Recreational marijuana is not legal in Kauai, and the question of whether marijuana is legal here has a narrow answer: the only lawful way to possess or use cannabis on the island is through Hawaii’s Medical Cannabis Registry Program, which is open to both residents and qualifying visitors. Hawaii has decriminalized possession of three grams or less, treating it as a $130 civil fine, but anything above that threshold is a criminal offense, and federal law still treats all cannabis use as a crime regardless of what the state allows.
Years of legislative attempts to legalize adult-use cannabis in Hawaii have failed to clear both chambers. Until that changes, every non-medical use of marijuana on Kauai is illegal under state law.
What Happens if You’re Caught Without a Card
Hawaii charges marijuana possession as “promoting a detrimental drug,” and the degree of the offense depends entirely on weight. The jump from a civil fine to a criminal record happens at just over three grams, which is roughly a small handful.
- Three grams or less: a non-criminal violation, $130 fine, no jail, no criminal record.1Justia Law. Hawaii Code 712-1249 – Promoting a Detrimental Drug in the Third Degree
- More than three grams but less than one ounce: a petty misdemeanor, up to 30 days in jail and a fine of up to $1,000.1Justia Law. Hawaii Code 712-1249 – Promoting a Detrimental Drug in the Third Degree
- One ounce to one pound: a misdemeanor, up to one year in jail and a $2,000 fine.
- One to two pounds: a felony, up to five years in prison and a $10,000 fine.
- Two to twenty-five pounds: a felony, up to ten years in prison and a $25,000 fine.
- Twenty-five pounds or more: a felony, up to twenty years in prison and a $50,000 fine.
Visitors sometimes assume Hawaii is relaxed about cannabis because of the three-gram threshold. It isn’t. Intent to distribute carries steeper penalties under separate statutes.
The Medical Card Is the Only Legal Path
Hawaii’s medical cannabis program covers a specific list of conditions under HRS 329-121: cancer, glaucoma, lupus, epilepsy, multiple sclerosis, rheumatoid arthritis, HIV/AIDS, and post-traumatic stress disorder. You can also qualify if your condition or its treatment causes severe pain, severe nausea, seizures, wasting syndrome, or persistent muscle spasms.2Justia Law. Hawaii Code 329-121 – Definitions
Residents apply through the Department of Health’s online portal with a driver’s license, state ID, or passport. A licensed physician or advanced practice registered nurse must certify in writing that you have a qualifying condition and that the potential benefits of cannabis outweigh the health risks for your situation.3Justia Law. Hawaii Code 329-122 – Medical Use of Cannabis Conditions of Use Once approved, you get a “329 card” that authorizes you at dispensaries and gives you an affirmative defense against prosecution for possession, as long as you strictly follow every program rule.4Justia Law. Hawaii Code 329-125 – Protections Afforded to a Qualifying Patient Exceed your supply, consume in a prohibited location, or let your registration lapse, and those protections disappear.
How Visitors Register
Visitors to Kauai can access the program through a temporary out-of-state registration. You need a valid medical cannabis card issued by your home state or territory and a government-issued photo ID. Cards from private medical marijuana evaluation companies do not count; this trips up California visitors in particular, and applications with non-governmental cards get denied.5Hawaii Department of Health. You apply through the Department of Health’s online portal. Each registration covers a 60-day period, and you can apply up to two times per calendar year. Applications open 60 days before your desired start date, so you can have the permit in hand before you land. The application fee is $49.50 and is non-refundable.6Hawaii Department of Health. Where to Buy on Kauai
Dispensary access on Kauai runs through Green Aloha, which operates two locations. The Kapa’a location is at 4-1565 Kuhio Highway, and the Koloa location is at 2827 Poipu Road. Both are open daily from 9:00 a.m. to 6:00 p.m.7Hawaii Department of Health. Kauai Dispensary Location
Bring your 329 card or out-of-state temporary registration and a government photo ID. Federal banking restrictions keep most cannabis businesses on a cash basis; some offer app-based payment linked to a bank account, but bring cash as a backup. Hawaii’s prescription drug exemption does not cover cannabis, so expect the standard 4% general excise tax plus the Kauai county surcharge, for a combined 4.5%, added at checkout.
The law caps your “adequate supply” at four ounces of usable cannabis at any given time, counting any combination of flower and manufactured products like edibles or concentrates.2Justia Law. Hawaii Code 329-121 – Definitions
Where You Can and Can’t Use It
A card lets you possess cannabis. It does not let you use it anywhere you want. HRS 329-122 prohibits medical cannabis use in moving vehicles (driver or passenger, including public and school buses), at your workplace, on any school grounds, in public parks, on public beaches, in recreation centers and youth centers, and in any place open to the public.3Justia Law. Hawaii Code 329-122 – Medical Use of Cannabis Conditions of Use
Federal land narrows things further. National wildlife refuges, federal buildings, and military installations fall under federal jurisdiction, where cannabis remains a Schedule I controlled substance regardless of your Hawaii registration. In practice, your private residence or a private outdoor space that is not open to the public is the only safe place to consume on Kauai.
The Traps That Catch Cardholders
A 329 card provides no protection against a DUI. Hawaii law prohibits operating a vehicle while under the influence of any drug that impairs safe driving, and there is no medical marijuana exception. You can be arrested, charged with OVUII (operating a vehicle under the influence of an intoxicant), and have your license administratively revoked. Law enforcement does not distinguish between medical and recreational impairment at a traffic stop.8Hawaii State Judiciary. Frequently Asked Questions – OVUII and Medical Marijuana
Inter-island travel is another trap. Even though your card is valid across Hawaii, state law explicitly prohibits transporting cannabis, usable cannabis, and manufactured cannabis products between islands.9Hawaii Department of Health. Medical Cannabis Use and Restrictions If you fly from Kauai to Oahu or Maui, you cannot bring your cannabis with you.
Mainland travel is more clear-cut. The TSA operates under federal law. Officers do not actively hunt for cannabis, but if they find it during routine screening, they are required to report it to law enforcement.10Transportation Security Administration. Medical Marijuana Your state card carries no weight at a federal security checkpoint at Lihue Airport; the product gets seized, and you could face a federal referral. Buy what you need on Kauai, use it on Kauai.
Employment is the last gap. Hawaii currently gives registered patients no workplace protections. Your employer can test for marijuana and can discipline or fire you for a positive result regardless of your card. A 2026 bill (SB 2998) would bar employment discrimination against cardholders while still allowing fitness-for-duty testing in safety-sensitive roles, but as of mid-2026 it has not passed. If you work in a safety-sensitive position or for a federal contractor subject to DOT drug testing, assume your employer is free to act on your cannabis use.11US Department of Transportation.
