Is Marijuana Illegal in Dubai? Penalties, CBD, and Medical Rules

Yes, marijuana is illegal in Dubai, and it is illegal everywhere else in the United Arab Emirates. Federal Decree-Law No. 30 of 2021 treats cannabis, hashish, THC edibles, vape cartridges, and every other form of the drug as a controlled narcotic with no recreational allowance and no recognition of foreign medical prescriptions.¹ Penalties begin at three months in jail for a first personal-use offense and rise to life imprisonment or the death penalty for trafficking.²

The UAE government describes its approach as zero tolerance, and enforcement takes that language literally. There is no legal distinction between “soft” and “hard” drugs, and the same criminal framework applies whether someone is stopped with a single joint or a shipment.¹ Tourists face the same rules as residents.

Penalties for Personal Use and Possession

Under Article 42 of Federal Decree-Law No. 30 of 2021, personal use or possession of cannabis carries escalating penalties by offense:²

First offense: at least three months in prison, or a fine of AED 10,000 to AED 100,000 (roughly $2,700 to $27,200).
Second offense within three years: at least six months in prison, or a fine of AED 20,000 to AED 100,000.
Third or later offense: at least six months in prison and a fine of AED 50,000 to AED 200,000. The court must impose both.

Non-citizens can also be deported. Since Cabinet Resolution No. 43 of 2024, judges have discretion over deportation rather than ordering it automatically, and non-resident foreigners caught with small amounts at a UAE port of entry may be fined AED 5,000 to AED 20,000 and allowed through after payment. A repeat violation at a port of entry can trigger a two-year entry ban.³

When Possession Turns Into Trafficking

Penalties jump sharply if authorities believe a person intended to sell, distribute, or promote narcotics. Under Articles 57 and 58, trafficking offenses can carry life imprisonment. If the offender is linked to an organized gang or hostile group, or the court finds clear trafficking intent, the sentence can be death.²

Intent to traffic does not require being caught mid-sale. Larger quantities, packaging materials, scales, and messages on a phone can all be used to build that inference, which is how a case that starts as simple possession can turn into something much worse.

CBD, Hemp, and Edibles

Travelers who assume CBD or hemp products are safe because they are legal at home are walking into one of the most common traps at Dubai’s borders. The UAE has a federal decree-law regulating industrial hemp, but it applies only to licensed industrial and medical manufacturing inside the country. It explicitly bans personal or recreational hemp use, as well as the import of hemp-based food products, dietary supplements, veterinary products, and smoking products.⁴

A narrow exception exists for cosmetics containing oils extracted from industrial hemp seeds or stalks. Anything that produces a narcotic or psychoactive effect still falls under the narcotics law regardless of how it is labeled.⁴ Gummies, tinctures, vape oil, and CBD capsules are all treated as prohibited.

Medical Marijuana Cards and Prescriptions From Abroad

A medical cannabis card or a doctor’s prescription from your home country carries no weight in the UAE. Ministry of Health guidelines state that drugs listed in the relevant international narcotic schedules cannot be brought into the country, even if their use is legal where you traveled from.⁵ Cannabis sits inside those schedules.

Other controlled medications, such as ADHD stimulants, benzodiazepines, and opioid painkillers, may be brought in with the correct paperwork through the Ministry of Health’s pre-travel approval process, but that route is not open for cannabis in any form.⁶

What to Expect at the Airport

Dubai International Airport uses X-ray scanning, sniffer dogs, AI-powered risk tools, and physical inspection, and customs officers are trained in behavioral analysis to spot concealment. Screening is thorough by design.

Enforcement reaches further than what is inside a suitcase. Authorities have prosecuted travelers over trace amounts of cannabis found on clothing or personal items, and residual THC in the bloodstream from use in another country has been treated as grounds for criminal charges. The 2024 port-of-entry reforms have softened outcomes somewhat for first-time visitors caught with small traces, but the underlying exposure remains.

Drug testing can also be initiated by employers, police during routine stops, and hospitals, and a positive result triggers the same criminal provisions. THC metabolites stay detectable in blood for days and in urine for weeks, so a person who used cannabis legally before flying can still test positive on arrival. Check every bag, pocket, and jacket before you travel, and understand that ignorance of the law is not a defense.

If You Are Arrested

Anyone charged with an offense punishable by death or life imprisonment has the right to a lawyer at trial, appointed by the court at state expense if they cannot afford one. For other serious drug charges, a court-appointed attorney can be requested after showing an inability to pay.⁷

For U.S. citizens, the embassy in Abu Dhabi or the consulate in Dubai can visit you in detention, monitor conditions, provide a list of local attorneys, contact your family, and help transfer money. They cannot secure your release, provide legal counsel, or intervene in the case itself.⁸ Other governments run similar consular services; contact yours before you travel to know what is available.

Proceedings run in Arabic, so a non-Arabic speaker needs both a translator and a lawyer. Drug defense fees in the UAE are substantial and cases can take months. Hiring experienced local counsel as early as possible after an arrest matters more than almost any later step, because the investigation and interrogation phase often shapes the outcome before the trial begins.
