Incest is illegal in Ohio, but not under that name. Ohio has no standalone incest crime. Instead, sexual activity between a parent figure and their child or ward is prosecuted as sexual battery under Ohio Revised Code 2907.03, a felony that can carry up to five years in prison and mandatory sex offender registration.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery Ohio also bars marriage between any relatives closer than second cousins, which reaches further than the criminal statute does.
No Separate Incest Statute
Most states define incest as its own criminal offense covering a wide range of relatives. Ohio does not. The conduct is folded into the sexual battery law at ORC 2907.03, which focuses on authority relationships rather than bloodline.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery A prosecutor charging a relative with a sex crime files sexual battery, not incest.
Because the statute is built around parental authority, it reaches a narrower set of relationships than many people assume.
Which Family Relationships Are Covered
Under ORC 2907.03(A)(5), sexual activity is illegal when the offender is the other person’s natural parent, adoptive parent, stepparent, guardian, custodian, or a person standing in place of a parent.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery That last category, known as in loco parentis, covers anyone who has taken on a parental role without a formal legal designation, such as a grandparent raising a grandchild or a live-in partner acting as a parent.
Which Are Not
Siblings, aunts, uncles, nieces, nephews, and cousins are not named in the statute. Two adult siblings, for example, are not covered by ORC 2907.03(A)(5) unless one somehow held a parental or custodial role over the other. If the situation involves a minor, other Ohio sex crime statutes may apply regardless of the family connection, including unlawful sexual conduct with a minor (ORC 2907.04) and rape (ORC 2907.02).
Consent Is Not a Defense
When the charge rests on a prohibited family relationship, consent is legally irrelevant. The prosecution does not have to prove force, coercion, or inability to consent. It only has to prove that sexual activity occurred between two people in one of the listed relationships.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery Both participants can be consenting adults, and the act is still a felony. The law treats the power imbalance in a parent-child relationship as something agreement cannot overcome.
Criminal Penalties
Penalties turn on two things: the type of sexual activity and the age of the other person. Ohio draws a sharp line between sexual conduct (intercourse and similar acts) and sexual contact (touching).
Sexual Conduct
Between adults, sexual battery involving sexual conduct is a third-degree felony. Ohio sentencing law names ORC 2907.03 violations specifically and sets the prison range at 12 to 60 months.2Ohio Legislative Service Commission. Ohio Revised Code 2929.14 – Definite Prison Terms The court can also impose a fine of up to $10,000 per count.3Ohio Legislative Service Commission. Ohio Revised Code Chapter 2929 – Penalties and Sentencing
If the other person is 13 to 17 years old, the charge becomes a second-degree felony with a mandatory prison term. The minimum sentence ranges from two to eight years, and the court has no discretion to avoid incarceration.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery
Sexual Contact
When the offense involves sexual contact rather than conduct, the baseline charge is a fifth-degree felony carrying 6 to 12 months in prison.2Ohio Legislative Service Commission. Ohio Revised Code 2929.14 – Definite Prison Terms If the other person is under 18, the charge rises to a fourth-degree felony.1Ohio Legislative Service Commission. Ohio Revised Code 2907.03 – Sexual Battery
Sex Offender Registration
A sexual battery conviction triggers mandatory registration under Ohio Revised Code Chapter 2950. The tier, and the length and intensity of reporting, depends on whether the offense involved sexual conduct or sexual contact.4Ohio Legislative Service Commission. Ohio Revised Code 2950.01 – Definitions
- Sexual conduct brings Tier III: lifetime registration, in-person verification at the local sheriff’s office every 90 days, and community notification to neighbors and local organizations.
- Sexual contact brings Tier II: a less intensive but still substantial requirement with periodic verification.
Registrants must provide their home address, employer, and school enrollment to the sheriff’s office in every county where they live, work, or attend school.5Ohio Legislative Service Commission. Ohio Revised Code 2950.04 – Duty to Register Failing to comply is itself a felony. A Tier III designation lasts for life, so the registration obligation continues long after the original sentence ends.
Marriage Between Relatives
Separate from the criminal law, Ohio prohibits marriage between people closer than second cousins. ORC 3101.01(A) permits marriage only between individuals “not nearer of kin than second cousins.”6Ohio Legislative Service Commission. Ohio Revised Code 3101.01 – Persons Who May Be Joined in Marriage That bars marriages between first cousins, siblings, parents and children, and other close relatives. A marriage entered in violation of this rule is void under Ohio law.
The marriage restriction is broader than the criminal statute. Two adult siblings who could not be charged under ORC 2907.03(A)(5) still cannot legally marry each other in Ohio.
How Long Can Charges Be Brought
Prosecutors have 25 years from the date of the offense to file sexual battery charges.7Ohio Legislative Service Commission. Ohio Revised Code 2901.13 – Limitations of Criminal Prosecutions This is one of the longest limitation periods in Ohio criminal law. If the victim was a minor at the time, other tolling provisions may extend the deadline further. Within that window, conduct from years or decades earlier can still be prosecuted.
