Is Getting Married in Vegas Legit and Binding?

Getting married in Las Vegas is fully legal, and the marriage is binding in every U.S. state and, in most cases, abroad. A Nevada wedding carries the same legal weight as a ceremony performed anywhere else in the country, as long as four things are in place: a valid Clark County marriage license, an authorized officiant, at least one witness, and proper filing of the certificate afterward. The speed and the Elvis impersonators are features of the local wedding industry, not shortcuts around the law.

What Actually Makes a Vegas Marriage Legal

Nevada’s requirements are shorter than most states’, but each one matters. Miss any of them and the ceremony produces no legal marriage, regardless of how real it felt.

A Valid Marriage License

Every legal Las Vegas wedding begins with a license from the Clark County Marriage License Bureau. Both people must appear in person, both must be at least 18, currently unmarried, and not more closely related than second cousins.1Nevada Legislature. Nevada has no blood test and no waiting period, so once the clerk hands you the license you can be married within the hour.3Clark County, NV. How to Get Married in Las Vegas The license costs $102 and stays valid for one year from the date of issue.4Clark County, NV. Fees A ceremony performed after that year is void.

If either of you has been married before, the previous marriage must already be legally ended before you apply. You answer questions about the month, year, and location of the divorce under oath. Marrying while still legally married to someone else is bigamy, a felony in Nevada, so this is not a corner to cut.1Nevada Legislature. Nevada Revised Statutes Chapter 122 – Marriage

An Authorized Officiant and a Witness

Nevada law doesn’t require any particular script or format for the ceremony, but it does require an authorized officiant, at least one witness besides the officiant, and a verbal declaration from both parties that they take each other as spouses.5Nevada Legislature. Nevada Revised Statutes 122.110 – No Particular Form of Solemnization Required; Witness Those spoken vows are the legal core of the marriage. The chapel, the costumes, the drive-through window — none of that affects whether the marriage is valid.

Authorized officiants include judges, justices of the peace, licensed ministers, notaries public, and marriage officiants holding a valid certificate of permission from a Nevada county clerk.5Nevada Legislature. Nevada Revised Statutes 122.110 – No Particular Form of Solemnization Required; Witness If you book through an established Las Vegas chapel, the officiant is almost certainly licensed. If a friend got ordained online for the occasion, verify them through the Nevada Secretary of State’s public officiant search before relying on it.6NVSOS.gov. Nevada Minister Search A ceremony performed by someone with no authority is not a marriage.

The ceremony itself can happen anywhere in Nevada — a Strip chapel, a hotel suite, Red Rock Canyon, a courthouse. Location has no bearing on legality.

Filing the Certificate Within 10 Days

The step most couples don’t think about is the one that turns a ceremony into a legal record. After the wedding, the officiant is required to deliver the signed marriage certificate to the Clark County Clerk’s Office within 10 days.1Nevada Legislature. Nevada Revised Statutes Chapter 122 – Marriage Chapels handle this automatically. A private officiant may not, so confirm in advance that they know the deadline and the process.

About two weeks after the ceremony you can check the filing status through the county’s online portal and order certified copies for $20 each.4Clark County, NV. Fees Certified copies — not photocopies or phone photos — are what the Social Security Administration, DMVs, insurers, and foreign governments accept as proof. Order at least two or three.

Will Your Home State Recognize It?

Yes. A marriage legally performed in Nevada is recognized in all 50 states under the Full Faith and Credit Clause of the U.S. Constitution, which requires every state to honor the public records and legal proceedings of every other state.7National Archives. The Constitution of the United States: A Transcription You don’t register the marriage again when you get home, and you don’t hold a second legal ceremony. Spousal rights that attach to marriage — joint tax filing, inheritance, insurance, hospital visitation — all follow from the Nevada marriage itself.

Taxes Change the Moment You Say “I Do”

The IRS treats you as married for the entire tax year if you are married on December 31. A Vegas wedding on any day of the year — including December 30 — means you file as married filing jointly or married filing separately for that full year.8Internal Revenue Service. Publication 501 – Dependents, Standard Deduction, and Filing Information Late-year weddings can shift your tax picture meaningfully, so it’s worth running the numbers before the trip.

If You Live Outside the United States

Most foreign governments won’t accept a Clark County marriage certificate on its own. They require an apostille, an internationally standardized seal confirming the authenticity of the county official’s signature. Nevada’s apostille is issued by the Secretary of State and costs $20 per document.9Nevada Secretary of State. Fees You need a certified copy of the marriage certificate first, then submit it for authentication.10Nevada Secretary of State. Apostille

Countries that aren’t part of the Hague Apostille Convention use a different authentication process routed through the U.S. State Department. Check with your home country’s embassy or consulate before leaving Las Vegas so you know which version of the paperwork to request.

Can You Undo It Quickly?

Probably not the way the “what happens in Vegas” line suggests. A Nevada marriage is legally binding the moment the ceremony is complete and the paperwork is filed, and ending it requires either a divorce or an annulment. Annulment is not a convenient exit for regret — it’s only available when there was a legal defect in how the marriage was formed.

Nevada allows annulment when a party lacked the capacity to consent at the time of the ceremony, which can include severe intoxication, mental incapacity, or insanity.11Nevada Legislature. Nevada Revised Statutes Chapter 125 – Dissolution of Marriage The bar is higher than most people assume. Being drunk and impulsive is not the same as being legally incapable of understanding what a marriage is. Courts also look at what happened afterward: couples who continue living as spouses after sobering up are much less likely to get an annulment granted.

Other recognized grounds include fraud about something fundamental to the decision to marry, duress, and underage marriage without the proper authorization. If none of those apply, the only way out is a standard divorce, filed through whichever state has jurisdiction over you by then. That is the real answer to whether a Vegas wedding is binding: binding enough that getting out of one looks exactly like getting out of any other marriage.
