Yes, kratom is legal in Tennessee for adults 21 and older, but only in specific forms and with specific labeling. Tennessee Code 39-17-452 permits the sale and possession of natural kratom leaf and powder while banning synthetic versions of its active alkaloids, and it makes any violation a Class A misdemeanor.1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone
Who Can Legally Buy and Possess Kratom
You must be at least 21 to buy or possess kratom in Tennessee. The statute makes it a crime for anyone under 21 to purchase or possess it, and equally a crime for a seller to distribute kratom to anyone under 21.1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone Simple possession by an adult 21 or older is not criminalized. Retailers should check a government-issued ID before every sale, because the age rule cuts both ways.
What Form Kratom Has To Be In
Only natural kratom is legal. The statute defines “natural form” as dried, cut-and-sifted kratom leaf or raw kratom leaf powder.1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone Extracts, tinctures, and concentrated products go beyond that definition, and selling them can fall outside what the law allows. If you’re buying kratom in Tennessee, loose leaf or plain powder from a properly labeled vendor is the safest bet.
Synthetic versions are flatly prohibited. Producing, selling, or possessing synthetic compounds derived from mitragynine or 7-hydroxymitragynine (kratom’s two primary alkaloids) is illegal under the same statute that covers synthetic cathinones or “bath salts.”1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone The ban applies whether you’re selling or just holding the substance.
The Required Warning Label
Every kratom product sold in Tennessee has to carry the manufacturer’s information and a warning that includes, at minimum, this exact language: “Warning: Do not use if you are pregnant or nursing. It is illegal to possess Kratom if under 21 years of age. Consult your healthcare professional before using. Do not combine with alcohol or medication. Consult a doctor prior to usage if you have any heart disease, liver disorder, high blood pressure, or medical condition or take medication.”1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone
A package missing this warning is illegal to sell even if the powder inside is pure natural leaf. Buyers can use the label as a quick legality check at the counter.
Penalties for Violations
Every offense under 39-17-452 is a Class A misdemeanor.1Justia. Tennessee Code 39-17-452 – Synthetic Derivatives or Analogues of Methcathinone That covers selling without the required label, selling in a form other than natural leaf or powder, selling synthetic alkaloids, selling to anyone under 21, and buying or possessing kratom while under 21. A Class A misdemeanor in Tennessee carries up to 11 months and 29 days in jail, a fine of up to $2,500, or both.2Justia. Tennessee Code 40-35-111 – Authorized Terms of Imprisonment and Fines for Misdemeanors
The penalty is flat: the same classification applies to a retailer who forgot a warning label and to someone manufacturing synthetic mitragynine. The statute does not currently create enhanced penalties for repeat offenses. If a kratom product is laced with a separately scheduled controlled substance, the seller can face additional drug charges under other statutes, and those carry far heavier consequences.
New Rules Taking Effect July 1, 2026
Tennessee’s legislature introduced the Tennessee Kratom Consumer Protection Act (HB2594) with a July 1, 2026 effective date, and it would substantially expand what’s required of kratom sold in the state.3BillTrack50. TN HB2594
The act would require every kratom product to be tested and certified with a Certificate of Analysis, with contaminant limits set at:
- Lead and arsenic: less than 1 part per million (or undetected)
- Mercury: less than 0.3 parts per million (or undetected)
Labels would need two additions on top of the existing warning: a statement that kratom use may be habit-forming, and the standard FDA disclaimer that the product has not been evaluated by the FDA and is not intended to diagnose, treat, cure, or prevent any disease.3BillTrack50. TN HB2594
The bill would also cap 7-hydroxymitragynine at no more than 2% of total alkaloid content and require kratom extracts to meet United States Pharmacopeia standards for residual solvents. Because the legislation was introduced during the 114th General Assembly (2025–2026 session), the final form depends on whether and how it is enacted.
Federal Status and Imported Kratom
Kratom is not a federally scheduled controlled substance. The DEA has not placed mitragynine or 7-hydroxymitragynine on any schedule, so there is no federal criminal prohibition on possessing or selling natural kratom.
The FDA takes a different posture at the border. Under Import Alert 54-15, the agency authorizes customs districts to detain imported kratom shipments without physically examining them, treating kratom as an adulterated dietary supplement because it is a “new dietary ingredient” without adequate safety evidence.4U.S. Food and Drug Administration. Import Alert 54-15 – Detention Without Physical Examination of Dietary Supplements and Bulk Dietary Ingredients That Are or Contain Mitragyna Speciosa or Kratom Vendors on the FDA’s Red List face automatic detention. If you order kratom from an overseas vendor, there’s a real chance the shipment is stopped at customs, even though buying kratom locally in Tennessee is legal.
Kratom and Drug Testing
Standard workplace drug panels (the common 5-panel and 10-panel tests) do not screen for kratom alkaloids. One caveat: research found that the Thermo Scientific CEDIA Methadone Metabolite immunoassay produced false positive results in the presence of kratom metabolites.5ResearchGate. A Kratom Metabolite Causes False Positive Urine Drug Screening Results for Methadone If you use kratom and are subject to workplace testing, telling the medical review officer up front can prevent a false positive for methadone from creating problems before a confirmatory test clears it.
