Yes, maternity leave in New York is paid, through two separate state programs that run back-to-back. Paid Family Leave covers up to 12 weeks of bonding time at 67% of your average weekly wage, capped at $1,228.53 per week in 2026. Short-term disability covers your physical recovery from childbirth at 50% of your average weekly wage, capped at $170 per week. Together they give most birthing parents 18 weeks of paid leave after a vaginal delivery or 20 weeks after a cesarean.
How the Two Programs Fit Together
New York splits pregnancy leave into two distinct events. The medical recovery after childbirth is handled through disability insurance. The bonding period that follows is handled through Paid Family Leave. You cannot collect both benefits in the same week, but you can sequence them.
Most birthing parents take disability first, covering the weeks immediately after delivery, then roll into Paid Family Leave for bonding. The standard disability period is 6 weeks after a vaginal delivery or 8 weeks after a cesarean section, plus up to 4 weeks before your due date if pregnancy-related complications keep you from working.1Workers’ Compensation Board. Employee Eligibility and Benefits Add the 12 weeks of PFL bonding on top, and you reach 18 or 20 weeks of paid leave.
There is an overall ceiling. You cannot collect more than 26 weeks of disability and Paid Family Leave benefits combined in any 52-week period.2Paid Family Leave. What Paid Family Leave Pays for Bonding
PFL gives you 12 weeks of paid leave to bond with a newborn, newly adopted, or newly fostered child. The benefit equals 67% of your average weekly wage, calculated from your last eight weeks of pay before leave starts. For 2026, the weekly maximum is $1,228.53, based on a state average weekly wage of $1,833.63.4Paid Family Leave. New York Paid Family Leave Updates for 2026
Both parents qualify, regardless of gender or how the child joined the family. Your employer has to hold your job and return you to the same or a comparable position when you come back. Health insurance continues on the same terms as if you were still working, and you keep paying your usual share of the premium during leave.5New York Codes, Rules and Regulations. 12 CRR-NY 380-7.3 Health Insurance During Paid Family Leave
The program is paid for entirely out of employee payroll deductions, so PFL bonding leave is available to you whether or not your employer offers any voluntary parental benefits.
What Short-Term Disability Pays for Recovery
Statutory short-term disability covers the weeks a birthing parent is physically unable to work. The payment is 50% of your average weekly wage, but the statutory cap is $170 per week.1Workers’ Compensation Board. Employee Eligibility and Benefits That cap has not moved in years and does not come close to replacing most New York paychecks.
Many employers offer a supplemental short-term disability policy through a private insurer that pays substantially more. If yours does, find out whether that private plan coordinates with the statutory benefit or replaces it, because the answer changes what actually hits your account.
Once your doctor clears you to return (or your disability weeks run out), you transition into Paid Family Leave for bonding. The handoff is where paperwork tends to stall, so file for both benefits before the baby arrives rather than waiting for one to end before starting the next.
Who Qualifies
Eligibility for Paid Family Leave depends on your hours and your tenure with your current employer:
- If you work 20 or more hours per week, you qualify after 26 consecutive weeks of employment.
- If you work fewer than 20 hours per week, you qualify after 175 days of work, which do not have to be consecutive.
These thresholds apply to most private-sector employees. Public employers can opt in but are not required to.6Paid Family Leave. Eligibility Citizenship and immigration status do not affect eligibility. Most private employers in the state must carry statutory disability insurance for their workers, so if you qualify for PFL you likely qualify for disability too.
If you are self-employed or an independent contractor, you are not automatically covered. You can opt in by buying a combined PFL and disability policy (PFL cannot be bought on its own). Timing matters. Buy within the first 26 weeks of starting your business and you become eligible 26 weeks later. Wait longer and a two-year waiting period applies before you can collect PFL benefits.7Paid Family Leave. Self-Employed Individuals If a pregnancy is anywhere on your horizon, that is a decision to make early.
Remote workers are a boundary case worth checking. The jurisdiction where you physically perform your work generally determines which state’s leave program covers you. If you live in New York and work remotely for an out-of-state employer, or you split time across state lines, confirm with your employer and the insurance carrier which program applies before you plan around New York’s benefits.
How to File
Start on the paperwork at least a month before you plan to go out. You have to give your employer at least 30 days’ advance notice when leave is foreseeable.8Cornell Law School. 12 NYCRR 380-3.1 – Employee Notice Requirements for Paid Family Leave
Claims go to your employer’s insurance carrier, not to a state agency. For the bonding claim you complete your portion of the PFL request, your employer completes theirs, and you attach proof of the child’s birth or placement, such as a birth certificate or a letter from your provider. For disability, your doctor completes medical certification of your inability to work.
After the carrier receives a completed request, it must pay or deny within 18 days or by your first day of leave, whichever is later.9Paid Family Leave. Handling Requests If the carrier denies the claim, it has to send a written explanation and tell you how to challenge the decision through arbitration.
One practical point: your average weekly wage is calculated from your last eight weeks of gross earnings before leave begins. Pull your recent pay stubs and make sure the numbers you report match your employer’s records. Wage mismatches are a common reason claims get delayed.
Taxes on Your Benefits
Paid Family Leave benefits are taxable income on your federal return. The carrier will not automatically withhold federal tax, so either request voluntary withholding or set money aside for April.10New York State Department of Taxation and Finance. New York State Paid Family Leave After months of reduced income, an unexpected tax bill stings.
Short-term disability is taxed based on who paid the premiums. Employer-paid premiums make the benefits taxable. Premiums you paid yourself with after-tax dollars make the benefits tax-free. Premiums paid through a pre-tax cafeteria plan are treated as employer-paid, so those benefits are fully taxable.11Internal Revenue Service. Life Insurance and Disability Insurance Proceeds New York’s statutory disability deductions typically come out of employee wages, so most workers will not owe federal tax on those payments. Check your pay stub if you are not sure.
Federal Protections That Run Alongside
New York’s paid programs do not stand alone. Two federal laws add protections you should know about before you plan your leave.
FMLA
The federal Family and Medical Leave Act gives qualifying employees at companies with 50 or more workers 12 weeks of job-protected, unpaid leave each year. If you qualify for FMLA and PFL both, your employer can require them to run concurrently. The 12 weeks overlap rather than stack. What FMLA adds is federal job protection and a requirement that your employer maintain your health insurance on the same terms as if you were still working.12eCFR. 29 CFR 825.209 – Maintenance of Employee Benefits If you come back and your employer demotes or fires you, FMLA gives you a separate federal claim on top of any state-law remedy.
Pregnancy Discrimination Act and PWFA
The federal Pregnancy Discrimination Act requires your employer to treat pregnancy-related medical leave the same way it treats any other temporary disability. If a coworker recovering from surgery would have the job held open for a given period, so should you.13U.S. Equal Employment Opportunity Commission. The Pregnant Workers Fairness Act, in effect since 2023, goes further. Employers with 15 or more workers must provide reasonable accommodations for limitations related to pregnancy and childbirth unless doing so would cause undue hardship. Accommodations can include modified schedules, extra breaks, temporary reassignment, telework, and leave for recovery or medical appointments.14U.S. Equal Employment Opportunity Commission.
