Is It Illegal to Ride in the Bed of a Truck in Georgia?

Riding in the bed of a truck in Georgia is illegal only in a narrow set of circumstances: when the passenger is under 18, the bed is uncovered, and the truck is traveling on an interstate highway. Outside those three conditions, the practice is not prohibited by state law. The driver, not the passenger, is the one charged if the rule is broken.1Justia. Georgia Code 40-8-79 – Unlawfully Riding in Bed of Pickup Truck; Penalty

When It’s Against the Law

O.C.G.A. 40-8-79 makes it a misdemeanor for a driver to transport anyone under 18 as a passenger in the uncovered bed of a pickup truck on any interstate highway in Georgia.1Justia. Georgia Code 40-8-79 – Unlawfully Riding in Bed of Pickup Truck; Penalty All three conditions have to be present at once:

  • The road has to be an interstate. State routes, county roads, and city streets are not covered.
  • The bed has to be uncovered. A camper shell, topper, or similar cover takes the trip outside the statute.2Insurance Institute for Highway Safety. Cargo Area Restrictions Laws
  • The passenger has to be under 18. Adults are not subject to this rule.

The statute lists no exceptions. There is no carve-out for agricultural work, parades, emergencies, or short low-speed trips.1Justia. Georgia Code 40-8-79 – Unlawfully Riding in Bed of Pickup Truck; Penalty

When It’s Legal

Because the statute is so narrow, a lot of truck bed riding stays within the law in Georgia. Adults 18 and older can ride in an open bed on any road, including interstates. Minors can ride in an open bed on any non-interstate road: a two-lane rural highway, a county road, a city street, a driveway. And a minor riding under a camper shell or other cover on an interstate is not covered by the prohibition either.2Insurance Institute for Highway Safety. Cargo Area Restrictions Laws

Penalties If You’re Charged

A driver cited under 40-8-79 faces a misdemeanor. The statute itself does not set a specific fine or jail term, so Georgia’s general misdemeanor sentencing rules apply: a fine of up to $1,000, up to 12 months of confinement, or both.3Justia. Georgia Code 17-10-3 – Punishment for Misdemeanors A first offense with no injuries is unlikely to draw the maximum, but the judge has discretion anywhere within that range.

One thing a conviction will not do is add points to your license. The Department of Driver Services point schedule does not include 40-8-79 among its listed offenses.4Georgia Department of Driver Services. Points Schedule A misdemeanor conviction still shows up on your criminal record, and insurers can weigh any traffic-related conviction when setting rates.

How Georgia Compares to Nearby States

Georgia’s rule is on the permissive end for the region. Alabama has no state law on the subject at all. Florida, South Carolina, North Carolina, and Tennessee each restrict minors more broadly than Georgia does, applying their rules to more road types and spelling out specific exceptions for things like parades, agricultural work, and emergencies.2Insurance Institute for Highway Safety. Cargo Area Restrictions Laws If you are used to another Southeastern state’s law, do not assume Georgia’s is the same in either direction: it is stricter about exceptions (there are none) and far more lenient about where it applies (interstates only).

Legal Doesn’t Mean Safe

Being outside the reach of 40-8-79 does not make an open bed a safe place to ride. One national study found the fatality risk for open cargo area occupants was 3.5 times higher than for front-seat occupants, and roughly 8 times higher than for belted front-seat passengers.5ScienceDirect. Fatality Risk for Occupants of Pickup Truck Cargo Areas The same research found that 34 percent of cargo area deaths occurred in non-crash events, meaning the vehicle itself was not deformed. A hard brake, a swerve, or a pothole at speed can eject an unrestrained passenger. Research on California crashes similarly found cargo area passengers were ejected more often and injured more seriously than passengers inside the cab.6National Center for Biotechnology Information. Injuries to Occupants in Cargo Areas of Pickup Trucks Georgia’s statute sets a low legal floor; the safety judgment above that floor is left to the driver.
