Is Michigan a Reciprocal State? Which States Qualify?

Michigan has income tax reciprocity with six states: Illinois, Indiana, Kentucky, Minnesota, Ohio, and Wisconsin. If you live in one of those states and earn wages from a Michigan employer, you owe income tax on those wages only to your home state. The arrangement runs both ways, so a Michigan resident working in any of those six states files and pays only in Michigan. Reciprocity covers wages, salaries, and commissions from personal services. It does not cover self-employment, rental income, business profits, or Michigan city taxes.

The Six Reciprocal States

Michigan’s authority to enter these agreements comes from MCL 206.256, which lets the Department of Treasury exempt nonresidents from Michigan income tax when their home state offers Michigan residents the same treatment.1Michigan Legislature.   • Indiana
  • Kentucky
  • Minnesota
  • Ohio
  • Wisconsin

To qualify, your permanent legal residence (your domicile) must be in one of those six states while you earn wages from a Michigan employer. Move to a non-reciprocal state, or otherwise change your domicile, and the exemption ends. What Reciprocity Covers and What It Doesn’t

The agreements reach a narrow band of income: compensation for personal services, meaning wages, salaries, and commissions paid by an employer. They do not reach independent contractor pay, self-employment income, rental income from Michigan property, business profits, or investment income sourced from Michigan.3State of Michigan. Live in Ohio and own a rental in Michigan? That rental income is taxable by Michigan. Run a Michigan business as a sole proprietor from your home in Indiana? Michigan taxes that too. In those situations you file a Michigan nonresident return on the non-wage income.

Independent contractors get caught by this most often. Freelance or 1099 work for a Michigan company is not shielded by reciprocity even if you live in a reciprocal state. Only W-2 wage income qualifies.

City Income Taxes Still Apply

State reciprocity does not touch Michigan city income taxes, and roughly two dozen Michigan cities levy their own.3State of Michigan. So if you commute from Indiana to a downtown Detroit job, your MI-W4 will stop the 4.25 percent state withholding, but your employer should still withhold Detroit’s 1.2 percent city tax. Grand Rapids, Lansing, Flint, and other taxing cities have their own nonresident rates. Check whether your workplace address sits inside a taxing city before you assume reciprocity handles everything.

How to Claim the Exemption with Form MI-W4

Give your employer a completed MI-W4, the Employee’s Michigan Withholding Exemption Certificate. It’s available from the Michigan Department of Treasury or from your payroll department.5State of Michigan. On line 8b, claim exemption as a resident of a reciprocal state. Sign it; the certification is under penalty of perjury.

Timing matters. The MI-W4 has to be with your employer on or before your first day of work. Miss that, and your employer must withhold Michigan tax with no exemptions until the form is on file.5State of Michigan. Once processed, Michigan withholding should stop within one to two pay cycles. Check your stubs to confirm. Stopping Michigan withholding does not automatically start home-state withholding. If your employer has payroll set up in your state, they may begin withholding there. If not, you’ll need to make estimated payments to your home state to avoid a bill and underpayment penalties at filing time.

Remote Work and Reciprocity

Living in a reciprocal state and working remotely for a Michigan employer without physically entering Michigan? You generally owe no Michigan income tax. The Department’s own examples confirm it: an Indiana resident earning compensation from a Michigan employer while working from Indiana owes nothing to Michigan.6State of Michigan. Split schedules get messier. Some employers allocate wages by days worked in each state. For a resident of a reciprocal state, the Michigan days are covered by the agreement and the home-state days are taxable only at home. Either way, a properly filed MI-W4 keeps Michigan withholding off your pay.

If You Live in Michigan and Work in a Reciprocal State

Reciprocity runs both directions. A Michigan resident commuting to a job in Ohio, Indiana, or any of the other four reciprocal states pays no income tax to that state on the wages. The income stays subject to Michigan’s 4.25 percent rate, and you file only in Michigan.7Michigan Department of Treasury. Ask payroll for the right form when you start.

Work in a state that isn’t on the reciprocal list, and the rule flips. You pay income tax in that state and claim a credit on your Michigan return under MCL 206.255. The credit offsets the double taxation but cannot exceed what Michigan would have charged on that same income. It also applies to taxes paid to local governments in other states, the District of Columbia, and Canadian provinces.8Michigan Legislature. Recovering Michigan Tax That Was Withheld by Mistake

If Michigan tax came out of your pay before your MI-W4 was on file, or kept coming out despite the form, you can get it back by filing a Michigan Individual Income Tax Return (MI-1040). Check the nonresident box and attach Schedule NR along with the W-2 showing the withholding.9State of Michigan. Michigan Individual Income Tax Return MI-1040

If you already filed a Michigan return and later spot the error, file an amended MI-1040 with the Amended Return box checked and include Schedule AMD explaining the change.
