Is It Illegal to Idle Your Car in California?

Idling your car in California is not itself illegal for a regular driver sitting in the vehicle, but it becomes illegal the moment you step away and leave the engine running on a public road. That specific act is banned under Vehicle Code Section 22515 and carries about $238 in total fines and fees. Different and much stricter rules apply if you drive a diesel commercial truck, a school bus, or if you park near a school.

Leaving Your Car Running While You Walk Away

The rule most passenger-car drivers actually bump into is California Vehicle Code Section 22515. Anyone driving or in control of a motor vehicle cannot let it stand on a highway unattended without first setting the brakes and stopping the engine.1California Legislative Information. California Vehicle Code Division 11 Chapter 9 Section 22515 “Highway” here is broad. It covers virtually any public road or street, not just freeways. Run into a coffee shop with your car idling at the curb and you can be cited.

The base fine is $35. Once California adds mandatory court fees, surcharges, and penalty assessments, the total lands at roughly $238.2California Courts. Sitting in Your Car With the Engine On

California has no statewide time limit on how long a passenger car can idle while someone is inside it. The state’s well-known five-minute idling cap applies only to diesel commercial vehicles, not to cars or pickup trucks.3California Air Resources Board. Breathe Easier, California! Some cities have looked at their own anti-idling ordinances that would cover passenger vehicles. Los Angeles introduced a council motion in 2019 exploring a ban on car idling while parked. Scope and enforcement vary from city to city, so if you idle regularly in a dense urban area, check the local municipal code.

Idling Near a School

The rules tighten dramatically around schools, but the restriction targets buses rather than parents in passenger cars. Under Title 13, Section 2480 of the California Code of Regulations, drivers of school buses, pupil activity buses, youth buses, and general public paratransit vehicles must turn the engine off immediately upon stopping at a school or within 100 feet of a school, and cannot restart it more than 30 seconds before departing.4Cornell Law School. Narrow exceptions apply. The driver can keep the engine running when it is necessary to operate defrosters, heaters, air conditioning, or other equipment that protects the safety or health of the driver or passengers. A turbo-charged diesel can also idle for three to five minutes to cool down before shutoff, per the manufacturer’s recommendation.4Cornell Law School. Cal. Code Regs. The Five-Minute Rule for Diesel Trucks and Buses

If you drive a diesel-fueled commercial vehicle with a gross vehicle weight rating over 10,000 pounds, Title 13, Section 2485 prohibits idling for more than five consecutive minutes at any location in California.5California Air Resources Board. 13 CCR 2485 – Airborne Toxic Control Measure to Limit Diesel-Fueled Commercial Motor Vehicle Idling The clock runs at rest stops, loading docks, distribution centers, and parking lots. Semi-trucks, buses, delivery trucks, and sleeper cabs are all covered.

The rule targets the primary diesel engine. A truck fitted with an approved auxiliary power unit or other idle-reduction device can run that system without triggering the limit. Sitting at a truck stop with the main engine running for cab climate control past five minutes is a violation.

The regulation includes several exemptions. A vehicle stuck in traffic, held at a signal, or directed by a peace officer is not counted as idling. Emergency vehicles can idle as needed while performing their duties. Buses can idle while passengers are on board and for up to 10 minutes before boarding begins. Vehicles running a power take-off to operate a lift, pump, refrigeration unit, or similar equipment are exempt while doing that work. Idling is also allowed when it is necessary for testing, servicing, or diagnostics, and when immediate adverse weather conditions affect safe operation. California does not set a specific temperature that triggers the weather exemption; the standard is safe operation, which leaves room for judgment.5California Air Resources Board. 13 CCR 2485 – Airborne Toxic Control Measure to Limit Diesel-Fueled Commercial Motor Vehicle Idling

What a Ticket Costs

Penalties for violating Section 2485 are steeper than most drivers expect. CARB, local air districts, the California Highway Patrol, and city police can all write citations, and both the driver and the vehicle owner can be held responsible.6California Air Resources Board. California’s Truck Idling Rules Are Enforced

CARB enforcement data from 2014 through 2024 shows fines for a single idling-over-five-minutes violation ranging from $100 to $1,000. Maximum penalties on a per-day basis can reach $5,455 to $10,910, and the most serious enforcement actions have topped out at $42,450.7California Air Resources Board. 2014-2024 Enforcement Penalty Summary Under California Health and Safety Code Section 42402, civil penalties can reach $5,000 per day, doubling to $10,000 per day for intentional or negligent conduct and reaching $15,000 per day if the violation causes actual injury to public health.8California Legislative Information. California Health and Safety Code Section 42402 Criminal prosecution as a misdemeanor is also possible under Section 42400, though rare for idling.9California Legislative Information. Fleet operators face broader exposure. CARB can fine the company directly when an employer fails to ensure compliance, and repeated violations can lead to settlement agreements requiring funding for air quality projects. Idling citations recorded during roadside inspections can also feed into a carrier’s federal safety profile.

Reporting a Truck or Bus That Is Idling

If you want to report excessive idling, CARB accepts complaints from the public. The agency runs online complaint forms for idling near schools and for general commercial vehicle idling. Have the vehicle type, license plate number, date, time, and location ready. CARB will follow up with the vehicle owner. Why It Is Worth Shutting Off Anyway

Even where no ticket is on the table, idling costs you money. Department of Energy research found that idling for more than 10 seconds burns more fuel and produces more carbon dioxide than restarting the engine.11Alternative Fuels Data Center. Which Is Greener: Idle, or Stop and Restart? A mid-sized sedan puts out about 35 grams of CO2 per minute at idle, and heavy-duty trucks burn considerably more.

An idling engine also runs cooler than one under load, and fuel does not burn as cleanly during that extended warm-up. The residue can degrade lubricating oil and accelerate wear on cylinders and pistons over time. Modern fuel-injected engines are built to be driven shortly after startup rather than idled to warm up, a habit carried over from the carburetor era that no longer serves the engine.
