Gambling is not legal in Idaho except in three narrow forms spelled out in the state constitution: the Idaho Lottery, pari-mutuel wagering on horse racing, and charitable bingo and raffles run by qualified nonprofits. Everything else — casino table games, sports betting, online gambling, daily fantasy sports, slot machines, and even friendly home poker — falls on the wrong side of Idaho law. Tribal casinos operate on their own lands under federal authority, but the state constitution limits what they can offer.
How Idaho Law Defines Gambling
Idaho Code 18-3801 defines gambling as risking anything of value for gain that depends in whole or in part on chance, a gambling device, or the outcome of an event, including sporting events. The statute names blackjack, craps, roulette, poker, baccarat, and keno as examples of covered casino games.1Idaho State Legislature. Idaho Code 18-3801 – Gambling Defined
A few activities are carved out of that definition. Genuine contests of skill, speed, strength, or endurance where prizes go only to entrants or sponsors do not count as gambling. Neither do valid business contracts, games whose only reward is additional play, merchant promotional contests with no entry fee, or anything the legislature has specifically authorized.1Idaho State Legislature. Idaho Code 18-3801 – Gambling Defined
The skill-game exception is narrower than it sounds. The activity has to be a real competition decided by the participant’s own ability, not something partly resolved by chance, so it does not open a path for poker rooms or skill-gaming lounges.
Why the Ban Runs So Deep
Idaho’s gambling restrictions sit in the state constitution, not just in ordinary statutes. Article III, Section 20 declares gambling “contrary to public policy and strictly prohibited” and permits only the lottery, pari-mutuel betting, and charitable bingo and raffles, each requiring enabling legislation.2Justia. Idaho Constitution Article III, Section 20 – Gambling Prohibited
The constitution goes further. Even within those permitted categories, no one may use “any form of casino gambling including, but not limited to, blackjack, craps, roulette, poker, bacarrat, keno and slot machines,” and the ban reaches electronic or electromechanical imitations of those games.2Justia. Idaho Constitution Article III, Section 20 – Gambling Prohibited That constitutional language is why Idaho has no traditional casinos and why even tribal operations are limited in the games they can spread.
What You Can Legally Do
Play the Idaho Lottery
The Idaho Lottery was created in 1988 after 51% of voters approved a constitutional amendment. It offers scratch games and multi-state draw games like Powerball and Mega Millions, with proceeds going to public schools and the state’s permanent building fund.3Idaho Lottery. Bet on Horse Racing
Pari-mutuel wagering on horse racing is the second constitutional exception. The Idaho State Racing Commission, a self-funded agency within the Idaho State Police, regulates all live and simulcast horse racing.5Idaho State Police. Idaho Racing Commission Live meets still run at venues such as Pocatello Downs, and simulcast wagering lets bettors wager on races broadcast from other tracks.
Dog racing is treated very differently. Idaho Code 54-2514A makes it a felony to participate in or conduct a live dog race with pari-mutuel betting. One narrow carve-out lets a facility licensed before January 1, 1996, continue to offer simulcast wagering on horse and dog races from other locations, but no live dog racing is allowed. Exhibition dog races at county fairs with no betting, and sled dog races, are also exempt.6Idaho State Legislature. Idaho Code 54-2514A – Dog Racing Illegal After the Effective Date of This Act
Play Charitable Bingo and Raffles
Qualified nonprofits can run bingo games and raffles under Idaho Code 67-7701, which requires the activities to be strictly controlled and used to fund charitable purposes.7Idaho State Legislature. Idaho Code 67-7701 – Purpose and Policy Professional operators cannot run these games for a fee or a cut. The organization must hold IRS tax-exempt status and have existed for at least a year in the county where it operates. Licensing is required once annual bingo revenue exceeds $10,000 or raffle prize values exceed $5,000 in aggregate, and the Idaho Lottery administers the program.8Idaho Lottery. Charitable Gaming FAQs
Visit a Tribal Casino
Tribal casinos in Idaho operate under the federal Indian Gaming Regulatory Act of 1988, which lets federally recognized tribes offer gaming on their own lands, with Class III (casino-style) gaming requiring a compact with the state.9National Indian Gaming Commission. Indian Gaming Regulatory Act Because the state constitution bans casino gambling and its electronic simulations, Idaho’s tribal casinos cannot offer traditional blackjack, roulette, or conventional slot machines. Operations such as the Coeur d’Alene Casino and the Fort Hall Casino are generally limited to electronic bingo-style machines and video gaming terminals permitted under their compacts. Visitors expecting a Las Vegas-style floor will find the options narrower.
What’s Illegal, Including Things That Surprise People
Sports Betting and Daily Fantasy Sports

Online Gambling
No form of online gambling is legal in Idaho. Idaho Constitution Article III, Section 20 – Gambling Prohibited Sweepstakes-style social casinos that run legally in other states are also unavailable here for the same reason.
Home Poker Games
Idaho has no social gambling exception. A friendly poker game at a kitchen table is technically illegal under the same statute that covers organized gambling, even when no one takes a rake. Idaho Code 18-3802 makes it a crime both to participate in gambling and to knowingly allow it on property you own or control.11Idaho State Legislature. Idaho Code 18-3802 – Gambling Prohibited
Slot Machines
Possessing a slot machine in Idaho is a misdemeanor, and the statute covers using, operating, keeping, selling, or maintaining one. The only exception is for antique slot machines manufactured before 1950 that are entirely mechanical, with no electronic components, and even those may be owned only for display and never operated.12Idaho State Legislature. Idaho Code 18-3810 – Slot Machines, Possession Unlawful, Exception
Bookmaking
Idaho Code 18-3809 separately criminalizes bookmaking and pool selling. It targets anyone who takes bets for profit, keeps space or equipment for recording wagers, or forwards money for betting. Property owners who knowingly allow their premises to be used for bookmaking face the same liability. The offense is a misdemeanor carrying up to six months in jail and a $1,000 fine.13Idaho State Legislature. Idaho Code 18-3809 – Bookmaking and Pool Selling
