Gabapentin is not a controlled substance in Michigan. The state removed it from Schedule 5 effective May 31, 2024, ending the controlled-substance classification that had been in place since January 2019.1Michigan Council of Nurse Practitioners. Pharmacy – Controlled Substances Rules It is still a prescription-only medication, so you need a valid prescription from a licensed provider to possess or use it legally.
What Descheduling Changed
When LARA’s Bureau of Professional Licensing revised the Pharmacy – Controlled Substances Rules in May 2024, several things shifted at once for patients, prescribers, and pharmacies in Michigan:
- Gabapentin prescriptions no longer have to be reported to the Michigan Automated Prescription System (MAPS).
- Prescribers no longer need a controlled substance license to write a gabapentin prescription.1Michigan Council of Nurse Practitioners. Pharmacy – Controlled Substances Rules
- The prior requirement that a provider check a patient’s MAPS report before prescribing more than a three-day supply no longer applies to gabapentin.
- The criminal penalties that attached to unlawful possession or delivery of a Schedule 5 substance no longer reach gabapentin.
Those Schedule 5 penalty tiers, a misdemeanor of up to one year in jail and a $2,000 fine for unlawful possession and a felony of up to two years in prison for manufacturing or delivery, still apply to other substances on the schedule.2Michigan Legislature. Michigan Compiled Laws Chapter 333 Health – 333.7403 They simply no longer apply to gabapentin.
You Still Need a Prescription
Descheduling is not the same as making gabapentin available over the counter. It remains an FDA-approved prescription medication used for nerve pain (including postherpetic neuralgia from shingles), certain seizure disorders, and moderate-to-severe restless legs syndrome. Buying, selling, or possessing gabapentin without a valid prescription is still illegal. If someone offers it to you outside a pharmacy, that transaction remains unlawful even though gabapentin is off Michigan’s schedule.
Federal Status Is Separate
Gabapentin has never been classified as a controlled substance under the federal Controlled Substances Act, and the DEA does not schedule it nationally. Pregabalin (Lyrica), which works on similar brain pathways, is federally scheduled as a Schedule V substance, and the two drugs are sometimes confused. Because gabapentin is unscheduled federally, your prescription does not carry the extra federal controlled-substance paperwork that applies to medications like pregabalin, codeine cough syrups, or benzodiazepines.
Traveling With Gabapentin
Michigan’s rule change applies only inside Michigan. Several other states still classify gabapentin as a controlled substance or require it to be reported through their prescription drug monitoring programs.3ScienceDirect. Keep gabapentin in its original pharmacy-labeled container and carry documentation showing it was prescribed to you.
