V controlled substance, which does impose refill and record-keeping limits. Most states still treat it as an ordinary prescription drug with no special monitoring at all. Indiana sits between those two camps.3National Library of Medicine. Possessing Gabapentin Without a Prescription Is a Felony
Gabapentin is a legend drug in Indiana, which means a valid prescription is required to possess it legally. IC 16-42-19-13 prohibits possession of any legend drug unless you obtained it through a practitioner’s prescription, a drug order, or another exception authorized by the Board of Pharmacy.4Indiana General Assembly. Indiana Code 16-42-19-13 – Possession or Use of Legend Drug or Precursor
The penalty is stiffer than most people expect. Under IC 16-42-19-27, knowingly violating the Legend Drug Act is a Level 6 felony.5Indiana General Assembly. Indiana Code 16-42-19-27 – Violations; Prior Offenders; Anabolic Steroids A Level 6 felony carries a fixed prison term of six months to two and a half years, with an advisory sentence of one year, plus a possible fine of up to $10,000.6Indiana General Assembly. Indiana Code 35-50-2-7 – Level 6 Felony A prior conviction under the same section bumps the charge to a Level 5 felony.
The scenarios that get people charged are often mundane. Carrying a few of a spouse’s pills in a pill organizer. Holding onto leftover gabapentin from an old prescription and giving some to a relative with similar pain. Being found with loose capsules you can’t tie to a current prescription of your own. Because INSPECT logs every dispensation, law enforcement can confirm quickly whether a valid prescription exists in your name.
Sharing or Distributing Gabapentin
Unauthorized distribution of a legend drug falls under the same penalty structure as unauthorized possession. Giving away, selling, or otherwise transferring gabapentin without authorization is a Level 6 felony, with the same sentencing range and potential $10,000 fine, and a prior conviction elevates the offense to a Level 5 felony.5Indiana General Assembly. Indiana Code 16-42-19-27 – Violations; Prior Offenders; Anabolic Steroids
Indiana law does not distinguish between street sales and informal sharing. Handing a few capsules to a family member who ran out, or splitting a bottle with a roommate who has the same prescription elsewhere, both fit the statute’s definition of unauthorized distribution. The INSPECT trail makes gaps in the chain of custody easier to notice, and a pharmacist’s dispensation record will not match a second person’s possession.
What This Means if You Have a Valid Prescription
If gabapentin is prescribed to you, the day-to-day experience is close to any other prescription. There are no monthly limits, no prohibition on refills, and no requirement to see your prescriber for a new paper script each time. The reporting burden sits with pharmacies and prescribers rather than with you.
A few practical points still matter. Keep gabapentin in its original pharmacy-labeled bottle, with your name, your prescriber, and the dispensing date on the label. That label is the simplest proof of lawful possession if the question ever comes up, whether at a traffic stop or at airport security. The TSA allows prescription medications in pill form in carry-on bags without any requirement to declare them; liquid formulations above 3.4 ounces are allowed as medically necessary liquids but must be disclosed to the screening officer before screening begins.7Transportation Security Administration. Travel Tips
If you travel to a state that has scheduled gabapentin, the rules you’re used to in Indiana may not apply. Scheduling states impose refill and quantity restrictions that Indiana does not, so a large travel supply that is unremarkable here may run into limits elsewhere. Check the destination state’s rules before carrying more than a short course.
Driving is the other area worth flagging. Indiana’s operating-while-intoxicated statute includes a per se provision for Schedule I and II substances in the blood, which does not reach gabapentin.8Indiana General Assembly. Indiana Code 9-30-5-1 – Operating While Intoxicated But Indiana’s broader impairment provisions allow an OWI charge based on observed impairment from any substance, and gabapentin’s FDA label warns that the drug can cause dizziness, somnolence, and slowed thinking and motor skills.9Food and Drug Administration. NEURONTIN (Gabapentin) Prescribing Information A valid prescription is not a defense to driving impaired. Until you know how gabapentin affects you, and especially if you combine it with alcohol or other sedating medications, avoid driving.
Could Indiana Reclassify Gabapentin?
The national direction has been toward tighter gabapentin regulation, with additional states moving to Schedule V over the past several years.3National Library of Medicine. A Comprehensive Analysis of Jurisdiction-Specific Laws Related to Gabapentin If Indiana ever formally schedules gabapentin, the consequences would reach past monitoring: stricter refill rules, new prescription paperwork, and possession penalties shifting from the Legend Drug Act into Indiana’s controlled-substance statutes.
For now, the answer to the question is straightforward. Gabapentin is not a controlled substance in Indiana. It is a legend drug that is tracked like one, and the Level 6 felony exposure for possessing or sharing it without a prescription is real.
